HomeMy WebLinkAbout20140427.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO FEBRUARY 12, 2014 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, February 12, 2014, at the hour of 9:00 a.m. El ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman - EXCUSED Commissioner William F. Garcia Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Susan Brown Controller, Barbara Connolly e MINUTES: Commissioner Garcia moved to approve the minutes of the Board of County Commissioners meeting of February 10, 2014, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. e AMENDMENTS TO AGENDA: There were no amendments to the agenda. e CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed. Commissioner Garcia seconded the motion, and it carried unanimously. e PUBLIC INPUT: No public input was given. IR COMMISSIONER COORDINATOR REPORTS: Commissioner Kirkmeyer reported the new Weld County Regional Communications Center (WCRCC) was brought online at 6:45 this morning and is working well. El (Clerk's Note: Commissioner Freeman present at 9:04) BIDS: e 1) APPROVE BID #61400025, GEOTECHNICAL TESTING SERVICES FOR 2014 - DEPARTMENT OF PUBLIC WORKS: Trevor Jiricek, Director of General Services, said based on the anticipated workload; staff is recommending the low vendor Terracon, for a total amount of $23,665.00. v� Minute, February 12, 2014 2014-0427 8 Page 1 BC0016 Commissioner Kirkmeyer moved to approve said bid as recommended by staff. The motion was seconded by Commissioner Garcia, and it carried unanimously. • 2) PRESENT BID #61400023, TREE TRIMMING AND TREE REMOVAL MAINTENANCE CONTRACT - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek said there is a sole vendor, who has bid in the past, and this will be brought back to the Board with a staff recommendation on February 26, 2014. G 3) PRESENT BID #61400039, TRAFFIC PAINT AND BEADS - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek said there are six (6) vendors and this will be brought back to the Board with a staff recommendation on February 26, 2014. 4) PRESENT BID #B1400040, 2014 CATTLEGUARD BID - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek said there are two (2) vendors and this will be brought back to the Board with a staff recommendation on February 26, 2014. Eri 5) PRESENT BID #61400043, GRAVEL PIT CRUSHING - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek said there are seven (7) vendors and this will be brought back to the Board with a staff recommendation on February 26, 2014. In response to Commissioner Rademacher, Mr. Jiricek confirmed this will likely be a split bid for the various classifications of materials. NEW BUSINESS: e 1) CONSIDER TEMPORARY CLOSURE OF CR 50.5 BETWEEN CRS 39 AND 41: Amy Joseph, Department of Public Works, reviewed this temporary road closure of approximately seven weeks for a bridge replacement. In response to Commissioner Rademacher, she confirmed they are working with the Union Ditch Company. Commissioner Kirkmeyer moved to approve said temporary road closure. The motion was seconded by Commissioner Garcia, and it carried unanimously. e 2) CONSIDER REQUEST TO WAIVE LATE FEE, APPROVE RENEWAL APPLICATION FOR 3.2 PERCENT BEER RETAIL ON/OFF PREMISES LICENSE ISSUED TO HIGHLANDLAKE, INC., DBA HIGHLANDLAKE, INC., AND AUTHORIZE CHAIR TO SIGN: Lawrence Jensen, President of Highland Lake, Inc., and his sister, Joan, said they have been in business for a century, and requested a waiver of the $500.00 late filing fee, because they have been waiting for the State of Colorado to send their paperwork and made every effort to comply. Brad Yatabe, Assistant County Attorney, said the application is in order and corroberated there was an issue/delay with the State of Colorado. He reported that the applicant came to the Clerk to the Board's office to find out what the holdup was. Lisa Carpenter, Sheriff's Office, reported there were no calls for service and no reasons for denial. Commissioner Garcia moved to waive said late fee, approve renewal application, and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. ▪ 3) CONSIDER CERTIFICATION TO THE WELD COUNTY TREASURER OF ZONING VIOLATION PENALTIES AS SPECIAL ASSESSMENT: Bob Choate, Assistant County Attorney, explained the history of this proposed action, explaining this is a certification of an ongoing daily penalty, that has not been paid, this amount of$1,680.00, which dates from August 28, 2013, at $10.00 per day, and is in addition to previously certified assessments. Notice has been provided to the landowners multiple times this month, a one-on-one conversation has been attempted but not been achieved, and they were notified of today's hearing. Mr. Choate confirmed there is no indication this property was affected by the flood. In response to Commissioner Rademacher, Mr. Choate said from here on the special assessment will be added to their tax bill and, if not paid, a lien would be available Minute, February 12, 2014 2014-0427 Page 2 BC0016 for purchase, and there are harsher penalties available. In response to Commissioner Kirkmeyer, Mr. Choate said that the County would have to go to Court to increase the daily penalty, to his knowledge that action has no precedent with the Board, but could be considered. The other option is to seek an injunction with the eventual result of criminal charges. He stated the daily penalty is ongoing since September, 2012, the problem has been ongoing for several years, and this is a high visibility location. Commissioner Kirkmeyer moved to approve said certification of special assessment with direction to staff. Seconded by Commissioner Garcia, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were approved and signed as listed on the Consent Agenda. No Ordinances were approved. PA Roy Rudisill, Director of Office of Emergency Management, said these seven additions are project worksheets or what CDOT and FHWA refers to as the DDIRs (Detailed Damage Inspection Report).
