SUBJECT: USR14-0031, Tallgrass Pony Express Pipeline
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
Parcel # - Not available
Access improvements are required and shall include 60ft radii to accommodate turning trucks and double
cattle guards across the accesses to prevent the tracking of mud onto the County maintained gravel
roadway.
Traffic statement indicates approx. 120 trucks/day will use site and then reduce to approx. 50 trucks/day
during Phase 2. All trucks are anticipated to use CR 119 to CR 110.
The gate must be set back 75 feet from future right-of-way to allow a truck or RV and trailer to pull
completely off of the roadway and open the gate after the future road widening.
A right of way permit is required for any work within the County right of way. A special transport permit is
required for over length, width, height, or weight vehicles. Contact Public Works.
An Access Permit is required and has been submitted to PW. Permit is still pending.
Tracking control is required to prevent tracking from the site onto the public roadways. Standard tracking
control for accesses onto gravel roads includes double cattle guards at the access point. Standard
tracking control for accesses onto paved roads includes either 300 feet of pavement onsite OR 100 feet
of pavement plus double cattle guards. Alternatives such as recycled AC, recycled concrete, or gravel
may be considered with lighter traffic impact projects.
Improvements/Road Maintenance Agreement: A draft of the agreement will be provided to the applicant
after approval of the application at the BOCC hearing. An example agreement is available at:

o An Improvements Agreement is required for sites with required offsite improvements. Collateral
is required to ensure the improvements are made.
o Road Maintenance will be included as a section of the Improvements Agreement when the
County feels that the site activities may impact the County roadways. Possible mitigations
included in the road maintenance agreement may include but are not limited to: dust control,
specified haul routes, damage repairs, and future improvement triggers.
A drainage narrative and water quality feature design is required and full Drainage Report and detention
pond waived because the stormwater drainage impacts of the project will be insignificant.
o Narrative: The applicant shall provide a short description of the historic stormwater flows across
the property and how their application will affect those flows. The description shall include but not
be limited to:

1. where the water originates if it flows onto the property from an offsite source
2. where it flows to as it leaves the property
3. the direction of flow across the property
4. if there have been previous drainage problems with the property
5. The overall site imperviousness
o Water Quality Feature Design: A Water Quality Feature is required onsite downstream of the
business activities such as parking, buildings, storage areas etc... The area can be an existing
low point or excavated area that will capture the stormwater and contaminants prior to flowing
offsite. Methodology for sizing is outlined in Volume 3, Section 3.3.0 of the Urban Storm Drainage

The applicants will be required to maintain historic drainage flows and run-off amounts on the property.
A Weld County Grading Permit will be required if disturbing more than 1 acre by the planning department.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-
692-3575.
This site is Not in a Geologic Hazard Area.
A water quality design was submitted. Label the water quality feature on the plat as "Water Quality
Feature, No Build/Storage Area" and label the required volume.
An Improvements Agreement between the Applicant and the County will be required for this project. It will
detail the approved haul route(s), any onsite and offsite requirements, and a maintenance agreement for
the haul routes. Road maintenance after construction is not required for this site due to the minimal traffic
stated in the application (1 pickup truck/day).
CONDITIONS OF APPROVAL:
Prior to recording the plat:
A. An Improvements Agreement and Road Maintenance Agreement is required for this site.
Road maintenance including dust control, damage repair, and triggers for improvements
will be included.
The plat shall be amended to delineate the following:
A. County Road 119 is designated on the Weld County Road Classification Plan as a gravel
local road, which requires 60 feet of right-of-way at full build out. The applicant shall verify
the existing right-of-way and the documents creating the right-of-way and this information
shall be noted on the plat. All setbacks shall be measured from the edge of future right-of-
way. If the right-of-way cannot be verified, it shall be dedicated. This road is maintained by
Weld County.
B. Show the approved access(es) on the plat and label with the approved access permit
number(will be provided)
Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to
the start of construction.
B. Right of way permit is required for any work within the public right of way.
C. Special transport permit is required for any over size or over weight vehicles.

