The dairy operation on the hereon described parcel shall be limited to the facilities shown which are designed to handle a total of - 700 cows and all other uses permitted by right under Section 3 . 3 .B. of the Weld County Zoning Resolution . 2 . The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust , and the growth of noxious weeds. 3 . All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 4. Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May, 1968. The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health, Water Pollution Control Division. 5. All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department . 6. All plans, specifications and data pertaining to the dairy opera- tion shall be submitted to the Weld County Health Department for approval prior to obtaining a Building Permit for the dairy operation. 7. There shall be no discharge of wastes into any streams, other bodies of water , or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 8. All dairy facilities will be set back at least 30 feet from the Pierce Lateral Ditch to allow maintenance of the ditch. 9. The area between the Pierce Lateral Ditch and the dairy shall be disced frequently to prevent any vegetative growth which may become a hazard in the event of a fire. 10. All grain shall be kept inside a building . No feed shall be stored between the Pierce Lateral Ditch and the feed building. 11 . Tree planting in the landscape area shall not be planted closer than 50 feet from the north line of Section 8 to protect sight distance at the service entrance. 12 . The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permittted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 13 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Noncompliance with any of the above stated Development Standards shall be reason for revocation of the Special Use Permit by the Board of County Commissioners. r CC::': :;TS : 1 . The Ault Fire Protection District has not responded to the re- ferral that was sent to that agency. 2. To date our office has received 3 letters in opposition to this request . A copy of those letters are included in the attached packets. 1 The Weld County Planning Commission held a scheduled meeting on November 6 , 1979 in the Weld County Centennial Center County Commissioners Hearing Room, first floor, 915 10th Street, Greeley, Colorado. A motion was called for to approve the October 16, 1979 minutes . Jerry Kiefer made a motion to approve the minutes as presented. His motion was seconded by Don Billings. All present cast a unanimous vote of "aye" to accept the minutes. CONSIDER A RECOMMENDATION FOR THE PURPOSE OF ADOPTING THE UNIFORM MECHANICAL CODE, 1979 EDITION AND CONSIDERING AMENDMENTS TO THE FOLLOWING SECTIONS OF THE WELD COUNTY BUILDING CODE: SECTION III.A. RELATING TO THE INCORPORATION OF STANDARD CODES; SECTION III .B. RELATING TO EXEMPTIONS; SECTION III.C. RELATING TO MOVED BUILDINGS; SECTION III .H. RELATING TO A FEE SCHEDULE FOR BUILDING PERMITS; AND SECTION III. I . RELATING TO THE CONDUCT OF INSPECTION DISCUSSION: Planning Director Gary Fortner indicated that problems have been encountered with regard to the advertising which was done concerning the Planning Commission meeting to consider the amendments to the Weld County Building Code. The error which was made in the advertising occurred to the sections which were listed to be considered in the Public Hearing on the codes . Specifically, the reference to Section III .A. relating to the incorporation of Standard Codes should have been a reference to Section II .A. since this is the actual section of the Weld County Building Code which deals with the incorporation of Standard Codes. The staff suggested that the hearing be opened on the proposed changes so that testimony could be accepted and that the hearing be continued until November 20 at which time the code changes could have been advertised properly. The Planning Commission agreed to this course of action. The various major areas of changes in the Code as proposed were summarized by the Director. Consideration of the Code as proposed was broken into two different areas : 1) The actual changes in the more technical aspects of the Code; 2) Changes in the Fee Schedule which are proposed in the 1979 Code. In the discussion of the more technical aspects of the Code a number of minor points were raised as the changes were explained, although these items were basically dealt with to the satisfaction of the Commission during the hearing. Two major points were raised with reference to changes in these portions of the Code. These include: 1) The requirement under Section II .A. 1 .b. that coverings on ventilation openings should be covered Planning Commission ME ing Page 2 November 6, 1979 by a wire mesh not less than one-quarter inch nor more than one-half inch in any dimension. It was indicated that it is typical to see wire mesh which is smaller than is used on those ventilation openings . Bob Huffman indicated that we were passing some that were covered with mesh smaller than one-quarter inch. It was suggested that this be taken back to the Building Trades Advisory Council and discussed for possible action to amend this section. It was determined that this would stand as indicated in the draft at this time. The second major issue which was raised related to the exemption from building permit requirements of work with a total valuation of less than $100. This particular exemption is found under Section III . B. 1 . a. The Planning Commission requested that the staff consider the possibility of increasing this minimum valuation to somewhere between $500-$1, 000 . With reference to the consideration of those portions of the Code dealing with changes in fee structures, significant opposition was raised by builders in attendance at the meeting as well as a number of members of the Planning Commission. In addition, a resolution from the Building Trades Advisory Committee objecting to the proposed increases in fees was presented to the Planning Commission. The general reasons for why the increases were being suggested were discussed by the Director of Planning who then answered questions from a number of the Planning Commission members and from members of the audience as to why such increases were taking place. After discussion of the proposed Building Code amendments , it was the decision of the Planning Commission to continue the hearing on the proposed amendments until November 20 , 1979 at which time the Commission would make a decision with regard to the proposed changes . In taking this action the Commission also recognized the resolution by the Building