NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land owned by Tom Scheirman be, and hereby is, exempt from the definition of the terms "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended. The parcel of land on which this request has been made is described as Pt . Lot 5, NW4SW4 Section 9, T5N, R65W of the 6th P.M. , Weld County, Colorado. This property is located on the east side of 1st Avenue approximately 200 feet north of the intersection of 1st Avenue and East 18th Street . The property contains approximately 2. 8 acres of Commercially Zoned property. The request is to split the property into parcels of 1 .413 acres and 1.414 acres. Mr. Scheirman desires to sell one of the lots. Each parcel is proposed to have warehousing facilities located on it . Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the re- quest be approved for the following reasons : 1. The Greeley Planning Commission has indicated the request complies with the City of Greeley Comprehensive Plan and recommends the recorded exemption be approved subject to the conditions contained in a letter dated October 11, 1979. These conditions will be ad- dressed in the following paragraph. 2. The proposed split conforms with the recorded exemption intent clause and the Weld County Comprehensive Plan. The request would be compatible with surrounding land uses. 3. The request complies with the provisions of Section 9-4 (A) of the Weld County Subdivision Regulations. Dedication of an additional 10 feet of right-of-way on the east side of 1st Avenue . b. Drainage conforming with the Greeley Drainage Policy. c. 1st Avenue being constructed to City standards including curb, gutter, and sidewalk when it is improved. The applicant has provided for the additional 10 feet of right-of-way and the recorded exemption plat has been amended to show the additional 10 feet of right-of-way. In reference to items b and c, it is the opinion of the Department of Planning Services Staff that the County does not have the authority under the Recorded Exemption Procedures to require that these conditions be met by the applicant.
