This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: CR 17 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate or dedicate an additional 40-foot of right-of-way parallel to the CR 17 right-of-way for full build-out. CR 54 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate or dedicate an additional 40-foot of right-of-way parallel to the CR 54 right-of-way for full build-out. REQUIREMENTS: Access Permit Application Form: Tracking control is required to prevent tracking mud and debris from the site on to the County Roadways. Place at the entrance double cattle guards across both lanes. Our Traffic Engineer Division will evaluate the Access Permit Application and accompanying documents. The fee is $75.00 (small commercial) for your existing access permit. Show the approved access on the plat and label it with the approved access permit number (AP#). Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code. Traffic: The applicant should continue to follow Traffic Control Plans which conform to the Manual on Uniform Traffic Control Devices (MUTCD) for all events held at the facility. All Traffic Control Plans, at a minimum, must contain flagger control, temporary traffic control signing, and cones. The applicant shall upgrade the entrance with a double cattle guards across both lanes (two traffic) , not in the county right-of-way with adequate turning radius adjacent to CR 17. Recycled asphalt or road base is required to prevent tracking mud and debris from the site onto the county road. A stop sign should be installed at the main entrance/exit as the CR 17 is classification as arterial. Drainage Report: The applicant submitted a Stormwater Narrative in the Questionnaire. Jennifer Petrik P.E., Planning/Engineering Review, is available to provide assistance with your stormwater flows at 970-356- 4000, ext. 3552. An water quality feature to catch storm water run-off from the parking area needs to be sized for the parking area. Grading Permit: If more than one acre is to be disturbed, a Weld County Grading Permit will be required prior to the start of construction. The facility will be operated spring, summer and fall. The following section is from Environmental Health Services, Weld County Department of Public Health & Environment, Septic Policies. 2.2.K Use of portable toilets and bottled water (revised 5/8/12) Purpose: To define when portable toilets and commercially bottled water are allowed. Policy: Portable toilets and bottled water from a commercial source are allowed in the following circumstances: 1. Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Note: Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. As indicated above, it is the policy of this Department that portable toilets are allowed for temporary or seasonal uses that are utilized 6 months or less per year, such as recreational facilities. As this request is for a seasonal use, in accordance with Environmental Health Services policy, the use of portable toilets is allowed. There is a septic system permitted for 3 bedrooms which serves the existing residence (G19860188). There will be a portable hand washing station near the petting zoo. The application states the station will contain water and will not be hand sanitizer. The applicant is proposing to water or apply magnesium chloride on the entrance drive for dust control. The parking areas and activity areas will be watered as necessary. A sprayer mounted on an ATV will be utilized. Little Thompson Water District provides water to the existing residence. The waste handling plan indicates trash bins will be distributed over the site. Gallegos Sanitation will provide dumpsters for temporary disposal which will be emptied weekly. Employees will empty trash bins several times a day and will walk the grounds and retrieve trash that is left on the ground. Animal waste will be either applied to farm fields or disposed of in a trash dumpster. There will be no fuel storage on the site. Noise will be limited to the non-specified level which is the same as residential. The applicant did submit a noise control plan that states hay bales, sound wall and locating the temporary stage in a low lying area will be utilized for noise reduction. The application indicates staff will be monitoring the levels to determine if further mitigation is necessary. All food vendors must adhere to the Colorado Retail Food Establishment Rules and Regulations. A Weld County licensed mobile unit is an acceptable method to provide food. We have no objections to the proposal; however, we recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 2 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved "waste handling plan". 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan". 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non-specified Zone District, as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. As this is a temporary or seasonal use that is utilized 6 months or less per year, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 8. The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations governing the regulation of food service establishments. 9. Handicap Accessibility will need to be accommodated for parking and routes to areas of all activities of recreational facility. The owner may submit a letter of intent that he will take responsibility for providing accessibility for any handicap person beyond the point of entry to the facility or a place of designated staff contact. Any amusement structures will require permits through the State of Colorado Division of Safety and Regulations. A building permit application must be completed and two complete sets of engineered plans. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2012 International Building Code; 2012 International Mechanical Code; 2012 International Plumbing Code:; 2012 International Fuel Gas Code; 2006 International Energy Code; 2011 National Electrical Code; 2009 ANSI 117.1 Accessibility Code and Chapter 29 of the Weld County Code. They will need to determine what the traffic impacts at US 34 are going to be. As part of the study we would ask that their engineer provide the measurements of the existing turn lanes on US 34. I'm thinking that they are long enough but want to make sure. The submitted material does not appear to qualify as a "subdivision"as defined in § 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. The application is seeking a request for a site specific development plan and use by special review permit for a temporary agri-tourism enterprise on two parcels totaling 233 acres. The attractions and activities to be offered at the site include a corn maze, pumpkin festival, farm animal petting zoo, zip line, paintball, concerts, and more. The attractions will operate from late spring through October, and are estimated to bring in 1,500 to 2,000 people per week. The proposed enterprise will require 1-2 full-time employees, with 5-10 temporary employees during the spring/summer and 10-50 temporary employees during the fall. Domestic water is currently provided to the property through an existing tap from the Little Thompson Water District. Irrigation water for the property is obtained from the Greeley/Loveland Ditch. Portable restrooms and a hand washing station will be provided for use by visitors to the site. Water is also proposed to be used on roads and on the activities area for dust control purposes. The source of water to be used for dust control purposes was not specified. This office has no objection to the use of water from the Little Thompson Water District for such commercial/industrial use; however, the applicant's irrigation water may not be used for dust control purposes unless the applicant has first obtained a change in water right allowing for such use.
