RESOLUTION RE: FINDINGS AND RESOLUTION CONCERNING PETITION OF M. G. AND DELLA LINSON FOR A CONDITIONAL USE PERMIT NO. 19 . The petition of M. G. and Della Linson, husband and wife, 1100 Skyline Drive, Fort Collins, Colorado 80521, for a Conditional Use Permit for a single family residence on the following described property, to-wit: A Tract of land in the Southwest Quarter of Section 5, T3N, R68W of the 6th P.M. , in Weld County, Colorado, and being more particularly described as follows : Beginning at the West Quarter (144) Corner of said Section 5, Thence South along the West line of said Section 5, 1113 . 15 feet, thence S89°52 ' 15" E, 334. 49 feet to a point on the approximate centerline of the Supply Ditch, thence along said a proximate centerline of said Supply Ditch the following courses and distances : S17°19 ' 20" E, 182. 98 feet; S31°39 ' 18"E, 514.70 feet; 586°31 ' 16"E, 192 . 33 feet To a point of intersection of the aforementioned Supply Ditch and a large eroded drainage ditch bearing Northeasterly. Thence along the approx- imate centerline of said drainage ditch the fol- lowing courses and distances : N68°15 ' 57" W, 116 . 47 feet; N17°42 ' 54" W, 94. 05 feet; N43°56 ' 24" E, 332 . 20 feet; N14°48 ' 43" W, 100. 55 feet; N31°10 ' 34" E, 364 . 12 feet; N61°19 ' 49" E, 73 . 94 feet; Thence North, 922 . 73 feet to a point on the North line of the aforementioned SW4, Section 5; thence S89°58 ' 34" W, 1172. 43 feet to the point of begin- ning; thus described tract containing 35, 000 acres. came on for hearing on August 16, 1976, and the Board of County Commissioners of the County of Weld, having heard the testimony and evidence adduced upon said hearing, and having considered the testimony, evidence and statements and recommendations of the Weld County Planning Commission filed with said Board, and having carefully weighed the same, now makes the following findings: 1 . The evidence and investigation shows that said Petition is inconsistent with the Weld County Comp- rehensive Plan. PL0608 760136 • 2 . The evidence and investigation shows that the subject property is in fact one of several approx- imately 35-acre parcels which were split out of the Southwest Quarter of Section 5, Township 3 North, Range 68 West of the 6th P.M. in Weld County, Colorado, since 1972 when said Quarter Section was one agricultural unit . The land in question consists primarily of Class II soils which are classified as prime agricultural soils by the Soil Conservation Service. The area could easily support agricultural uses if an urban en- croachment on the land does not occur. 3 . The evidence and investigation shows that the granting of said petition would enhance the con- flict between basically incompatible uses, i . e. , the traditional conflicts between urban and agri- cultural uses . 4 . The evidence and investigation shows that if such urban residential uses , as proposed in the petition of the applicants , are allowed to occur, the cost of providing services to such rural areas can only be increased, thus resulting in overall increased costs to the taxpayers . 5. The evidence and investigation shows that if such development is encouraged, more agricultural lands will be split into parcels which are basically too small to support viable farm operations . 6. That each of the preceding findings in and of themselves and independent of each other, con- stitutes a separate and individual ground for denial of the request for a Conditional Use Permit for a single family residence on the real estate described in said petition. -2- RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld has heard the application of M. G. and Della Linson, husband and wife, for a conditional use permit to place a single family residence on the real estate first described above, and WHEREAS , the Board has made its findings on the evidence and testimony submitted to it, including the independent investigation by the Board, which findings precede this Resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, the said Board has carefully considered the petition, evidence and testimony and the recommendations of the Weld County Planning Commission, and has given the same such weight as it, in its discretion, deems proper, and is now wholly advised in the premises; NOW, THEREFORE, BE IT RESOLVED, that the petition of M. G. and Della Linson, husband and wife , 1100 Skyline Drive, Fort Collins , Colorado , 80521 , for conditional use permit number 19 for the purpose of placing a single family residence on the real estate first described above, be and hereby is denied on each of the grounds as set forth in the Boards' findings herein. The Weld County Planning Commission held a regularly scheduled meeting on Tuesday, July 6, 1976 at 1 :30 P.M. in the County Commissioners Board Room, first floor, Centennial Building, Greeley, Colorado. Reid Tape 631 (#1552-1670) CASE NUMBER: CUP 18 SUBJECT: Radio Tower LOCATION: SE' Sec. 2 T1N R62W APPEARANCE: Mr. Reid DISCUSSION: Mr. Reid explained that he wishes to install a station for the purpose of communicating between the various mobile units of the farm and his home. The radio tower will be 180 feet in height. Range is proposed to be 15 to 20 miles. Mr. Reid also explained that this is slightly over the County line in Morgan County and Adams County, as well as in Weld County. Weld County Planning staff recommends approval for the following reasons: 1 ) A radio tower facility at the proposed location would appear to be compatible with the neighborhood and surrounding area; and 2) The Soil Conservation Service has indicated that