HomeMy WebLinkAbout20140716.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT #1696 FOR A USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS(AUTO SALES,SALVAGE,SERVICES,AND REPAIR)IN THE A (AGRICULTURAL)ZONE DISTRICT - MANUEL AND ANITA BALDERAS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on July 22, 2009, the Board approved the application of Manuel and Anita Balderas, 2732 County Road 27, Fort Lupton,Colorado 80621,for a Site Specific Development Plan and Use by Special Review Permit#1696 for a Use Permitted as a Use by Right,Accessory Use,or Use by Special Review in the Commercial and Industrial Zone Districts (auto sales, salvage, services, and repair) in the A (Agricultural) Zone District, on the following described real estate, being more particularly described as follows: Lot A of Recorded Exemption #2012; being part of the E1/2 NE1/4 of Section 30, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS,the Board has been presented with the plat for the Bal deras Annexation to the City of Fort Lupton, Recorded at Reception No. 3977995, dated November 14, 2013, documenting that the property is no longer within Weld County's jurisdiction, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present, studied the request and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to refer the matter back to the Department of Planning Services to close the case since the property is no longer within the jurisdiction of Weld County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Site Specific Development Plan and Use by Special Review Permit#1696 for a Use Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial and Industrial Zone Districts (auto sales, salvage, services, and repair) in the A (Agricultural)Zone District, issued to Manuel and Anita Balderas, on the parcel of land described above be, and hereby is, referred back to staff for closure of the case since the property is no longer within the jurisdiction of Weld County. The subject property described as Lot A of RE-2012 located in part of the NE4 of Section 30, T2N, R68W of the 6 P.M., Weld County, CO has been annexed into the Town of Fort Lupton. The Annexation Agreement and Annexation Plat were recorded on 11/14/2013. A copy of the Annexation plat has been included with this memorandum.