Trades Advisory Committee which supported the basic technical changes which were proposed in the Code, but which referred to their opposition to the proposed fee changes in the Code. As a result of this discussion surrounding the proposed Code changes , the Planning Commission requested that the Staff prepare materials relating to basic questions by November 20 so that the proposed changes could be reviewed in more detail at that point in time. These requests included: 1 . Review the Exemption section to determine whether or not a more realistic value for exemptions can be established. This point relates primarily to the now existing $100 valuation referred in Section III .B. l .a. 2 . The Staff was to clarify Section III .H. l .b. to reflect that only one plan check fee would be charged in those cases were standardized plans were submitted. This means that when standardized plans are submitted that will be utilized_ to develop or construct a number of homes , the plan check fee would be charged with the first building permit on that group of homes. Further plan check fees would not be required on latter permits which were built to the same set of plans which had already been reviewed. It was indicated by the Staff that any changes to such standardized plans would require additional fee charges , but that these fee charges would be based on the hourly rates defined in Table 3-A of the Uniform Building Code. Planning Commission r - ting Page 3 November 6 , 1979 3 . The Planning Commission requested a break-down of the costs and revenues associated with the Planning and Zoning and Building Inspection budgets. They also wanted a sheet which would give them the cost of the Planning Division and 208 budgets for 1980. 4 . The Planning Commission requested that the Staff determine how many permits would be taken by the office that would be based on standardized plans that have been previously reviewed by the Building Inspection Division. In general , the question related to what percent of the permits received would be required to pay a plan check check fee. Also, the Planning Commission wanted us to determine what percentage of the plans would not be charged plan check fees because of standardized plan reviews . 5 . The Planning Commission requested that we prepare copies of the fee schedules referenced in the changes from the Code book so that they would be available for the Planning Commission members review at the next meeting. 6. The Planning Commission requested that we contact other jurisdictions with reference to what kind of requirements they have for plan checks including the types of plans they require and what they require plans on. They requested that we contact Larimer County, Boulder County, City of Boulder, Greeley, Loveland, Longmont and Fort Collins . DECISION: The Planning Commission by a unanimous vote continued the hearing on the proposed changes in the Weld County Building Code until November 20, 1979. APPLICANT: Louis J. Highway 34 Business APPEARANCE: Tom Houtchens DISCUSSION: Mr. Houtchens stated that this request is to move the lot lines which requires amending the site plan for Lot A and considering the site plan for Lot B. The request is also to move the lot lines between Lots A and B to create a five acre parcel on Lot A which presently has a building on it and a three acre parcel on Lot B which is proposed to have a small steel building on it to service small engines and for the sale of boats. Tom Honn read the Planning Staff ' s recommendation for approval of both requests into the record, the Development Standards and comments . Mr. Ehrlich quested whether or not on-Lot B it would be appropriate to wait to see if there is adequate water to service the property. Mr. Houtchens responded that a household well has been approved for the property. However, since the property is commercially zoned a new well permit will have to be applied for for an exempt commercial use and anticipates no problem with the approval of the permit. Discussion followed. MOTION (Lot A) : Be it therefore resolved to recommend approval based on the Planning Staff ' s recommendation to the Board of County Commissioners. SE4 SW%, Section 16, T5N, R66W LOCATION: Northwest corner of the intersection of 65th Avenue and Highway 34 Bypass APPEARANCE: Monrico Lehnert DISCUSSION: Mr. Lehnert stated he purchased this property specifically because it is zoned Agricultural with the intention of developing his apple orchard and selling the products from the orchard. Several people in the area asked him if he could also sell their produce. This property has been designated as a neighborhood convenience shopping area by the Greeley Comprehensive Plan. There being no questions at this time, Tom Honn read the Planning Staff ' s recommendation for approval, the Development Standards and the comments into the record. Mr. Ehrlich asked that if this change of zone is granted if this would cause a problem if additional businesses came into the area where there are presently residences or other areas that could be developed into residences. Tom Honn stated it could set a precedence where there are circumstances like this particular one. Discussion followed. When he staked the foundation for construction of his home on Lot 4 , he could not find the front corner pins . The pins had been covered when Cactus Drive was put in and paved. Assuming the Public Service Company had set their transformer pedestal on the corner of the property he used it as a guide. When his house was completed and an improvement survey done, it showed the power box to be approximately 30 feet off the corner pin and the house too close to the south property line. He had no intention of moving it as he owned both lots and was not concerned about it. He has now sold the property and wishes to have this problem corrected. The property has been surveyed and the pins moved enough to allow the new property owners full use of Cactus Drive on the south side of the house. Tom Honn then read the Planning Staff ' s recommendation for approval of the request into the record. Doug Murray, President of the Board of Directors of the Northmoor Acres Homeowners Association, expressed his opposition in behalf of the Homeowners Association because they were not notified of the proposal . He stated that the Homeowners Association owns the property that borders the back of the lots and therefore had a right to be notified of the request and the hearing. He also stated that the Board of Adjustment should should not have granted a variance on this property because of lack of notification of surrounding property owners . A great deal of discussion followed regarding this matter. The attached Development Standards being recommended and adopted for the Special Use Permit . 