SELECT ENERGY SERVICES
A public hearing was conducted on November 26, 2014, at 10:00 a.m., with the following
present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 31, 2014, and duly published
November 5, 2014, in the Greeley Tribune, a public hearing was conducted to consider the
request of United Surface and Minerals, LLC, c/o Select Energy Services, for a Site Specific
Development Plan and Use by Special Review Permit, USR14-0056, for a Mineral Resource
Development Facility, including Oil and Gas Support and Service (water hauling) in the
A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of
record.
e Diana Aungst, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the
record as written. She stated this is a water storage and load-out facility to support oil and gas
operations in the area. It has an 80,000-barrel capacity reservoir with three truck filling bays
and is located beside an existing onsite water well. This is a 300-acre site; an 80-acre parcel
has been split off for this USR and, of that acreage, the facility footprint will cover approximately
10 acres. This is an active zoning violation due to the operation without a proper zoning permit;
if approved, this violation shall be resolved. The maximum number of people using the site is 40
per day. The facility is located on County Road (CR) 74 and in proximity to CR 105. The closest
residence is 1/2 mile to the east. No correspondence has been received from surrounding
property owners. Ms. Aungst showed images of the site and site plan, and reviewed the
proposed haul route for the Board. Ms. Aungst said she did not know the number of residences
along the haul route.

Wayne Howard, Department of Planning Services, provided a brief overview of the
transportation plans and requirements. He gave the Average Daily Traffic count for CR 105, but
stated one is not available for CR 74. There will be a total of 15 truck trips per day with a
maximum of 40 vehicles accessing the site in a 24-hour period. The water will go to nearby
wells. Mr. Howard again reviewed the haul route. He said there will be an Offsite
Improvements or Maintenance Agreement. In response to Chair Rademacher, Ms. Aungst
confirmed that the driveway is long because of the location of the reservoir on the parcel. Mr.
Howard confirmed the traffic count on CR 105 may be due to the existing traffic, because the
site has already been in operation.
El Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions.
El William Fronczak, Select Energy Services, representing the applicant, stated the truck
counts are due to a lot of oil and gas activity in this area. He confirmed there are no residences
on CR 105, so dust will probably not be an issue. Mr. Howard noted there will likely be triggers
for dust control and there is no one currently residing on the nearest property. In response to
Commissioner Kirkmeyer, Mr. Fronczak said they ran trucks out of the facility while they were
developing the well, and he showed the location on the map. He explained that the USR
application was delayed by their corporate structure and changes in ownership. He said the
intent of the facility is to run water lines (fastlines), and ultimately reduce truck hauling to around
two (2) percent. He noted the line froze a few weeks ago, so trucks were obviously needed at
that time.
No public testimony was offered concerning this matter.
Mr. Fronczak confirmed for Commissioner Kirkmeyer that at no time will a full-time
employee be stationed at the site. It is remotely monitored.
El In response to Chair Rademacher, Mr. Fronczak indicated he has reviewed, and agrees to
abide by, the Conditions of Approval and Development Standards, as amended.
Commissioner Freeman moved to approve the request of United Surface and Minerals,
LLC, c/o Select Energy Services, for a Site Specific Development Plan and Use by Special
Review Permit, USR14-0056, for a Mineral Resource Development Facility, including Oil and
Gas Support and Service (water hauling) in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Garcia, and it carried unanimously.

Commissioner Conway thanked the applicants for coming in and rectifying g this violation.
Commissioner Kirkmeyer stated that people are watching the oil and gas industry, and so the
applicant should be careful to adhere to County requirements in the future.
