RE: APPROVAL OF RECORDED EXEMPTION NO. 302 - ART ROBBINS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing
held on the 30th day of January, 1978, in the Chambers of
the Board of County Commissioners of Weld County, Colorado, that
the division into two parcels of a certain parcel of land, as
shown on the plat known as Recorded Exemption No. 302, being the
property of Art Robbins, located on Part of the SE; of Section 10,
66
Township 1 North, Range 613 West of the 6th P .M. , Weld County,
Colorado, and more particularly described as follows:
That part of the South one-half of the Southwest
one-quarter of the Southeast one-quarter of
Section 10, Township 1 North, Range 66 West of the
6th P.M, Weld County, Colorado, described as:
Beginning at the Southwest corner of said South-
west one-quarter; thence N 00°09'15" E on an
assumed bearing along the West line of said South-
west one-quarter, a distance of 662.18 feet to a
point on the North line of said South one-half;
thence N 89°56'04" E along said North line, a
distance of 1327.52 feet to a point on the Fast
line of said Southwest one-quarter; thence S
00°13'10" W along said East line, a distance of
663.70 feet to the Southeast corner of said South-
west one-quarter; thence S 90°00'00" W along the South
line of the Southwest one-quarter, a distance of
1326.75 feet to the point of beginning.

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-lA(3) of the Weld County Subdivision
, Regulations.

Commissioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Art Robbins, be, and hereby

"subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 30th day of
January, A.D. , 1978.

RE: Recorded Exemption #302
Dear Commissioners:
The attached application, plat , and related items are in reference
to a request by Mr. Art Robbins for a recorded exemption . The
property is described as Pt . SE4 Section 10, TIN, R68W of the 6th
P.M. , Weld County, Colorado . This property is located approximately
3 miles southeast of Ft . Lupton. The subject property contains
approximately 18 .426 acres of Class IV and VI non-irrigated soils .
The request is to split the property into parcels of 1 . 0 acres and
17.426 acres. The larger parcel contains an existing set of im-
provements and the 1 acre parcel is a proposed building site for
Mr. Robbins ' son.
On December 28, 1977, the Board of County Commissioners approved a
request by Mr. Robbins for a lot size variance so that he could
make application for this recorded exemption . At the time they
made the decision on the request , the Department of Planning Ser-
vices Staff submitted a letter of recommendation to the Board. A
copy of that letter of recommendation is included in the attached
packet . Nothing has been received by our office which would change
our recommendation of approval for this request as outlined in the
letter o the Board of County Commissioners dated December 28, 1977.

Dear Mr. Honn; Re: Recorded Exemption
I would like to request that the attached application and supporting
documents be approved for filing, as a Recorded Exemption. I have
the previous approval already for the Lot Size Variance to split one
acre of land from the 18% acres that I own, so that my Son can build
a home on the 1 acre. (Lot Size Variance approval attached)
Water availability will be from sharing an existing deep well that
has more than adequate capacity for two residences. With the max.
size pump it will pump the maximum 15 gallons per minute that is
allowed by the State for a domestic well. A water line easement is
shown on the attached survey and this survey along with a legal
document indicating water rights and well maintainance agreements,
will be filed with, and made a part of, the Deed when the ownership
of the property is actually transfered. (State well usage document
with well number is attached)
Sewage will be handled with a Septic Tank and leach field system.
(copy of the Weld County Health Depts. land & soil suitability report
for a septic system, is attached)

RESOLUTION
RE: APPROVAL OF LOT SIZE VARIANCE NO. 55 - ART ROBBINS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County
Home Rule Charter, is vested with the authority of administering
the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 28th day of December, 1977, in
the Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain parcel of land is owned by Art Robbins,
which land is more particularly described as follows , to-wit:
Pt. of the SE( of Section 10, Toimship 1 North,
Range 66 West of the 6th P.M. , Weld Canty,
Colorado
WHEREAS, the owner of said tract of land desires to obtain
a variance from the minimum lot size requirement so that
Art Robbins may make application to the Board of County Com-
missioners to apply for a recorded exemption, as set forth in
Section 9-4.A. (6) of the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, based upon the recommendations of the Department of
Planning Services, feels that the applicant has shown good cause
for granting a lot size variance under Section 9-4 .A. (6) of the
Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that a variance from lot size

