Re: Site Specific Development Plan and Use by Special Review Application
Circle B Land Company c/o Bill Barrett Corp.
Case No. USR14-0051
S / SW IA Section 7, T6N, R61 W, 6th P.M.
Water Division 1, Water District 1
Dear Mr. Ogle:
The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011
memorandums to county planning directors, this office will only perform a cursory review of the
referral information and provide comments. The comments will not address the adequacy of the
water supply plan for this property or the ability of the water supply plan to satisfy any County
regulations or requirements.
The applicant is seeking a Site Specific Development Plan and Use by Special Review permit
for an oil and gas storage yard facility and operations office on a parcel of approximately 80 acres. A
radio communications tower is also proposed to be installed at the site. Approximately ten
employees will be staffed on-site, and an additional six to twelve delivery trucks will access the site
on a daily basis.
The proposed water source for the site is an existing well constructed under permit no.
69938. Well permit no. 69938 was issued for domestic use; the applicant has indicated plans to
submit an application to this office to change the use of the well to commercial use. To date, no
such application has been received by this office. It is anticipated that a commercial exempt well
permit could be obtained for the site upon application for such. This type of well may be used for
drinking and sanitary purposes inside a commercial business, with no irrigation or other outside use
allowed. The amount of water allowed to be withdrawn would be limited to one-third of an acre-
foot (108,600 gallons) per year. This office's final determination regarding if a well permit can be
issued for the site will be made at the time a well permit application is submitted to this office.
Since the proposed water source is already in existence and could potentially be used in
violation of its permitted terms and conditions, we suggest that approval of the Site Specific
Development Plan and Use by Special Review be withheld until the necessary commercial well permit
is approved. Should you or the applicants have any questions regarding this matter, please contact
Sarah Brucker of this office.
