RE: APPROVAL OF RECORDED EXEMPTION NO. 423 - TOM SCHEIRMAN.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 17th day of October, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 423, described as part of Lot 5, Northwest Quarter
of the Southwest Quarter of Section 9, Township 5 North, Range 65
West of the 6th P.M. , Weld County, Colorado, being more parti-
cularly described as follows :
All that part of the North 461. 5 feet of Lot 5,
in the Northwest Quarter of the Southwest Quar-
ter of Section 9, Township 5 North, Range 65
West of the 6th P.M. , Weld County, Colorado
being more particularly described as follows :
Beginning at the Northwest Corner of said Lot 5
and considering the West line of said Lot 5 as
bearing South 00°26 ' 20" East, with all other
bearings contained herein relative thereto;
Thence South 00°26 ' 20" East, along said West
line, 96. 50 feet to the True Point of Begin-
ning;
Thence continuing South 00°26 ' 20" East, along
said West line, 300. 00 feet;

under Section 39-28-101 (10) (d) , CRS 1973, as amended, and

WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this division of land is not within the pur-
poses of the Weld County Subdivision Regulations and the Board
desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Tom Scheirman be, and hereby is, exempt
from the definition of the terms "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 17th day of
October, A.D. , 1979.

RE : Recorded Exemption #423
Dear Commissioners :
The attached application, plat , and related items are in reference to
a request from Tom Scheirman for a recorded exemption. The parcel of
land on which this request has been made is described as Pt . Lot 5,
NW4SW4 Section 9, T5N, R65W of the 6th P.M. , Weld County, Colorado.
This property is located on the east side of 1st Avenue approximately
200 feet north of the intersection of 1st Avenue and East 18th Street .
The property contains approximately 2. 8 acres of Commercially Zoned
property. The request is to split the property into parcels of 1 .413
acres and 1.414 acres.
Mr. Scheirman desires to sell one of the lots. Each parcel is proposed
to have warehousing facilities located on it .
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1. The Greeley Planning Commission has indicated the request complies
with the City of Greeley Comprehensive Plan and recommends the
recorded exemption be approved subject to the conditions contained
in a letter dated October 11, 1979. These conditions will be ad-
dressed in the following paragraph.
2. The proposed split conforms with the recorded exemption intent
clause and the Weld County Comprehensive Plan. The request would
be compatible with surrounding land uses.
3. The request complies with the provisions of Section 9-4 (A) of the
Weld County Subdivision Regulations.

The City of Greeley Planning Commission has recommended approval con-
ditional upon the following:
a. Dedication of an additional 10 feet of right-of-way on the east
side of 1st Avenue .
b. Drainage conforming with the Greeley Drainage Policy.
c. 1st Avenue being constructed to City standards including curb,
gutter, and sidewalk when it is improved.
The applicant has provided for the additional 10 feet of right-of-way
and the recorded exemption plat has been amended to show the additional
10 feet of right-of-way. In reference to items b and c, it is the
opinion of the Department of Planning Services Staff that the County
does not have the authority under the Recorded Exemption Procedures to
require that these conditions be met by the applicant.

RE: Mr. Tom Scheirman Recorded Exemption on Parcel locat-
ed in the 1700 Block of First Avenue, Greeley.
Dear Sirs:
We are requesting a Recorded Exemption to split the afore-
mentioned property into two (2) equal parcels of 1 .413 acres,
more or less, each. The property is presently zoned commer-
cial and the use of the property will comply with the existing
commercial zone of the County, as well as the Industrial zone
of the City for it's property adjacent to the subject property.
Parcel A of the recorded exemption will be occupied by Bruce
Carlisle, and the use will be for the warehousing of dry goods.
We anticipate that Parcel B will be used in the warehousing
capacity also.
We feel that this Recorded Exemption is necessary because
the property, in its present state, is too large for the uses
which have been previously described; and yet, the site is not
large enough for other users. Most of the properties in this
area are smaller parcels, such as those we have requested.

Dear Chuck:
The Greeley Planning Commission reviewed the request by Thomas
Sheirman for a recorded exemption located northeast of First
Avenue and East 18th Street at their meeting on October 9 , 1979 .
The Commission felt that the request was in compliance with the
Greeley Comprehensive Plan and therefore recommended approval
conditioned upon the following:
1. Dedication of an additional 10 feet of right-of-way
on the east side of First Avenue.
2 . Drainage conforming with the Greeley Drainage Policy.
3. First Avenue being constructed to City standards includ-
ing curb , gutter, and sidewalk when it is improved.
