the application is in order and corroberated there was an issue/delay with the State of Colorado. He

per day, and is in addition to previously certified assessments. Notice has been provided to the
landowners multiple times this month, a one-on-one conversation has been attempted but not been
achieved, and they were notified of today's hearing. Mr. Choate confirmed there is no indication this
property was affected by the flood. In response to Commissioner Rademacher, Mr. Choate said from
here on the special assessment will be added to their tax bill and, if not paid, a lien would be available

for purchase, and there are harsher penalties available. In response to Commissioner Kirkmeyer,
Mr. Choate said that the County would have to go to Court to increase the daily penalty, to his
knowledge that action has no precedent with the Board, but could be considered. The other option is to
seek an injunction with the eventual result of criminal charges. He stated the daily penalty is ongoing
since September, 2012, the problem has been ongoing for several years, and this is a high visibility
location. Commissioner Kirkmeyer moved to approve said certification of special assessment with
direction to staff. Seconded by Commissioner Garcia, the motion carried unanimously.
