RESOLUTION WHEREAS, a public hearing was held on July 28, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the pur- pose of hearing the petition of the Colorado State Highway Department, c/o Leo O'Connor, 1420 Second Street, Greeley, Colorado, (Baumgartner land), requesting permission to locate a gravel pit operation on the following described property: A tract or parcel of land in the Northeast Quarter of Section 23, Township 1 North, Range 63 West of the 6th Principal Meridian, in Weld County, Colorado, said tract or parcel being more particularly described as follows: Beginning at a point from which the Northwest Corner of North- east Quarter Section 23, Township 1 North, Range 63 West of the 6th P. M. bears North 88°11'24" West a distance of 1582. 8 feet; thence East 90° a distance of 410 feet; thence South 0° a distance of 195 feet; thence East 90° a distance of 35 feet; thence South 0° a distance of 190 feet; thence East 90° a distance of 40 feet; thence South 0° a distance of 100 feet; thence East 90° a distance of 25 feet; thence South 0° a distance of 795 feet; thence East 90° a distance of 90 feet; thence South 0° a distance of 570 feet; thence West 90° a distance of 450 feet; thence North 0° a distance of 1465 feet; thence West 90° a distance of 150 feet; thence North 0° a distance of 385 feet, more or less to point of beginning. The above described parcel contains 16. 9 acres, more or less, and WHEREAS, the Petitioner was present, being represented by Mr. Joe A. Intermill, Jr. , Assistant Highway Engineer, for the Colorado State Highway Department, and WHEREAS, there was some opposition to the request of petitioner for the location of said gravel pit operation, and WHEREAS, the said requested gravel pit operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (8) and Section 6. 1 (3) of the Zoning Resolution of Weld County, said gravel pit operation may be authorized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of the Colorado State Highway Department c/o Leo O'Conner (Baumgartner land) to locate a gravel pit operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. PL 11 ACT 750444 2. That Petitioner shall proceed with due diligence to effect construc- tion of said gravel pit operation and that he shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That whenever Petitioner feels that the extraction of gravel may cause hardship due to said gravel extraction to upstream landowners, then said Petitioner shall contact such persons and/or landowners and negotiate or work out any problems that may be created or reasonably forseen by virtue of said gravel extraction. 4. That when gravel extraction is completed said permittee shall immediately notify the Board of County Commissioners and said permit shall automatically be revoked without further action of the Board. 5. That the operation and development of each gravel pit excavation and rehabilitation shall be limited to plans as submitted and in accordance with the rules and regulations for the operation of gravel pits as adopted by Weld County, Colorado. 6. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Box 1424 Greeley, Colorado 80631 Dear Mr. Ray: Re: Resolution granting a sand and gravel permit to the Colorado State Highway Department on a tract of land in the NI of Section 23, Township 1 North, Range 63. The Board of Commissioners has reviewed the above-mentioned resolution as you requested in your letter dated August 5, 1975. There was some discussion among the Board members concerning the amount of gravel which might be extracted from the property in question; however, no definite limit was set. From the engineering standpoint, we do not feel that the removal of the amount of gravel which the Colorado State Highway Department proposes to extract would result in any damage or hardship for the landowners three miles upstream. We also feel that the Colorado State Highway Department has acted in excellent faith in all their operations in Weld County and we have not found it necessary in the past to place extensive restrictions upon their operations. It•is the decision of the Board of Weld County Commissioners that the resolution does cover accurately and completely the decision made in our Board meeting on July 30, 1975. Sirs : I wish to thank you for forwarding me a copy of the resolution passed by you on July 30, 1975, in connection with the above matter . However, on behalf of Nicholas Arnusch I must voice an objection to the language of that resolution . It was my understanding at the hearing in connection with this matter that the permit was going to be granted with the condition that as soon as the State Highway Department had removed approxi- mately twelve thousand tons of material from the permit area, they would be required to contact Nicholas Arnusch to take steps to insure that removal of any further material would not cause erosion