MEMORANDUM ° 1L 8 ° TO: Diana Aungst, Planning Services DATE: February 12, 2014 FROM: Donald Carroll, Engineering Administrator Public Works Department CQiNir Y_ � SUBJECT: USR14-0002, Circle B Land Company (Oil & Gas, Field Ops Building, SH 392/CR 33) The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: CR 33 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate or dedicate an additional 10-foot of right-of-way parallel to the CR 33 right- of-way for future build-out. Weld County Our most recent traffic count (ADT) for CR 33 between SH 392 to CR 70 reflect 1120 vehicles, taken 8- 21-2013; average speed 62 MPH, 7% single axle and 8% combination trucks. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. (State Highway 392) State Highway 392 Environment Overview Study (EOS) shows SH 392 at CR 33 access number 195 is an un-signalized intersection allowing full movement in all directions and providing access to homes and fields north and south of SH 392. North/south legs are stop-controlled. Intersection works at Level B intersection in the a.m. and Level C intersection in the p.m. REQUIREMENTS: Access: The applicant has received an approved Access Permit, AP13-00227. Parking & Circulation: The main access drive and office parking will be paved with additional gravel parking in the rear, with good circulation. Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code. C:\Users\kford\AppData\Local\Microsoft\Windows\Temporary Internet Files\Content.lE5\RR4QROCx\USR14-0002[1].docx Traffic Narrative: 25 employees will drive company-owned pick-up trucks that will be dispatched from the shop and return at the end of each shift. 10 miscellaneous vehicles; passenger cars, pickups, and step-van type vehicles will arrive randomly for mail, deliveries, and other miscellaneous purposes. Based on the above information, Bill Barrett Corporation will generate around 60 round trips per day with a majority of the trips occurring before or after traditional peak traffic hours. Stormwater Drainage: The applicant has supplied a drainage report from Interwest Consulting Group. This report has been signed and stamped by a professional engineer. Please address the redline comments provided on the construction drawings that have been returned to the applicant's engineer. Please provide construction details for all drainage related improvements that are proposed for this site. Condition of Approval: A final drainage report, signed and stamped by a professional engineer registered in the State of Colorado is required. Development Standard: • The historical flow patterns and runoff amounts shall be maintained on site. • The applicant understands that Weld County does not and shall not assume liability for drainage facilities designed by others. • Weld County shall not maintain on-site drainage related features. Grading Permit: As the applicant is proposing to disturb more than one acre of land, a Weld County Grading Permit is required prior to the start of construction. Flood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). Improvements Agreement: An off-site Improvements Agreement will be required for this facility. Improvements may include but are not limited to: specified haul routes, damage repairs, intersection upgrades, and future improvement triggers for turn lanes. Collateral is required to ensure the improvements are made. Comments made during this stage of the review process will not be all inclusive, as revised materials are submitted other concerns or issues may arise. All issues of concern and critical issues during further review must be resolved with the Public Works Department. Water will be provided by North Weld County Water District. An engineer designed septic system will be installed. The access drive will be hard surfaced. Native vegetation, reduced vehicle speeds and a water truck will be utilized for dust control. The waste handling plan stipulates that a dumpster will be provided and will be serviced by Waste Management or Northern Colorado Disposal. Any fluids will be recycled or disposed of in accordance with regulations. Equipment will not be washed at the site. An SPCC plan will be developed for the property and shall be kept on site. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: Prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirement be incorporated into the permit as a condition that must be met one month prior to operation: 1. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be provided to Environmental Health Services Division of the Weld County Department of Public Health & Environment. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the approved "waste handling plan", at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan, at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non-specified Zone District, as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 7. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 9. The Spill Prevention, Control and Countermeasure Plan shall be available on site, at all times. 2 10.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. We are required to list the square footage of each occupancy, as well as any covered exterior space. This is why the square footage listed on the cover sheet indicates the following: -- 1st Floor- 10,850 SF --Shop- 2,550 SF --1st Floor unenclosed exterior areas- 1,800 SF --Mezzanine-490 SF The actual square footage of the interior of the building is 13,400 sf., with the addition of a mezzanine of 490 sf. The mezzanine does not count against square footage requirements per the building code, which is why it is listed separately and we list the total SF of this building to be 13,400 SF. I also understand they will be parking a large number of trucks on the site which will be driven on a daily basis. I have two concerns with this proposal: 1). Road damage at the corner of HWY 392&WCR 33. When the trucks and/or trailers rear wheels cut across the corner the corners develop large potholes,and the roadway materials starts to break apart. 2). The backup of traffic on WCR 33, south bound,at the corner of HWY 392 by the trucks will be significant at times. With the amount of traffic on HWY 392, it makes it difficult for large vehicles to turn onto it or even cross it. This backup in traffic could hold up the buses and disrupt the route schedules. Route schedules do not have extra time built into them. A hold up of 5-10 minutes in the morning could cause the bus to arrive at school late. If we build the 5-10 minutes into the route and the bus arrived early, the kids would have to sit on the bus,and that wouldn't be good either. In the application for Plumb Ridge(RECX 13-0066)the following response was sent to the Planning Dept.: "The canal for The New Cache La Poudre Irrigating Company (NCLPIC),commonly known as Greeley#2 Canal,passes along the south property line of Plumb Ridge. The canal right-of-way in this area would typically be a total of i 50 feet in width being 75 each side of the center of the canal. Request is made to have that width platted. The drainage of the site and the subsequent detention/retention of the stormwater/spills is a second area that New Cache is concerned about. The property has been a farm and return flows from irrigation of the farm came into the canal.Now that the property is being developed,there is increased concern in the diminished quality of the water entering the canal. I have read the drainage report and the other supporting documents that outline the plan for controlling the water and removing contaminants from the water. I will rely on the departments within the county to verify that the water entering the canal will not be compromised. If further clarification of my comments is needed please contact me. Thank you. The North Weld County Water District provided updated supply and demand information to this office via the Tri-Districts on December 18, 2012. The document shows that the District's firm yield supply of 6,392 acre-feet exceeds its dry year planning demand of 4,702 acre- feet. With the North Weld County Water District as the water supplier, this office has no objections to the subject proposal.
