Staff comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Issues of concern must be resolved with the Public Works Department. Our comments and requirements are as follows: COMMENTS: Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011) CR 32 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by the Town of Mead. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Grace Way, within Eden's Reserve, is paved. This PUD Road is maintained by their HOA. REQUIREMENTS: Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code Drainage: The historical flow patterns and run-off amounts will be maintained on site. Flood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). Traffic: No additional traffic is anticipated. Vehicular traffic circulation will continue to be provided by Grace Way which connects to CR 32 (annexed by the Town of Mead). Department of Public Health and Environment CASE NO.: COZ14-0002 NAME: Eberl Environmental Health Services has reviewed this proposal to rezone 79.265 acres from the Planned Unit Development Zone District (PUD) to the Agricultural Zone District (A) for one (1) lot. The minimum lot size of 79.265 acres coupled with an overall density of one septic system per 79.265 acres does meet current Department policy. There is a residence located on the parcel. Little Thompson Water District provides water (account 5732) and an individual sewage disposal system (SP-0200166) provides sewer. The Department recommends approval with the following notes which should appear on the change of zone and final plats: 1. Water service shall be obtained from Little Thompson Water District. 2. This subdivision is in rural Weld County and is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Language for the preservation and/or protection of the absorption field shall be placed on the plat. The note shall state that activities such as permanent landscaping, structures, dirt mounds or other items are expressly prohibited in the absorption field site. 4. Weld County's "Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. NE% Section 21, T3N, R68W Water Division 1, Water District 5 Dear Mr. Gathman: This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The application in case no. PUDF14-0001 seeks to vacate approximately 79 acres known as lot 9 out of the Eden's Reserve PUD. In conjunction, case no. COZ14-0002 seeks to chance the zone of the 79- acre parcel from PUD Agricultural to Agricultural. These amendments are being sought so that the applicants can do a recorded exemption on the parcel in the near future which would allow them to sell off the existing residence and approximately 2 acres of land. Such a recorded exemption would not be allowed while the parcel is part of a PUD. The subject parcel currently contains a residence, a barn, and a 15.359-acre man-made irrigation lake known as Logan's Reservoir. Water is currently provided to the residence through an existing tap from the Little Thompson Water District. This office has no objection to the above-referenced cases.