to his property. In paragraph three of the written form of your resolution you stated: That whenever Petitioner feels that the extraction of gravel may cause hardship due to said gravel extrac- tion to upstream landowners, then said Petitioner shall contact such persons and/or landowners and negotiate or work out any problems that may be created or reasonably forseen by virtue of said gravel extraction. I believe that if you will review the minutes of that hearing, you will find that I am correct in my assessment of that record. Would you please see to it that the written resolution is amended to properly reflect the resolution that was actually passed at the hearing. Material has been previously removed from this area and adjacent areas up and down stream. The area is designated F-4 in Special Publication 5-A, Sand, Gravel, and Quarry Aggregate Resources - Colorado Front Range Counties. As the material to be removed is in the present channel of the creek, there is no overburden; the vegetation in the pit area is very sparce and consists of weeds for the most part. It is our intent to excavate the material in such a manner that the center portion of the creek will be lowered. By lowering the channel, future runoff water will be encouraged to flow in the center of the creek, and the bank erosion and encroachment into the adjacent fields will hopefully be alleviated. Backslopes are to be left no steeper than 2:1. The quantity of material removed from this pit will vary from year to year as highway maintenance and repair work needed in the area will dictate the amount of material removed. We are requesting permission to remove sand and gravel from the channel of Sand Creek located approximately two miles south of Prospect on S.H. 79, then 3/4 mile east on County Road 8. The material is located on property owned by Mr. Dave Baumgartner. Sand Creek is a dry creek which only flows during periods of runoff. During periods of runoff in past years, material has been deposited in the center of the creek causing the water to flow to the outside of the channel. This results in the banks being undermined and causes encroachment into adjacent fields. Our intent is to excavate the material in a manner which will lower the center portion of the creek channel encouraging runoff flow in the center portion. Any backslopes resulting from operation will be left no steeper than 2:1. The material will probably be removed by dozer or front-end loader, screened, then mixed through an asphalt plant or hauled to the road as untreated sand and gravel. BAUMGARTNER PIT - WELD COUNTY EXHIBIT B: MINING PLAN Access from the county road to the affected area will be via the owners existing road. The pit area is located in the creek bed of Sand Creek, which is a dry creek that only flows during periods of heavy runoff. The plant and stockpile site is on a terrace adjacent to, and east of, the pit area. The following outline of general requirements will be used as a guide for the mining operation in the area. However, those doing the excavation will be given latitude as to the sequence of operations, methods, and equipment used. a) Since this is an existing area where the plant and stockpile area was established years ago, there will be very little, if any, site preparation work required in the area. b) The sand and gravel will be removed directly from the creek bed, probably by a dozer or front end loader. At the owners request, the majority of our excavation work has been in the center portion of the existing creek bed. His intent is to channelize any minor flow of this normally dry stream to help prevent the further erosion of the banks back into his fields. In the event we find better quality sand and gravel in areas adjacent to the stream banks the owner has requested that we remove material from the center of the channel to backfill any excavations near the banks. c) As the sand and gravel is removed it could be stockpiled in the channel or stockpile area, screened and then stockpiled for future use, or hauled directly from the affected area. At times an asphalt plant could be moved into the affected area and used to mix asphalt with the stockpiled gravel, with the mixture being hauled from the affected area. d) When the gravel mining operation is completed the site will be reclaimed in accordance with the reclamation plan. e) The following types of equipment could possibly be used in the permit area: dozer"s, front end loaders, trucks, motor graders, screening plant, asphalt mixing plant, farm type tractors, seed drills, mulchers, and fertilizer spreaders. DAUMGARTNER PIT - WELD COUNTY EXHIBIT B: MINING PLAN "CONTINUED" f) There is no specific time as to when our gravel mining occurs in the area. They are usually sporadic operations dictated by the need for maintenance, repair, or construction of highways in the area. It is possible that there