HomeMy WebLinkAbout20143179.tiff HEARING CERTIFICATION DOCKET NO. 2014-79 RE: A PLANNED UNIT DEVELOPMENT FINAL PLAN, PUDF14-0007, FOR ONE (1) RESIDENTIAL LOT WITH E (ESTATE) ZONE USES, ELMORE PUD - JONATHAN SCUPIN AND ANN NASH A public hearing was conducted on October 22, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: (Clerk's note: at the applicant's request and by the Board's prerogative the Elmore PUD's name was changed; it was formally known as the Scupin-Nash PUD.) Fi I hereby certify that pursuant to a notice dated October 1, 2014, and duly published October 6, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Jonathan Scupin and Ann Nash, for a Site Specific Development Plan and Planned Unit Development Final Plan, PUDF14-0007, for one (1) residential lot with E (Estate) Zone Uses, Scupin-Nash PUD. Brad Yatabe, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of Planning Services staff into the record as written. He reviewed the location, which is in proximity to Longmont and Frederick, Firestone, Mead and Boulder County, and in the Seymour Subdivision. He explained that this change is necessary for the applicants to correct a violation of use, due to their existing animal (pet reptile) rescue operation, and come into compliance. The applicants received approval for a change of zone on October 30, 2013, which allowed the Colorado Reptile Humane Society to apply for a Use by Special Review, which will be heard next. Mr. Ogle noted that no correspondence has been received from surrounding property owners and the applicants would like to change the name of their property from the Scupin-Nash to the Elmore PUD. Mr. Ogle confirmed most of the neighborhood is zoned (Residential) R -1. a Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements. He said there are no employees, and a negligible number of volunteers and/or visitors to the site. 2014-3179 PL2245 CL' • CA-IpL,P60, +K ttIgo HEARING CERTIFICATION -JONATHAN SCUPIN AND ANN NASH (PUDF14-0007) PAGE 2 E Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, and said the only change would be to Condition of Approval #1.B.5, regarding the preservation and/or protection of the absorption field which will be changed to wording directly from the code: "Activity or use on the surface of the ground over any part of the Onsite Wastewater Treatment System (OWTS) must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed". Ei Ann Elizabeth Nash and Jonathan Scupin, introduced themselves, and showed images of some of the reptiles at their facility. The Colorado Reptile Humane Society was started in 1998 and has been in this location for 13 years. Mr. Scupin said they have 117 animals right now, at times there have been as many as 150, but it is usually around 100. They are both licensed wildlife rehabilitators, excluding venomous snakes. Mr. Ogle explained the PUD is preliminary to the USR, which will address the violation. Ms. Nash said they have two pet dogs, but this is not a kennel in that sense. No public testimony was offered concerning this matter. El Commissioner Conway stated that he remembered that last time they had done outreach with their neighbors. Mrs. Nash said they hold an open house every summer, with signs and balloons, and they have also sent letters explaining what they do, what animals they have, and what they have been doing to achieve compliance with the code. She said they have had no negative feedback and noted it is good that Elmore is a dead-end street without a lot of traffic. IR In response to Chair Rademacher, Jonathan Scupin and Ann Nash indicated they have reviewed, and agree to abide by, the Conditions of Approval, as amended. Mr. Yatabe noted their request to change the name of the PUD from Scupin/Nash to Elmore. Commissioner Kirkmeyer moved to approve the request of Jonathan Scupin and Ann Nash for a Site Specific Development Plan and Planned Unit Development Final Plan, PUDF14-0007, for one (1) residential lot with E (Estate) Zone Uses, Elmore PUD, based on the recommendations of Planning Services staff, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
