(Custom Farming Operations)
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by
Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments
made during this phase of the Use by Special Review process may not be all inclusive; as other issues may
arise during the remaining application process.
COMMENTS:
CR 80 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
CR 39 is a local paved road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
CR 41 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
Traffic counts: CR 80/39-41, 78 vehicles per day (vpd) in 2008; CR 39, 675 vpd in 2014; and CR 41, 89 vpd in
2008.
REQUIREMENTS:
Access:
Show the approved access on the plat and label it with the approved access permit number (AP#).
Noxious Weeds:
Should noxious weeds exist on the property or become established as a result of the proposed development,
the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of
the Weld County Code.
Traffic Memorandum:
The trips that are generated by this facility are very seasonal and insignificant. Trips will not exceed 10-20 per
week. Traffic flow is dependent on the destination service location with expected trip distribution being 50/50
on CR 80, east/west.
Drainage Report:
The applicant submitted two proposed impoundments in the southeast corner of the site. Our Drainage
Engineer Jennifer Petrik will review and comment. Contact her at 970-356-4000, ext. 3552.
Grading Permit: If more than one acre is to be disturbed, a Weld County Grading Permit will be required prior
to the start of construction.
Improvements and Road Maintenance Agreement:
Not required.

Environmental Health Services has reviewed this proposal for uses similar to the
uses listed in Section 23-3-40.W as Uses by Special Review (equipment storage yard related to
custom farming operations) as long as the use complies with the general intent of the A
(Agricultural) Zone District.
"Policy 2.2.K Use of portable toilets and bottled water(revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are allowed.
Policy: Bottled water from a commercial source is allowed in the following
circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year (for
example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained on a
quarterly basis and available for review by the Weld County Department of Public Health and
Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall
contain hand sanitizers."
As indicated above, it is the policy of this Department that portable toilets are allowed when
employees or contractors are on site for less than 2 consecutive hours a day. As personnel will
be on site for a short duration, in accordance with Environmental Health Services policy the use
of portable toilets is allowed.
The dust abatement plan stipulates that the entrance and internal roadways will be graveled or
road base will be utilized. A water truck will be used to mitigate onsite dust if necessary.
The waste handling plan stipulates that a dumpster will be provided and Waste Management or
a similar company will provide waste removal.
We have no objections to the proposal; however, we recommend that the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in
a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions. The applicant shall operate in accordance with the approved "waste
handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The
facility shall be operated in accordance with the approved "dust abatement plan", at all
times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the Non-
Specified Zone as delineated in Section 14-9-30 of the Weld County Code.
6. Adequate drinking, handwashing and toilet facilities shall be provided for employees and
patrons of the facility, at all times. As employees or contractors are on site for less than 2
consecutive hours a day portable toilets and bottled water are acceptable. Records of
maintenance and proper disposal for portable toilets shall be retained on a quarterly
basis and available for review by the Weld County Department of Public Health and
Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County
and shall contain hand sanitizers.
7. The operation shall comply with all applicable rules and regulations of State and Federal
agencies and the Weld County Code.

After reviewing the application and documents submitted the Building Department has the following
comments:
A building and electrical permit will be required, per Section 29-3-10 of the Weld County Code, for any
new structures ,additions or renovation to any structures.
Weld County Building Department records do not indicate a building permit was pulled for the existing
shop, the Assessors records show the structure was built in 2004 for commercial storage. A building
permit for the current uses will be required for the existing shop. An Agreement Concerning Existing As-
Built Construction can be used to show compliance with structural, electrical and mechanical
requirements. The Agreement can be found on the Weld County Web Site shown below
Buildings and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2012 International Building
Code; 2012 International Mechanical Code; 2012 International Plumbing Code:; 2012 International Fuel
Gas Code; 2006 International Energy Code; 2011 National Electrical Code; 2009 ANSI 117.1
Accessibility Code and Chapter 29 of the Weld County Code.

Subject: USR14-0036 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV11-00086)was noted. This
violation was initiated due to the operation of a custom farming business without first completing the
necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court
Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual
court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied, the commercial vehicles, storage and all
operations shall be removed from the property within 60(thirty)days of denial or the violation will proceed
in court accordingly.
