HomeMy WebLinkAbout20141150.tiff HEARING CERTIFICATION DOCKET NO. 2014-22 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR14-0004, FOR A 100-FOOT TALL TELECOMMUNICATION TOWER IN THE A (AGRICULTURAL) ZONE DISTRICT - STATE OF COLORADO, CIO BONANZA CREEK ENERGY OPERATING COMPANY, LLC A public hearing was conducted on April 9, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem - EXCUSED Commissioner Sean P. Conway - EXCUSED Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Diana Aungst Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated February 28, 2014, and duly published March 5, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of State of Colorado, do Bonanza Creek Energy Operating Company, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0004, for a 100-foot tall Telecommunication Tower in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Fi Chair Rademacher advised Julie Cozad, Senior Planner at Tetra Tech, Inc., representing Bonanza Creek Energy Operating Company, LLC that, since Commissioners Conway and Kirkmeyer are not able to attend today's hearing, she had the option of continuing this matter to a date with the full Board present. However, if she decides to proceed today, it will require three affirmative votes, or the matter would be denied. Ms. Cozad indicated she would like to proceed. El Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She explained the purpose of the tower is to relay critical operations data from field locations to operators and engineers in Denver. The application includes a Decommissioning Plan and a Co-location Plan. A letter that details the results of applicants contacting other towers and indicating a new tower is required is also included. No light, landscaping, signage or screening plans are required. She reviewed adjacent land use, showed images of the site, and noted she did not visit the actual site as there is no public right-of-way, so the views are from the closest accesses. He stated private access is off County Road 69, via 70 Ranch. He stated they have permission to utilize the eight miles to access their site. Someone will visit the site approximately once a week. Fi Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, and said portable toilets are acceptable during construction. IFEJ Ms. Cozad gave a presentation. She indicated Pam Hora, Project Manager/Senior Planner, was prevented from attending the hearing due to illness. Martin Lohmann, Bonanza Creek, was present for questions. She noted the land owner is the Colorado State Board of Land Commission, and Bonanza Creek is leasing the 1.4-acre lot from them. She explained why the tower is needed, why the location was selected, and why co-location was not an option. ID No public testimony was offered concerning this matter. Ei In response to Commissioner Freeman, Mr. Lohmann confirmed the tower's frequencies are licensed and in a different range from any public safety frequencies the County might use. El Chair Rademacher indicated that Weld County currently has a gap in coverage and is possibly interested in co-locating on this tower. Mr. Lohmann indicated that would be a possibility and he will meet with Mike Wallace, Director of Public Safety Communications, to have that discussion. Chair Rademacher said although the closest residence is four miles away, he would like to confirm the tower lighting will be mitigated. El In response to Chair Rademacher, Ms. Cozad, indicated she, and the applicant, have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as presented. Commissioner Freeman moved to approve the request of State of Colorado, c/o Bonanza Creek Energy Operating Company, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0004, for a 100-foot tall Telecommunication Tower in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Garcia, and it carried unanimously.
