HomeMy WebLinkAbout20140983.tiff HEARING CERTIFICATION DOCKET NO. 2014-19 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR13-0067, FOR A MINERAL RESOURCE DEVELOPMENT, OIL AND GAS SUPPORT AND SERVICE, INCLUDING OIL AND GAS PROCESSING FACILITIES AND RELATED EQUIPMENT, INCLUDING, BUT NOT LIMITED TO, THREE (3) COMPRESSORS ASSOCIATED WITH GAS PROCESSING OR WHICH COMPRESS GAS TO ENTER A PIPELINE FOR TRANSPORT TO MARKET AND ONE (1) 25-FOOT COMMUNICATIONS TOWER IN THE A (AGRICULTURAL) ZONE DISTRICT — RONALD AND BETTY PAPPENHEIM/BILL BARRETT CORPORATION A public hearing was conducted on April 2, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tern Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated February 14, 2014, and duly published February 19, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Ronald and Betty Pappenheim/Bill Barrett Corporation, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0067, for a Mineral Resource Development, Oil and Gas Support and Service, including Oil and Gas Processing Facilities and related equipment, including, but not limited to, three (3) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market and one (1) 25-foot Communications Tower in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Ei Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He reviewed fencing and landscaping, access, referrals, surrounding land use, and one additional Development Standard in regard to written evidence of an approved Emergency Action and Safety Plan, as well as the necessity for an easement. Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements. He showed images of the road and the site. Access will be off of County Road 68, a gravel road east of the Wells Ranch. El Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions; there are no permanent employees at the site and noise is regulated by the Colorado Oil and Gas Conservation Commission. la Doug Dennison, with Bill Barrett Corporation, representing the applicant, stated production has increased dramatically creating a need for additional compression. He indicated Bill Barrett Corporation has compressor stations throughout the Rockies, and they are used to working in sensitive rural/residential areas and mitigating noise and light issues. He discussed the choice of a location for the project, noting the facility is located in a swale in the middle of the property for additional mitigation. Mr. Dennison said traffic was the top issue for attendees of the public meeting, as well as noise and lights. He described the site, including equipment, and showed what the compressors look like. He talked about the access and reviewed mitigation measures for traffic impact, such as a zero tolerance policy for speeding, and limiting truck traffic during school bus route times. A right-of-way application has been submitted for additional Stop signs and Noise Solutions, Inc., was hired to model the expected noise and control measures to meet state and residential standards; lights will be on sensors, interior and downward/shielded, and off the remainder of the time. In regard to spills and safety: all of the tanks have a triple liner containment system, equipped with electronic level monitoring, are remotely monitored with a leak detection system, and can be automatically shut-down. He said they have been in communication with the Briggsdale Fire Protection District and Weld County's Office of Emergency Management in regard to emergency response and access to the site. Commissioners Kirkmeyer and Conway thanked the applicants for holding a community meeting to address surrounding property owners' concerns proactively. Q In response to Chair Rademacher, Mr. Dennison, representing the applicant, indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards. F Commissioner Conway moved to approve the request of Ronald and Betty Pappenheim/Bill Barrett Corporation for a Site Specific Development Plan and Use by Special Review Permit, USR13-0067, for a Mineral Resource Development, Oil and Gas Support and Service, including Oil and Gas Processing Facilities and related equipment, including, but not limited to, three (3) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market and one (1) 25-foot Communications Tower in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Kirkmeyer. F Commissioner Rademacher noticed that there is no limit on the allowable number of compressors in the Resolution. Mr. Ogle responded that above and beyond three compressors they would have to petition for a minor amendment. Commissioner Conway said the applicant was clear that this USR is for a maximum of three compressors. There being no further discussion, the motion carried unanimously and the hearing was completed at 10:40 a.m. This Certification was approved on the 7th day of April, 2014.