soils in the area are stable enough to support the radio tower on a con- crete pad. SUBJECT TO: 1 ) Acquiring a building permit from the Weld County Building Inspection Division. COMMENTS: 1 ) A representa- tive of the Federal Aviation Administration indicated that Mr. Reid is not required to file for any permit with his agency; 2) A repre- sentative of the Federal Communications Commission indicated his agency is not involved in this matter and has no comments; and 3) The Weld County Engineering Department has no objections to this proposal . Tom Honn explained that the Zoning Resolution does not have any requirements for lighting on this type of facility. There is a radio/TV tower adjacent to this property. There are no water requirements involved with this request. Power service will come from Morgan County REA. No one in the audience objected. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners, approval of this request for a radio tower, subject to staff recommendations. Motion by Chuck Carlson. APPLICANT: M.G. and Della Linson Tape 631 (#1671 - 2065) CASE NUMBER: CUP 19 (Portions inaudible) SUBJECT: Single Family Residence LOCATION: Pt. SWa Sec. 5 T3N R68W APPEARANCE: Mr. Linson-and Terry Anderson, Century 21 - Longmont DISCUSSION: When Mr. Linson purchased the property he did not intend to sell it but was transferred to CSU. The piece is now planted in alfalfa. It has ample water. Parcel #2 has a building permit issued on it. Parcel #1 has an existing farm building on it. There are approximately 3'2 acres of dryland and 31 acres of irrigated land involved in Mr. Linson's parcel . Mr. linson feels that the appropriate place to locate a building (residence) would be on the 3-2 acres of dryland. Tom Honn explained that in May of 1972 Mr. Linson and Mr. Luchsinger purchased the 170 acres together. In 1973 Bob Swenson quit claimed his interest to the other three parties in ownership. In May 1973 Parcel #1 (through recorded ex- emption) was deeded to Mr. Swenson. In October of 1973 a fifth party sold parcel #2 to Mr. Hodgson. Parcel #2 is non-irrigated land. Parcels #3, 4 and 5 were all divided in April of 1974. As a result of the latter factor, additional conflicts with surrounding agricultural uses occur. A supply ditch does sever the 3-acre piece- off from the remaining parcel . There is no existing access to the proposed building site. Mr. Linson explained that he had checked with the Planning staff and the County Attorney at some point in the past, and had been informed that there would be no problem with the property if it was recorded prior to a certain date. Mr. Linson' s attorney recorded it two days later. He was told by the County Attorney and Planning staff that a recorded deed was all that was needed . Two years later Mr. Linson learned that he had been misinformed. Kay McEver, Assistant County Attorney, asked Mr. Linson if when he talked to Mr. Telep and the past zoning administrator and they told him a deed would be sufficient, if they indicated that to be true when the regulations had changed or if those changes were not even contemplated at the time Mr. Linson was in the office. Mr. Linson explained that there was some question at the time as to whether Page 1297 or not the 80-acre regulation was in effect. Mr. Telep informed Mr. Linson at that time that if he would have it recorded prior to the next County Commissioners hearing there would be no problem. MOTION: To table this request so that the Weld County Planning staff can investigate and determine what transpired. Motion by J. Ben Nix. Seconded by Chuck Carlson. A vote of "aye" by Hiatt, Elliott, Kountz, Ashley, Heitman, Nix, Carlson, and Yost. Motion Carried. APPLICANT: Roland G. Murren Tape 631 (#2065 - 2232) CASE NUMBER: VI-26 SUBJECT: Violation for Junk Yard LOCATION: Lot 7, Block 1 , Ranch Eggs , 2nd Filing APPEARANCE: Mr. Murren DISCUSSION: Field report indicates that the surrounding property is essentially subdivision tract with the agricultural use being chicken ranching. At the time the property was red-tagged, no one was home. There are several vehicles on the property that are not being used. This field check was made on March 19. Pictures were taken. In April the property was field checked again. Some cleaning had been done and some of the vehicles had been moved to the rear of the property. On April 21 there were soma progresses as far as cleaning and fencing the property. On May 12 there were no further signs of progress. On June 25 the fencing was about 50% completed. Mr. Murren does have an occupation which he sub-contracts to a major outlet to construct fence. As a result, some of the materials are kept on his property. Also, some of the materials on his property are materials that Mr. Murren feels will be useful for construction on his property, as far as adding on to housing, etc. Mr. Honn explained that it had been the feeling of the Planning staff and Mr. Murren that if some of the materials were placejbehind fencing, it would solve some of the problems of complaints regarding the view. Mr. Murren explained that he is using some of the vehicles to house equipment. Two are tied up in a divorce suit at this time, and he doesn' t feel that he can do anything with them. Mr. Murren feels that he has constructed fencing and that he is complying as much as possible. No one in audience commented . RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners that appropriate action be taken regarding this violation. Motion by Percy Hiatt. Seconded by Chuck Carlson. A vote of "aye" by Hiatt, Kountz, Ashley, Heitman, Nix, Carlson, and