WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 18th day of December, 1978 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption No. 356, being the property of I. R. Booth and Son, Inc. , described as part of Section 16, Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: The West Half of the Northwest Quarter of Section 16, Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado. Said described parcel of land contains 80.775 acres, more Cr less, including Road Right-of-Way, and is subject to any rights-of-way or other easements as recorded by instnmients of record or as now existing on said described parcel of land. does not come within the purview of the definition of the terms , "subdivision" and "subdivided land, " pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A (3) of the Weld County Subdivision Regulations . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land owned by I. R. Booth and Son, Inc. be, and hereby 780748 is, exempt from the definition of the terms "subdivision" and "subdivided land" pursuant to its authority under Section 30-28- 101 (10) (d) , CRS 1973, as amended. R. Booth and Son, Inc. The parcel of land under consideration is described as the W'NW*, Section 16, T7N, R66W of the 6th P. M. , Weld County, Colorado. This property is located 3 miles west of Ault on the southeast corner of the intersection of Colorado Highway 14 and County Road 29. This property contains approximately 80. 775 acres of Class II and IV ir- rigated soils. The request is to split the property into parcels of 8. 775 acres and 72. 000 acres. As indicated in a letter dated November 9, 1978, it is the applicant ' s desire to sell the 8. 775 acre parcel with improvements. I . R. Booth and Sons will continue the agricultural use of the remaining 72. 000 acres. The applicant has stated that the improvement site is a liabi- lity to their operation due to the problem of keeping the house oc- cupied and maintained. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the re- quest be approved for the following reasons: 1. The request conforms with the intent clause of the recorded exemp- tion procedure (Section 9-2 of the Weld County Subdivision Regu- lations) , the intent clause of the Agricultural Zone District (Section 3. 3A of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan in that the uses will be compatible Board of County Commissioners Page 2 December 18, 1978 with surrounding agricultural uses. The request will allow agri- cultural and related uses to be the predominant land uses. There will be no reduction in the amount of land currently being used for agricultural production. 2. This request complies with the provisions of Section 9-4 A. of the Weld County Subdivision Regulations. We were unable to receive a recommendation from the Town of Ault . The application was sent to the Ault Planning Commission Meeting on Decem- ber 5, 1978. Because there was not a quorum present , the Ault Planning Commission forwarded the application to the Town Board. The applica- tion was tabled at the December 11 , 1978 meeting of the Town Board. In reviewing the Application and Procedures for Recorded Exemption I read that all contingent land is to be in- cluded in the plat and application. It is not my intent to circumvent the County Planning Regulations, but to present the information in a manner fair to myself and the residents of Weld County. Prior to July, 1978 the NWT of Section 16, Township 7 North, Range 66 West of the 6th P.M. had been deeded as two separate parcels. At- tached are copies of deeds back twenty years showing separate acquisition. Therefore, this application ad- dresses itself only to the W1 of said quarter section. The improvement site is not necessary to our farming operation as I. R. Booth & Son, Inc. has a number of farms in the Ault/Eaton area with one headquarters unit located east of Ault. As a result, the improvement site is a liability to our operation due to the problem of keeping the house occupied, together with the resulting maintenance costs and the high degree of vandalism in rural areas.
