WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 15th day of November, 1976, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that a
certain parcel of land, being the property of Emilio Guadagnoli
and Flora Guadagnoli, Box 318, Frederick, Colorado 80530, being
more particularly described as follows:
LEGAL DESCRIPTION, BLOCK "Q" :
A tract of land located in the SW* of Sec. 30, T2N,
R67W of the 6th P.M. , Weld County, Colorado, being
more particularly described as Block Q of EVANS
ADDITION to the Town of Evanstown as recorded in
the records of said Weld County, Colorado, and all
that part of the vacated Union Pacific Railroad
Right-of-Way lying North and West of original
centerline and being further described as follows :

WHEREAS, the Board of County Commissioners of Weld County,
Colorado desires to exempt this particular division of land from

the definition of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101(10)(d) , CRS 1973 , as
amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Emilio Guadagnoli and Flora
Guadagnoli be exempt from the definition of the terms, "subdivision"
and "subdivided land" pursuant to its authority under Section
30-28-101(10)(d) , CRS 1973, as amended, and Section 2-1A(3) of
the Weld County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 17th
day of November, A.D. , 1976.

RE: Recorded Exemption 234
Dear Commissioners :
The attached application, plat, and related items are in
reference to a request by Emilio Guadagnoli for a recorded
exemption. The parcel of land is described as part of the
SWi of Section 30, T2N, R67W of the 6th P.M. , Weld County,
Colorado. Said property is located at the SW corner of the
junction of Williams Avenue and Johnson Street in Evanston.
The subject property contains 8. 116 acres of Class III dry-
land soils. The request is to split the property into par-
cels of . 270 acres and 7. 846 acres. The stated intent is
to use the two parcels for residential purposes.
On November 12, 1976, the Weld County Board of Adjustment
granted the following variances to Mr. Guadagnoli :
a. A variance to allow less than a one acre parcel
to be created by a recorded exemption procedure
as set for in Section 9-4A (7) of the Weld County
Subdivision Regulations;
b. A variance of 30 feet from the requirement of 180'
of lot frontage onto a public road as set forth in
Section 3. 14 of the Weld County Zoning Resolution
and Section 9-4 (A) (3) of the Weld County Subdivision
Regulations;
c. A variance of 25 feet from the required 50 foot set-
back in the agricultural district as set forth in

Section 3. 14 of the Weld County Zoning Resolution.
Based upon the information submitted and the adopted policies
in the County, the Planning Commission staff recommends that
the request be approved for the following reasons :
1. The Town of Firestone, the Town of Frederick, and
the Tri-Area Planning Commissions have all indicated
they have no objections to the proposed recorded
exemption;
2. The proposed split is in compliance with the Weld
County Comprehensive Plan, the intent clause of
the recorded exemption procedure (Section 9-2 of
the Weld County Subdivision Regulations) , and the
intent clause of the Agricultural District (Section
3. 3 A of the Weld County Zoning Resolution) in that
the request would be providing for the orderly
expansion of urban growth since the area is predomi-
nantly residential in nature and use; and
3. The request complies with the provisions of Section
9-4 A of the Weld County Subdivision Regulations.

Re: Applications for variances from the minimum lot size to be
created by Recorded Exemption, lot frontage, and setback and
an application for a Recorded Exemption all on a parcel of land
described as part of the SWa of Section 30, T2N, R67W of the
6th P.M. , Weld County, Colorado.
Dear Mr. Guadagnoli :
Your applications for the above described request are complete and
in order with the following exception:
1 . Submission of the enclosed application form with your signature
which must be notorized.
I have tentatively scheduled all three variance applications to be
heard by the Board of Adjustment on November 12, 1976. If those
variances are granted by the Board of Adjustment then the Recorded
Exemption application will be heard by the Board of County Commissioners
on November 15, 1976. Both hearings will take place in the County
Commissioners Hearing Room, First Floor, Centennial Center, 915 10th
Street, Greeley, Colorado.
It is recommended that you or a representative be present to answer
any questions the Board of Adjustment or the Board of County Commissioners
might have with regard to your applications.
