RE: ACTION OF BOARD CONCERNING IN EMINENT DOMAIN, PURSUANT TO SECTION
38-1-101, C.R.S., AGAINST DPG FARMS, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County is in need of acquiring additional right-of-way for the extension
of County Road 49, in a portion of Sections 1, 11, 12, Township 5 North, Range 65 West of the 6th
P.M., Weld County, Colorado, including a temporary construction easement and permanent
irrigation easement, and
WHEREAS, a hearing before the Board was held on the 10th day of February, 2013, at
which time the Board deemed it advisable to continue said matter one week to allow adequate
time for the Board to give the matter further consideration.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, continued to February 19,
2014, at 9:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the February 10, 2014.