DEVELOPMENT STANDARDS
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized.

Environmental Health Services has reviewed this proposal for the UET Pawnee Crude Terminal
with a pipeline injection/crude oil tank storage facility.
▪ The applicant has submitted an approved Dust Abatement Plan (Exhibit R in
Application).
▪ The applicant has submitted an approved Noise Abatement Plan Narrative (Exhibit R in
Application).
▪ The applicant has submitted an approved Waste Handling Plan (Exhibit S in
Application).
The applicant is proposing to install a new commercial septic system and a new water well. The
septic system will require engineer design and Weld County Board of Health approval. The
water well will require a State of Colorado Department of Water Resources permit. The
applicant is proposing to provide bottled water and portable toilets during construction activities.
Environmental Health has no objections to the proposal; however, we do recommend that the
following conditions be part of any approval:
1. Prior to allowing the plat to be recorded:
A. The applicant shall submit evidence of an Air Pollution Emission Notice (APEN)
and Emissions Permit application from the Air Pollution Control Division,
Colorado Department of Health and Environment. Evidence of such shall be
submitted in writing to the Weld County Department of Planning Services.
Alternately, the applicant can provide evidence from the APCD that they are not
subject to these requirements.
2. Prior to the issuance of the Certificate of Occupancy:
A. An individual sewage disposal system is required for the proposed facility and shall be
installed according to the Weld County Individual Sewage Disposal Regulations. The
septic system is required to be designed by a Colorado Registered Professional Engineer
according to the Weld County Individual Sewage Disposal Regulations.
We recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in
a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall operate in accordance with the approved "waste
handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The
facility shall operate in accordance with the approved "dust abatement plan", at all
times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the non-
specified Zone as delineated in Section 14-9-30 of the Weld County Code.
6. The facility shall be constructed and operated to ensure that contamination of soil and
groundwater does not occur. Any contaminated soils on the facility shall be removed,
treated or disposed of in accordance with all applicable rules and regulations.
7. All potentially hazardous chemicals must be handled in a safe manner in accordance
with product labeling and in a manner that minimizes the release of hazardous air
pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be
stored secure, on an impervious surface, and in accordance with manufacturer's
recommendations.
8. A current PE certified and signed copy Spill Prevention, Control and Countermeasure
Plan shall be available on site, at all times.

9. Adequate drinking, hand washing and toilet facilities shall be provided for employees
and patrons of the facility, at all times.
10. A permanent, adequate water supply shall be provided for drinking and sanitary purposes.
11. Portable toilets are acceptable for employees or contractors on site for less than 2
consecutive hours a day. All other sewage disposal for the facility shall be by septic
system. Any septic system located on the property must comply with all provisions of
the Weld County Code, pertaining to Individual Sewage Disposal Systems.
12. The operation shall comply with all applicable rules and regulations of the State and
Federal agencies and the Weld County Code.

comments:
A building and electrical permit will be required, per Section 29-3-10 of the Weld County Code, for any
new structures ,additions or renovation to any structures. A building permit application must be completed
and two complete sets of engineered plans. A Code Analysis prepared by a design professional, licensed
bin the Ste of Colorado shall be submitted with permit application. MSDS sheets for all materials stored
shall be submitted with building permit applications.
Buildings and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2012 International Building
Code; 2012 International Mechanical Code; 2012 International Plumbing Code:; 2012 International Fuel
Gas Code; 2006 International Energy Code; 2011 National Electrical Code; 2009 ANSI 117.1
Accessibility Code and Chapter 29 of the Weld County Code.

Every Factory-Built Nonresidential Structure manufactured after the effective date of these regulations
that is manufactured, sold, or offered for sale in this state must display an insignia issued by the Division
of Housing certifying that the unit is constructed in compliance with the standards adopted in schedule "B"
which is incorporated herein and made a part of these Rules and Regulations by reference, and all other
requirements set forth by this resolution.
A Fire District Notification letter shall be submitted to the Fire District with jurisdiction for review and
comments and submitted with Commercial Permit application to Weld County.
