The County Services Committee recommends that the office of County Clerk and Recorder remain an elective office with no additional qualifications added to this elective office beyond those now required. B . That the five ( 5) existing divisions under the County Clerk and Recorders Office be continued as they now exist . 1 . Motor Vehicle Registration 2 . Election 3 . Recording 4 . Retrieval Section —5-. Clerk to the Board of County Commissioners 2 . County Attorney A. This office is to be filled by appointment by the Board of County Commissioners . B . That this office be made a full time position with appropriate staffing and salaries to be determined by the Board of County Commissioners . Recommendations not to be_.included._in .the Charter but are given for consideration only . That the full time appointed County Attorney or a qualified member of his staff advise all county agencies in Civil matters where possible . 75.— /40- 9 i • COUNTY SERVICES COMMIf1EL MINORITY REPORT MARCH 19, 1975 With due deference to the views of the majority of the Committee on County Services, (County Clerk & Recorder and the County Attorney) , it is recommended to the Charter Commission: 1. The County Clerk serve as an appointed official, appointed by the County Commissioners, to serve at the pleasure of the Commissioners and have administrative skills and experience commensurate for the duties to be performed. 2. The present department duties of the County Clerk and Recorder be retained, with the exception of the duties of the Clerk to the Board of County Commissioners, which position would be removed and placed directly under the County Commissioners as their own sepRrate appointment. r 3. The County Commissioners should employ as County Attorney, one who has been admitted to practice before the Colorado Supreme Court for not less than five (5) years, to serve at the pleasure of the commissioners. No specific restrictions should be placed in the Charter, on outside practice by the County Attorney, which is not in conflict with County matters. A separate office and staff with view that the County Attorney would be employed so that the County matters would be his principal occupation. In all other matters the Majority views are adopted by the Minority. Reasons for the differences in views of this Minority report from those of the Majority of the Committee, will be expounded orally to the Commission. • • DUTIES OF CLERK TO THE BOARD Reference shall be made to C. R. S . 1973 , 30-10-319 , "Clerk of Board - Duties. " 1. Since the Clerk is required to record in a book all proceedings of the Board, at least one Deputy Clerk is in attendance at all official meetings . Minutes arc then written on those meetings . These are retained permanently in a Minute Book. 2 . Regular entries must be made of all resolutions and • decisions concerning the raising of money . All resol- utions are now put on Miraccde in date order for fast reference. The originals are maintained in files in the file room. Money matters, following approval by • the Board, are handled in the same manner . 3 . A record of the vote of each Commissioner on the questions submitted is• shown on the resolutions . 4 . P.11 bookkeeping is handled in the Office of Management and Budget. - Therefore, the only duty of this type is • to sign all warrants through the checksigner . Welfare warrants have the signatures of the Chairman of the Board as well as that of Barton Buss . All other warrants have the Chairman and the County Clerk ' s signatures . 5. The Clerk shall preserve and file all actions taken by • the Board during their official meetings . These may include such items as money matters, appointments , etc . 6 . Other duties required of the Clerk are : a . Attest the signatures of the Commissioners . (Attesting is simply authenticating the signatures of the Commissioners or Chairman of the Board . ) b. Prepare applications for beer , liquor and dance licenses. Issue same following approval by the Board. c. Keep record of oil and gas leases showing rental amounts received on each. ci . Distribute the daily mail. e. Receive and file reports from County agencies required to make such reports. f . Publish legal notices for hearings . Also, prepare the necessary items for hearings such as certified mail to the adjacent landowners , notices to other County depart- ments, packets for Commissioners . g. Prepare resolutions authorized in official meetings that are not prepared by the County Attorney . h. Tape record all official meetings of the Board. Tapes are maintained for future reference. i. Preparb agendas for weekly meetings . j . Make and certify copies of any documents on file in the Office of Clerk to the Board, upon request by anyone. k. Sell county maps . 1.
