We, Mark &Jacquelyn Eberl owner of Lot 9 of Eden's Reserve are requesting to vacate the PUD known
as Eden's Reserve PUD in order to do a Recorded Exemption.
The PUD is located in Weld County and was established in 1999. Eden's Reserve P.U.D. consists of 9
lots. The size of lots 1 -8 are approximately 2.5 acres and lot 9 consists of 79.264 acres. We would like
to do a Recorded Exemption on Lot 9, splitting off our home which is on approx 2 acres from the rest of
the acreage. Lot 9 is currently zoned P.U.D.Agricultural . There is one single family residence, one
barn, and a 15.359 acre man made irrigation lake (Logan's Resevoir).The 63.5 acres are currently being
farmed and irrigated by two pivot sprinklers. Since the property is part of a P.U.D., we cannot do a
Reordered Exemption.
It is our intent to sell our current home and build a home on the remaining acreage.
We are asking for the property to be vacated and then rezoned from P.U.D. Agriculture to Agriculture.

In as much as the original PUD was planned as a community subject to Eden's
Reserve HOA rules and conditions, the HOA would like the Eberl's to sell the
property containing their current home at 2672 Grace Way subject to and as an
Eden's Reserve HOA member. (referred to in the proposed replat as Parcel 1)
The HOA will include the property as a full voting member and subject to the rules
and benefits of the HOA, effective on the elate of the sale of the property.
We believe this would be in the best interests of the Eden's Reserve Homeowners,
the new owners of 2672 Grace Way and the Eberl's.
