MEMORANDUM 1L ° TO: Diana Aungst, Planning Services DATE: December 16, 2013 FROM: Donald Carroll, Engineering Administrator Public Works Department C � SUBJECT: USR13-0057, Shawn Greathouse (RV, Boat/Camper Storage) The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: CR 50 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate or dedicate an additional 40-foot of right-of-way parallel to the CR 50 right-of-way for full build-out. CR 15 (Telep), south of the 'T' intersection, is a local paved road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. REQUIREMENTS: Site Plan: Show tracking control across both lanes at entrance. Show existing right-of-way at 60 feet and future right-of-way at 140 feet. Access Permit Application Form: The applicant has submitted an application for a small commercial access from CR 50 at the 'T' intersection with Telep Avenue. Tracking control is required across both lanes with adequate drive storage before the gate. The fee is $75.00 (small commercial)for your new access. Show the approved access on the plat and label it with the approved access permit number (AP#). Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code. Traffic Study: The first phase of the project will consist of two buildings totaling 92 units with another 1-5 buildings for a total of 150-400 units over the next 5-10 years. On average 4-5 individuals will access their units per day, with more on the weekends. Development Standard: The historical flow patterns and run-off amounts will be maintained on site. Grading Permit: If more than one acre is to be disturbed, a Weld County Grading Permit will be required prior to the start of construction. Flood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). Improvements and Road Maintenance Agreement: Weld County Public Works is asking the applicant to enter into an Improvements Agreement and post collateral for off-site improvements (haul route) for CR 50. The application indicates there will be no employees stationed at the site. The applicant indicated that at full build out of 400 self storage units, there will be an average of 4-5 clients accessing the site on a daily basis, with some seasonal increases occurring with the RV, boat and camper usage. There will not be an RV dump station on this site. There is an existing residence on the property served by Little Thompson Water District (tap No. 5897) and an individual sewage disposal system (Permit No. SP-0000700). As this is a full time business, permanent drinking water and sewage disposal facilities are required if the number of customers exceeds 10 per day as indicated in Policy 2.2.K. Policy 2.2.K Use of portable toilets and bottled water (revised 5/8/12) Purpose: To define when portable toilets and commercially bottled water are allowed. Policy: Bottled water from a commercial source is allowed in the following circumstances: 1. Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Policy: Portable toilets are allowed in the following circumstances: 1. Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Note: Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. The dust abatement plan indicates the access drive, circulation areas, parking and outside storage spaces will be covered in recycled asphalt. The waste handling plan indicates there will be a trash dumpster on site that will be serviced by a commercial waste handling company. A portable toilet will be provided for the clients. The applicant will need to revise the waste handling plan to include the company providing refuse disposal and the company servicing the portable toilet. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a revised waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include the name, address and phone number of the company providing refuse disposal and the company servicing the portable toilet. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility. If the facility does not exceed 10 customers, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 8. The facility shall utilize the existing public water supply (Little Thompson Water District). 9. The referral that I previously sent mentioned the need of two fire hydrants. Mr. Greathouse will be able to install the two hydrants in phases per the Johnstown Fire Protection District. The first hydrant will provide protection for the first phase of construction and the second will be installed at a later date before final building construction and final completion. This property is within the Johnstown Planning Area. The Johnstown Comprehensive Plan designates the area as Agriculture/Low Density Residential, with long-term development prospects. The applicant has, in our opinion provided adequate screening of the storage facility, including fencing and landscaping. The sight distance on eastbound CR 50 may pose access issues. There is a slight rise just west of CR 15, and eastbound vehicles may not have adequate reaction time for a commercial driveway. Also, during icy periods northbound vehicles on CR 15 tend to slide through the intersection.
