OIL AND GAS SUPPORT AND SERVICE (DISPOSAL AND RECYCLING SITES FOR
PRODUCTION WASTE - A CLASS II UNDERGROUND INJECTION WELL AND AN
OIL AND GAS CONSTRUCTION LAY DOWN/STORAGE YARD) IN THE A
(AGRICULTURAL) ZONE DISTRICT— CIRCLE B LAND COMPANY, LLC
A public hearing was conducted on March 19, 2014, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 30, 2014, and duly published
February 4, 2014, in the Greeley Tribune, a public hearing was conducted to consider the
request of Circle B Land Company, LLC, for a Site Specific Development Plan and Use by
Special Review Permit, USR13-0066, for Mineral Resource Development Facilities, including Oil
and Gas Support and Service (disposal and recycling sites for production waste - a Class II
Underground Injection Well and an oil and gas construction lay down/storage yard) in the
A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of
record.
0 Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the
record as written. He said 11.74 acres in the southwest portion of the 80-acre parcel will be
utilized for the project. A Subdivision Exemption was also applied for, and the plat was just
submitted. This is a rural agricultural area, with residences two miles from the site. A noise limit
is proposed, lighting will be downcast, a chain-link fence will surround the facility, and no
objections have been received by the Department of Planning Services. He showed photos of
the proposed site.
Don Carroll, Department of Public Works, provided a brief overview of the transportation
plans and requirements. Access will be off of County Road 52, a local gravel road, and they
estimate 30 semi-truck trips per day. A grading permit will likely be required, as well as an
off-site road improvements agreement and a haul route.

El Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions, and Heather Barbare, Department of Public Health and Environment, was
also available for questions. Ms. Light stated a Waste Handling Plan and a Dust Abatement
Plan have been submitted, and a Spill Prevention, Control, and Countermeasure (SPCC) Plan
will be kept onsite at all times. An Air Emission permit is required, and there are COGCC
requirements, and, in addition, a Reclamation Plan needs to be in the County records prior to
release of building permits. The Development Standards are typical for injection wells
throughout the County. Commissioner Kirkmeyer asked about Development Standard #17, and
Ms. Light said run-off needs to be confined on the site in case of contamination. Ms. Barbare
said that this pertains to the whole site, not just the pad.
e Vince Harris, Baseline Corporation, represented the applicant and introduced the
representatives present from the Circle B Land Company, LLC. Mr. Harris summarized the
producing
company has assets in Colorado, Utah and Wyoming, with p g wells, and 83 more in
proposed in 2014. He reviewed location, access, and containment, and showed aerial images
of the site. He also reviewed the equipment/structures to be built on the site, showed the layout
of the storage facility and pictures of an existing operation, and reviewed the proposed haul
routes. Mr. Harris said he and the applicants appreciated all the help they received from Weld
County staff.
e In response to Chair Rademacher, Mr. Harris said that they expect around 30 trucks per
day, and only one may unload at a time. He said there is plenty of room for internal staging.
e No public testimony was offered concerning this matter.
In response to Chair Rademacher, Mr. Harris indicated he and the applicants have
reviewed, and agree to abide by, the Conditions of Approval and Development Standards.
Commissioner Kirkmeyer moved to approve the request of Circle B Land Company, LLC,
for a Site Specific Development Plan and Use by Special Review Permit, USR13-0066, for
Mineral Resource Development Facilities, including Oil and Gas Support and Service (disposal
and recycling sites for production waste - a Class II Underground Injection Well and an oil and
gas construction lay down/storage yard) in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Conway, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:26 a.m.