could be a span of two or three years between our operations in the area. These operations are normally of very short duration and would not total 180 days in any one year. BAUMGARTNER PIT - WELD COUNTY EXHIBIT D: WILDLIFE, WATER RESOURCES, VEGETATION, AND SOILS INFORMATION 1. WILDLIFE Please see attached statement from the Division of Wildlife concerning wildlife impact for the area. 2. WATER RESOURCES The pit is located in a dry creek bed. The creek bed in this area varies from approximately 300 to 700 feet wide. During periods of runoff in past years material has been deposited in the center of the creek causing the water to flow to the outside of the creek bed. This results in the banks being undermined and causes encroachment into the owners adjacent fields. Our intent is to excavate the material in a manner which will lower the center portion of the creek channel, thereby encouraging flow in the center of the channel and away from the banks. Our excavation will not be deep enough to encounter ground water elevations. 3. VEGETATION INFORMATION The plant and stockpile site which is located on the terrace is virtually bare of vegetation since it has been utilized as such for several years. The creek bed itself has some areas of scattered to rare vegetative growth. The vegetation inventory furnished by the Soil Conservation Service stated that the bulk of the vegetation on the site consists of annual grasses and weeds, with some sand dropseed. They also reported that this type of vegetation is typical for soils in areas that are subject to frequent flooding. The flooding would account for the large number of annuals in the area. 4. SOILS The Soil Conservation Service designates the soil of this area as a Bankard sandy loam. These are deep, somewhat excessively drained soils on floodplains at elevations of 4450 to 5000 feet, and contain numerous sand and gravel bars. Permeability is moderately rapid and available water capacity is low with slow surface runoff and low erosion hazard. BAUMGARTNER PIT - WELD COUNTY EXHIBIT D: WILDLIFE, WATER RESOURCES, VEGETATION, AND SOILS INFORMATION "CONTINUED" • These soils are suited to very limited cropping. Since they are sandy and subject to flooding, pasture is their best use. Many sites of this type have inclusions of other soils and vegetation in such a complex pattern that it is difficult to map separately. WILDI.- STATEMENT FOR MINE PERMIT Al- CATION 1. However, the lower areas will be recovered with more sand and gravel every time there is a high flow period. Prepared by Don Bogart Title Environmental Biologist Date April 6, 1978 • BAUMGARTNER PIT - WELD COUNTY EXHIBIT E: RECLAMATION PLAN The proposed gravel pit is located in the bed of sand creek, with the plant and stockpile area located on a terrace adjacent to a portion of the east boundary of the pit area. Sand Creek is a dry creek which runs only during periods of runoff. The creek bed is just waste land that the owner is unable to utilize due to the frequent flooding. During periods of runoff in past years, material has been deposited in the center of the creek causing heavier flow at the outside of the channel. This results in the banks being undermined and causes encroachment into the adjacent cultivated fields. The owner stipulated that our excavation must result in the lowering of the center portion of the creek. This would encourage the water to flow to the center and aid in alleviating the bank undercutting problem. After considering the area we concluded that seeding the creek bed would be futile since subsequent floods would either wash out or deposit silt and sand over any vegetation that we might have established. Therefore, our proposed reclamation for the creek bed is to lower the center portion and leave the backslopes created by our excavation no steeper than 2:1. The terrace area where the stockpile and plant area is located is low enough that it can be flooded during times of very heavy runoff. Due to the flooding potential, the small area, and elevation difference between it and the adjacent field, this terrace is waste land to the farmer and, to my knowledge, has been utilized only as plant and stockpile site for past gravel operations. Since the site has been utilized for these purposes many times in the past, the original soil has become so intermixed and overlain with gravel that it is doubtful any benefit would be derived from stripping the existing topsoil. Therefore our reclamation plan for the terrace will consist of ripping the area and then seeding it. We met with the U.S. Soil Conservation Service personnel at the site and they recommended that due to the nature of the site, and since it will revert to waste land when our operation is completed, we simply attempt to establish ground cover. Therefore, we propose to use the following seeding plan, based on the Soil Conservation recommendations.