Dear Commissioners :
The attached letter and related materials are in reference to
a request by Art Robbins for a lot size variance. The property
is described as Pt . of the SE* Section 10, T1N, R66W of the 6th
P.M. , Weld County, Colorado. The location is approximately 3
miles southeast of Ft . Lupton . Subject property contains ap-
proximately 181 acres of Class IV and VI non-irrigated soils .
The request is to obtain a variance from the minimum lot size
requirement , Section 9-4(A) (6) of the Weld County Subdivision
Regulations , so that he can apply for a Recorded Exemption .
Section 9-4(A) (6) states :
"That the original tract or parcel of land to be divided
under this Section meets the minimum lot size require-
ments established by the Weld County Zoning Resolution ;
variance from this requirement being allowed only upon
good cause being shown to the Board of County Commis-
sioners or where said tract or parcel of land lies
within the comprehensive plan area of an existing
incorporated town of Weld County. (Rev . 4/17/74)
If the lot size variance is granted, Mr. Robbins will proceed
with a Recorded Exemption application to create two parcels of
approximately 1 acre and 171 acres . The larger parcel contains
an existing set of improvements and the 1 acre parcel is a
proposed building site for Mr . Robbins ' son. This information
is outlined in a letter from Mr. Robbins dated December 1 , 1977 .
Based upon the information submitted and the adopted policies and
regulations of Weld County, the Department of Planning Services
staff recommends approval of the request for the following reasons :

1 . The request complies with the Weld County Comprehensive
Plan in that the soils are of low capability , Class IV
and VI , and the proposal is within the referral area of
Fort Lupton and the Fort Lupton Planning Commission has
no objection to the request ; and
2 . The request complies with the intent of the Agricultural
District of the Weld County Zoning Resolution and the
intent of the Recorded Exemption procedure in the Weld
County Subdivision Regulations as the proposal would not
be an encroachment to agricultural use as the highest
and best use of the land , would be orderly expansion of
urban growth in conformance with the Weld County Compre-
hensive Plan as outlined above and would not be incom-
patible with surrounding agricultural uses .

Gentlemen: Re: Lot Size Variance e
I would like to request a "Lot Size Variance" on an 18% acre parcel
of land that I now own. I would like very much to split 1 acre
off from the 18% acres so that my son can build a home on it.
I now have my home on this 18% acre piece of Dry-land, approx. four
mile south-east of Ft. Lupton and my address is 15721 Road #10. The i
legal description of the land is on the attached documents. I originally
owned 38% acres of land but in 1971 I sold two 10 acres parcels of
it.
My son, who is married and has a young child wishes to remain the
County and build a home near us. Due to cost considerations it is
impractical and almost impossible, for him to buy land elsewhere and
drill a new well and build a house. Therefore I would like to give
him this 1 acre where his new home could share our present water
well. I have already talked to the State Division of Water and 'tliey
have informed me that under State law three or less homes may share
a Domestic water well. The present well has more then sufficient
capacity for both homes as it is 900 ft. deep and has a 10 GPM-plus
capacity. (see attached record of Well Use document) and there will
be a legal water easement, water rights Document drawn up.
This land is "Dry-Land"and due to the arid, sandy soil, it is not
usefull for any agricultural purpose and my land, as well as the
adjacent land, has not been farmed for years.
Attached is a survey of this land showing the proposed 1 acre site.
In addition, attached are copies of the original Deeds to this land fr
showing the original 38% acres and the two seperate 10 acres parcels
that were sold from it in 1971 , leaving the 18% acres. (for clari- !I
fication of the Deeds, see the attached survey sheet)
Attached also is a letter from the Weld County Health Dept. stating
that this 1 acre of soil is compatible for a septic tank system.
