HomeMy WebLinkAbout20143407.tiff MEMORANDUM EL � TO: KIM OGLE,PLANNING SERVICES vn aNTY �Y FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH SUBJECT: USR14-0051 CIRCLE B LAND COMPANY DATE: SEPTEMBER 16, 2014 Environmental Health Services has reviewed this Site Specific Development Plan and a Special Review Permit for Mineral Resource Development Facilities, oil and gas support and service including, but not limited to an oil and gas production equipment storage yard, office and associated buildings including four (4) conex storage containers and a twenty (20) foot in height communications tower in the A (Agricultural) Zone District. Water will be provided by an individual well which the application states will be repermitted to commercial. The existing septic system for the residence (SP-0400015) was reviewed by an engineer and is adequately sized for the proposed office. The access drive, drive areas and storage yard will be graveled. Water will be utilized for dust control if necessary. The waste handling plan stipulates that two dumpsters will be provided and will be serviced by Waste Management. Any fluids will be recycled or disposed of by Clean Harbors. The plan did not indicate if vehicles or equipment will not be washed at the site. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: 1. Prior to recording the plat: a. The applicant shall submit a revised waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include whether washing will occur on site and how wash water will be contained. b. The applicant shall submit written evidence of a commercial well to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. We recommend that the following requirement be incorporated into the permit as a condition that must be met within 6 months of operation: 1. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be provided to Environmental Health Services Division of the Weld County Department of Public Health & Environment. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the approved Waste Handling Plan, at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan, at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non-specified Zone District, as delineated in Section 14-9-30 of the Weld County Code. 6. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 7. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 8. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On-Site Wastewater Treatment Systems. 2 9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 10.The Spill Prevention, Control and Countermeasure Plan shall be available on site, at all times. 11.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 12.The applicant shall obtain a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, as applicable. 13.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 3 DNR D O1 HOER A D O Resources Co Water 1 Tt—,rt ofv,,u no,°I_ 1313 Sherman Street, Room 821 Denver. Water Division 1, Water District 1 Dear Mr. Ogle: The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. The applicant is seeking a Site Specific Development Plan and Use by Special Review permit for an oil and gas storage yard facility and operations office on a parcel of approximately 80 acres. A radio communications tower is also proposed to be installed at the site. Approximately ten employees will be staffed on-site, and an additional six to twelve delivery trucks will access the site on a daily basis. The proposed water source for the site is an existing well constructed under permit no. 69938. Well permit no. 69938 was issued for domestic use; the applicant has indicated plans to submit an application to this office to change the use of the well to commercial use. To date, no such application has been received by this office. It is anticipated that a commercial exempt well permit could be obtained for the site upon application for such. This type of well may be used for drinking and sanitary purposes inside a commercial business, with no irrigation or other outside use allowed. The amount of water allowed to be withdrawn would be limited to one-third of an acre- foot (108,600 gallons) per year. This office's final determination regarding if a well permit can be issued for the site will be made at the time a well permit application is submitted to this office. Since the proposed water source is already in existence and could potentially be used in violation of its permitted terms and conditions, we suggest that approval of the Site Specific Development Plan and Use by Special Review be withheld until the necessary commercial well permit is approved.
