RESOLUTION
RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 341 - JAMES
DAVIS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners that a certain parcel of land owned by James Davis
does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners did approve Re-
corded Exemption No. 341, by Resolution, on October 11, 1978 , and
WHEREAS, James Davis has requested that Recorded Exemption
No. 341 be amended by increasing the size of Lot A by 9. 466
acres, and
WHEREAS, the Board of County Commissioners has considered
the request of the applicant and the recommendations of the Weld
County Department of Planning Services and finds that said re-
quest should be granted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the amendment to Recorded
Exemption No. 341 for James Davis be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 11th day of

All of the Northeast Quarter (NE1) and all that part of the Southeast Quarter (SE%)
lying North of the Little Thompson River in Section 14, Township 4 North, Range 68
West of the 6th P.M. , Weld County, Colorado, being more particularly described as
follows:
Beginning at the Northeast Corner (NE Cor) of said Section 14 and considering the East
line of said Section 14 as bearing South 00°27 '42" West, with all other bearings
contained herein relative thereto;
Thence South 00°27 '42" West, along said East line of said Section 14, 3012.48 feet;
Thence Southwesterly 820. 00 feet;
Thence Westerly 1518.00 feet;
Thence Southwesterly, 820.00 feet to a point on the North-South centerline of said
Section 14;
Thence North 00°30'10" East, along said North South centerline, 4150.48 feet to a
point on the North line of said Section 14;
Thence North 90° 00'00" East, along said North line of said Section 14,2650.77 feet
to the Point of Beginning.
Said described parcel of land contains 211.565 acres, more or less, and is subject
to any rights-of-way or other easements as recorded by instruments of record or as now
existing on said described parcel of land.

RE: Amendment to Recorded Exemption #341
Dear Commissioners:
The attached application, plat and related materials are in reference
to a request from Mr, James Davis to amend Recorded Exemption #341 .
The property is described as the NE* and Pt . SE* Section 14, T4N,
R68W of the 6th p.m. , Weld County, Colorado. This property is
located approximately 2A miles west and 1 mile south of Johnstown.
The request is to amend Recorded Exemption #341 by increasing the
size of Lot A by 9.466 acres. The request will realign the property
lines with a creek that runs through the property.
Based upon the information submitted, the Department of Planning
Services staff recommends approval of this requested amendment for the
following reasons:
1. The impact on surrounding agricultural land uses would not appear
to be any different than the original request which has already
been approved.
2. The Johnstown Planning Commission has set forth no objections to
this request .
3. This request is in compliance with Section 9-4 A. of the Weld
County Subdivision Regulations.

RE: Recorded Exemption number 1O61-14-3-RE341
Dear Sirs;
I applied for, and received a Recorded Exemption on land in
the Northeast Quarter of Section 14, Township 4 North, Range 68
West of the 6th P.M. , Weld Coutny. I sold this property to Leighton
Wyscaver. Mr. Wyscaver would now like to purchase another 9.426
acres. The reason Mr. Wyscaver would like the additional acreage,
is because a natural boundry of a creek divides the two lots. We
have had the property surveyed, and an Ammended Recorded Exemption is
enclosed. The property in question is Lot 'A' .
I would like to close the sale soon, so if there is any problem
please advise me.