2. No building or electrical permits shall be issued on the Special Use Permit area until the attached Development Standards for the Special Use Permit have been placed on the Special Use plat and said plat has been delivered to the office of the Department of Planning Services. DEVELOPMENT STANDARDS 1. The dairy operation on the hereon described parcel shall be limited to the facilities shown which are designed to handle a total of 700 cows and all other uses permitted by right under Section 3. 3.B. of the Weld County Zoning Resolution. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust , and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 4. Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May, 1968. The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health, Water Pollution Control Division. 5. All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 6. All plans, specifications and data pertaining to the dairy opera- tion shall be submitted to the Weld County Health Department for approval prior to obtaining a Building Permit for the dairy operation. 7. There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 8. All dairy facilities will be set back at least 30 feet from the Pierce Lateral Ditch to allow maintenance of the ditch. 9. The area between the Pierce Lateral Ditch 2,nd the dairy shall be disced frequently to prevent any vegetative growth which may become a hazard in the event of a fire. 10. All grain shall be kept inside a building. No feed shall be stored between the Pierce Lateral Ditch and the feed building. 11. Tree planting in the landscape area shall not be planted closer than 50 feet from the north line of Section 8 to protect sight distance at the service entrance. 12. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permittted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 13 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Noncompliance with any of the above stated Development Standards shall be reason for revocation of the Special Use Permit by the Board of County Commissioners. COMMENTS : 1. This area will accommadate 80 additional dry cows when maximum cow numbers are reached. 4. The drainage ditch will collect runoff water from all of the cattle pens. It will be constructed 14 ft. wide with an 8 ft. bottom 111 ft. deep. There will be a: 2:1 slope from the bottom to the sides. 5. The lagoon shall be 230 X 60 X 13 with 2:1 sloping sides allowing a licquid depth of 12ft. and 1 ft. of freeboard. It is designed to hold a 25year 24 hour storm with additional capacity for the parlorr wash water and for the fact that ',only one lagoon will be used. Total capacity of the lagoon will be 2.27 acre feet. Page 6. The feed storage area will eventually contain grain storage in either steel bins or in a steel or ce ent building. A bunker silo will be built for silage and high caisture corn silage. There will be a cement slab to load the feed on. In addition soma covered hay storage ry be built in the future. Provisions for expansion of the lagoons and corrals will take place as the dairy grows; we hope to reach our maximim number in ten years. The barn will be built with adequate sewage disposal and meet building requirements set by the county and state. The barn will milk 16 head and the milk will be cooled through a heat exchange method using city water. This warmed water will then be, stared in water heaters for further use. The corral areas will be cleaned in the fall through spring and manure will be hauled.and spread on ad- joining fields on the farm. Although the exemption is being applied to the immediate area of the dairy, the farm will be operated as one unit and controlled by the dairy, thus making available ready manure disposal. The contents from the lagoons will be pumped on the fields and used as an irrigation source. The feed areas between pens will be a cement slab which can be scrapped daily to insure uneaten feed is removed and not allowed to decay. Fly abatement will primarily be by use of an oral larva- aide. During peak periods of large fly numbers control by misting will also be used. Pat and rodent control will be through poison application in areas where grains are stored and rodent traffic is observed. We also like cats. Inorder to alleviate noise, dust and excessive light pollution, the immediate dairy f e1'11 ty will be surrounded by a row of trees. Pens and work areas will be lighted with mercury lamps on light sensor controls. The milk truck will be on every other day pickup and will enter the facility at a vantage point to be clearly seen approximately 1/2 to 3/4 mile from either direction. A border fence will also bemain- tained inorder to insure livestock will not accidently wander onto the roadway. The cows in high and middle production pens will be milked three times daily. Lower producing cows will be milked twice. The facility will employ two full time people and a part-time relief milker. The full time people will have milking and feeding responsibilities. The dairy will eventually - grow until a maximum number of hours is spent in the barn with adequate down time to meet unforeseen equip- sent breakdowns. At this point we project milking around 500 to 600 cow. If a power failure occurs a generator will provide electricity to milk all the cows and cool the milk. Bo 86 Greeley, 0632 I have reviewed the Weld County Planning Commission request for Dale Benson, Dairy Operation Special Use Permit, located in a portion of the NIA of Section 8, Twp. 7N, Range 66W, four miles west and one mile north of Ault, Colorado. The special use permit will allow construction and installation of an operation that will eventually house 600 milk cows. From the material provided, there is not enough information to assess whether the planned construction will be adequate for the proposed facility. There is no information as to storm runoff, capacity and size of diversion or "drinage ditch", size of lagoon, or how wash water will be handled from the dairy barn itself. It surely cannot be handled with the 750 gallon septic tank and leach field. Manure disposal is mentioned as "spread on fields from fall to spring with sumps being emptied as an irrigation source", and disposal of stock pen drainage as "pens will drain to holding sumps Eor storage before pumping to nearby fields." This method is acceptable, however, the plan does not indicate whether the applicant does in fact have adjacent fields, or whether he will be making an agreement with neighbors for this privilege.
