RE: APPROVAL OF RECORDED EXEMPTION NO. 393 - DENNIS AND LORENA
GUSTAFSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 23rd day of May, 1979 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of land, as shown on the plat known as Recorded
Exemption No. 393, being the property of Dennis and Lorena
Gustafson, described as the Southwest Quarter of the Northeast
Quarter of Section 32, Township 5 North, Range 65 West of the
6th P.M. , Weld County, Colorado, being more particularly described
as follows:

Weld, State of Colorado.
does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of
land from the definitions of "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended, and Section 2-lA(3) of the Weld County Subdi-
vision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Dennis and Lorena Gustafson be, and
hereby is, exempt from the definitions of the terms "subdivision"
and "subdivided land" pursuant to its authority under Section
790816
30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A(3)
of the Weld County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
May, A.D. , 1979.

Dear Commissioners:
The attached application, plat and related items are in reference to a
request for a recorded exemption from Dennis and Lorena Gustafson. The
parcel of land under consideration is described as the SW*NE* Section 32,
T5N, R65W of the 6th P. M. , Weld County, Colorado. This property is
located 1/2 mile northeast of the Town of LaSalle. This property con-
tains approximately 40.6 acres of Class I , VI and VII irrigated soils.
The request is to split the property into parcels of 1. 04 acres and 39.6
acres.
As indicated in a letter dated April 10, 1979, it is the applicant ' s
desire to sell the 1. 04 acre parcel to their son and daughter-in-law to
build a residence. The 1. 04 acre parcel is currently in pasture/
natural grasses.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons:
1 . The proposed split conforms with Section 9-2 of the Weld County Sub-
division Regulations (intent clause of the recorded exemption pro-
cedure) , Section 3. 3 A. of the Weld County Zoning Resolution (intent
clause of the Agricultural Zone District ) , and the Weld County
Comprehensive Plan. The use will be compatible with surrounding
agricultural uses. The request will allow agricultural and related
uses to be the predominant land use. There will be no reduction in
the amount of land currently being used for agricultural production.

2. The Town of LaSalle Planning Commission has set forth no objections
to this request.
3. This request complies with the provisions of Section 9-4 (A) of
the Weld County Subdivision Regulations.

TO WHOM IT MAY CONCERN:
We want to get a building permit for a new "family" house to be built on
our place. This will be a home for our son and daughter-in-law, who are now
living in a small house built in 1947 in which my parents lived until their
deaths in 1966 and 1975, and which was originally built as a temporary home for
them and then to be made into a double garage. This is not adequate for a family.
Our own living headquarters is an old house, large, and has many more years
behind it than ahead of it. It is a comfortable hone and we have lived in it for
35 years and raised our family here.
The third house now on the property was built in 1969 for my widowed
mother-in-law, then occupied by another son and daughter-in-law for 5 years,
until 7 months ago when they moved to Loveland because of our sons' job. This
house having been built for one person (elderly) is not adequate for a family,
and in fact has only 3 rooms and bath.
This property is intended for family, even after my wife and I are gone and
is set up this way in our Estate Planning and Will.
The new house to be built will be the home of our youngest son Jace and
family. It will he a modest, useable family home. They do not want to leave this
Place and therefore must have a house built to accommodate a family.
lr wife spoke to Cathy Carter by telephone in regard to getting a new house
permit and we were asked to compose a letter to your office detailing present
buildings on the property and to make known our intentions of keeping this
nronerty as family residences--unforeseen circumstances excluded, of course.
Due to the fact that my mother and father lived in the house to be vacated
for many years and then died there, I do not want to tear the house down now or
to convert it to a double garage at this time at least. An empty house goes to
"pot" rapidly; so unless some other members of our family want to live in it,
we would probably plan to rent it so it will be "kept up". After my retirement,
when I have more time, this hose will probably be converted into the double
garage for which it was originally intended.
The important thing is that we do need a permit so our son and family can
have a home built for a family.
My wife s asked to contact Maurice ;:cMahon, Mayor of. La Salle, in lieu
of a La Salle Administrator and to ;;et a letter from him to present to you as to
w'.ether there would be any objections on the part of the Town of La Salle to our
addi nii another house. my wife talked to "Mac" on the telephone. He stated that
he would be glad to write a letter, but also stated that since this Property has
been owned by us since 1946 and he has known us and our family for this period t

of time, he. would certainly consider this a "family farm" and could see no reason
at all why a permit would not be granted without question.
I am enclosing a "can serve" letter from the Central Weld County Wpter District,
also a rough sketch of our property and buildings as instructed by your department
and showing the approximate location of the new house in regard to property lines.
Also attached is a rough floor plan and basement plan for the new house. The
proposed house will be a ranch style, with 2 bedrooms, 2 baths, living room,
dining room, kitchen, and laundry facilities on the pain floor. Also a fireplace.
The basement will be unfinished at this time, but will eventually contain a
recreation r.,om and spare bedroom. It will be heated by propane and have a propane
water heater, with a Ben Franklin stove in the basement. Exterior will be frame
with brick veneer part way up, but possibly not on all 4 sides (subject to cost).
There is also the possibility of an all brick house (subject to cost).
