The Weld County Public Works Department has reviewed this proposal. This project falls under the
Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23.
Staff comments made during this phase of the Use by Special Review process may not be all inclusive;
as other issues may arise during the remaining application process.
COMMENTS:
CR 21 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in
the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The applicant shall delineate or dedicate an additional 10-foot of right-of-way parallel to the CR 21 right-
of-way for future build-out.
REQUIREMENTS:
Site Plan:
Show tracking control; it is required to prevent tracking from the site onto the County roadway
Access Permit Application Form:
Show the approved accesses on the plat and label it with the approved access permit number (AP13-
00389).
Noxious Weeds:
Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant
to Section 15-1-180 of the Weld County Code.
Grading Permit: If more than one acre is to be disturbed, a Weld County Grading Permit will be
required prior to the start of construction.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
Traffic Study:
The applicant in the questionnaire is indicating that there will be water tankers accessing the site at 15-
25 trips per 24-hour day. .
Vehicle tracking control pads will be installed and maintained through the life of the site to prevent
tracking of debris onto the County roadway.

Drainage Report:
Comment: The applicant submitted a drainage and water quality capture feature for review from
Ag PROfessionals.
Condition of Approval: A final water quality capture volume report, stamped and signed by a P.E.
registered in the state of Colorado is required.
Development Standard: The historical flow patterns and run-off amounts will be maintained on site.

SUBJECT: USR13-0069 Ulrich Farms, Inc.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility including an oil and gas support and service facility (two water
depots) in the A (Agricultural) zone district.
There is a residence on the parcel which is served by Central Weld County Water
District and an individual sewage disposal system (SP-1100032).
There are two commercial wells which will provide water to the water depots. Well
permit 76132-F and well permit 76133-F are each permitted for industrial, oil and gas
exploration, dust suppression purposes and several other uses.
The application states up to 25 trucks per day could utilize the site.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Portable toilets and bottled water from a commercial source are allowed
in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this Department that portable toilets are allowed
when employees or contractors are on site for less than 2 consecutive hours a day. As
personnel will be on site for a short duration, in accordance with Environmental Health
Services policy the use of portable toilets is allowed.
The dust abatement plan indicates the internal roads and parking areas will be
constructed of road base or gravel. If necessary a water truck, portable sprinkling
system or magnesium chloride will be utilized to control dust.
The waste handling plan states that employee waste will be contained in a dumpster
and disposed of by an approved waste disposal company such as B&C Refuse.
We have no objections to the proposal; however, we recommend the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
the approved Waste Handling Plan, at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved Dust Abatement
Plan, at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in
the Non Specified Zone as delineated in Section 14-9-30 of the Weld County
Code.

6. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or contractors
are on site for less than 2 consecutive hours a day portable toilets are
acceptable. Records of maintenance and proper disposal for portable toilets
shall be retained on a quarterly basis and available for review by the Weld
County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
7. The fresh water storage and loading system shall be operated in a manner to
minimize spills. Fresh water spills should be captured in above-ground
containment areas for reuse or allowed to infiltrate. There shall be no discharge
from this process to surface waters or through the facility's stormwater
management system, in accordance with the Rules and Regulations of the
Colorado Water Quality Control Commission, and the Environmental Protection
Agency.
8. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

After reviewing the documents for a Mineral Resource Development Facility, including Oil and
Gas support and service, the Building Department has the following comments:
A building permit may be required for any new construction, alteration, or addition to any
buildings or structures on the property, per Section 29-3-10 of the Weld County Code.
Permits may also be required for a change of use, please contact the Building Inspection
Department prior to occupying any structure, to confirm the structure has been permitted for that
use. Currently the following codes have been adopted by Weld County: 2012 International
Codes; 2006 International Energy Code; 2011 National Electrical Code.

Dear Ms. Aungst:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S.
Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning
directors, this office will only perform a cursory review of the referral information and provide informal comments.
The comments do not address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot
be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical
availability of water.
The proposal is to use the property for oil and gas support services including two water depots. The
applicant would use existing commercial wells located on the property for a commercial water transfer facility and
depot; no additional buildings or infrastructure is proposed. There is an existing residence on the property that
uses a Central Weld County Water District tap and individual septic system.
The proposed water supply for the depot is two existing wells operating under permit nos. 76132-F and
76133-F. These wells operate pursuant to a Substitute Water Supply Plan (SWSP) approved by this office. For
the plan year of October 1, 2013 through September 31, 2014 the applicant is allowed to pump 180 acre-feet for
industrial uses, equipment washing, oil and gas exploration, development, reclamation, and dust suppression.
The Ulrich Fish Pond Well (permit no. 76132-F) may pump an additional 2.78 acre-feet for the irrigation of 1.3
acres of landscaping and 12.5 acre-feet to maintain the water level in the pond. The uses proposed in the
application appear to coincide with the uses allowed in the SWSP approved through September 31, 2014; future
SWSPs may not allow the same uses or amounts.
The plan map provided in the application materials places the well operating under permit no. 76132-F
more than 200 feet from the decreed and permitted well location. The applicant should verify the well's location to
ensure they are meeting Condition 11 on the permit, which requires that the well be located within 200 feet of the
permitted location.
This office has no objection to the proposal provided the well permits are operated in accordance with
the SWSP or court approved augmentation plan and the terms and conditions on the well permits. Should you