Yost. Elliott abstained. Motion Carried. Meeting adjourned. Respectfully submitted, / Janna S. Morrow Secretary Page 1298 I 1' Weld County Planning Commission staff recommends the request be tabled for the following reasons: 1 ) Letters of opposition to this proposed expansion have been received from August Gittlein, William Gittlein, and Mr. and Mrs. Sheldon Sickler. Copies of those letters are included in an attached packet; 2) Noise has been identified as one of the problems in the area by the surround- ing property owners. The Planning Commission staff has requested a noise study be done which would indicate: A. The noise level of the existng operation; B. The noise level of the facility with the proposed expansion; and C. How these noise levels com- pare with acceptable noise level ratings at the perimeter of the Special Use Permit area and also at the nearby residences. The requested noise study has not been presented to date; 3) In December, 1972 when the Special Use Permit was granted for the original facility, there was to be a landscape screen planted around the perimeter of the area. According to Amoco, trees were planted, but later died from a dust applied to control weeds on the internal area of the facility. The Planning Commission staff has requested the applicant to develop a landscape plan for visual and noise screening purposes to be plantediaround the perimeter of the Special Use Permit area to be in compliance with the recommendation of the Soil Conservation Service. This has not been done to date; and 4) Another sheet to the Special Use Permit plans needs to be submitted to include the proper certificates and development standards. William Gittlein was present. He lives on Road 19 just south of the plant. He was concerned about the noise, dust and traffic. He stated that a good percentage of the traffic is related to the plant. Dr. -Chinaud explained his ideas for designing noise barriers. He stated that the increase in noise would not be very detectable with the addition of new compressors. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of this request, subject to the noise levels being improved. Motion by Bill Elliott. Seconded by Percy Hiatt. A vote of "aye" by Elliott, Carlson, Weigand , Heitman, Hiatt, Nix , and Kountz. MOTION CARRIED. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners that the Noise Level Report be updated. Motion by John Weigand. Seconded by Mr. Nix . SWa Sec. 5 T3N R68W SUBJECT: Single Family Residence APPEANCE: Mr. Linson Page 1314 • • DISCUSSION: This item was tabled at the July 20, 1976 Planning Commission meeting. Mr. Linson has submitted a letter from Carol Lee to the Planning Commission attempting to establish that Mr. Linson was doing as he had been instructed during the time that Ms. Lee was Zoning Administrator. The Weld County Planning staff recommends denial for the following reasons: 1 ) The proposal at hand is inconsistent with the Weld County Comprehensive Plan. The Plan states that agriculture is a resource in Weld County which must be protected from the impacts of urban growth. To accomplish this objective, the plan states that urban residential , commercial , and industrial uses will be encouraged, to located around existing urban centers so that their impacts will be minimized, and so that the cost of providing the services associated with such uses will be minimized to the greatest extent possible. Inthe pending proposal , the pro- posed use is not an agriculturally related use, but is an urban residential use proposed for a predominately agricultural area . The proposal sets forth no evidence that the use is related to in- tended agricultural uses of the land in question. The subject property is in fact one of several approximately 35-acre parcels which were split out of the SW1 of Section 5, Township 3 North, Range 68 West of the 6th P.M. , since 1972 when said quarter section was one agricultural unit. The land in question consists primarily of Class II soils which are classified as prime agricultural soils by the Soil Conservation Service. The area could easily support agricultural uses if urban encroachment on the land does not occur; 2) The granting of this request would enhance the conflict between basically incompatible uses, i . e. the traditional conflicts between urban and agricultural uses; 3) If such urban residential uses, as proposed in the pending application are allowed to occur, the cost of providing services to such rural areas can only be increased , thus resulting in over- all increased costs to the taxpayer. As stated by the Weld county Comprehensive Plan, such uses should be encouraged to locate around existing urban centers, where the base for providing such services is already established; and 4) Finally, if such development is encouraged, more and more agricultural lands will be split into parcels which are basically too small to support viable farm operations, and too large to be maintained properly by those who work in the city but live in the country. As a result of the latter factor, additional conflicts with surrounding agricultural uses occur. Tom Bonn explained that the Planning Commission staff has not been able to understand where the deeds describing the property match the description submitted by Carol Lee. The property itself is not divided by the ditches. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commisisoners denial of this request based on staff recommendations. Motion by J. Ben Nix. Seconded by Bette Kountz. A vote of "aye" by Elliott, Carlson, Weigand, Heitman, Hiatt, Nix. and Kountz. MOTION CARRIED.
