However, having adjoining property and an irrigation carrier ditch that runs the entire length of the eastern boundary of the development property, we do request that the following concerns be noted and addressed by the Planning office and the Commissioners. 1) The property access crossing over the Sater Family Interests concrete carrier ditch must be engineered by an accredited concrete ditch engineer, with footers and a cap that will maintain the weight of all vehicles and machines requiring access to the property without damage to the existing ditch. The planned engineered crossing will be presented to and approved by Sater Family Interests, 2) Any damages to the concrete carrier ditch will be reported immediately and the method of repair approved by Sater Family Interests. 3) Any intent of change to the carrier ditch must be requested and approved. 4) All costs associated with changes and repair will be incurred by Goddard investments, LLC or the property owner at the time of damage and/or change. 5) Access to maintain and burn the carrier ditch must be granted to Sater Family Interests. 6) There will be no authorized headgates or interference in the delivery of irrigation water. 7) The Purchaser of the lot abutting the carrier ditch must be notified of items 2 thru 6. 8) There is no authorization to use the Sater/Anadarko southern boundary well access road. Kahn Subject: New Coal Ridge Ditch Mr. Kahn, I represent Chris Zadel and Tommy Ray. They are attempting to develop Panorama Planned Unit Development near Firestone. Through the Change of Zone referral process the County Planning Department received a letter from you as representative of the New Coal Ridge Ditch Company. The only concerns raised by the Ditch Company were that all activities related to the Planned Unit Development be off of the easement for the canal and that a written agreement be entered into before any structures or modification are made to or within the easement or the canal. Thomas O'Malley, President of the New Coal Ridge Ditch Company, requested assurance that we understood these concerns. We would like to state that we do understand that all activities related to the Development need to be off of the Ditch easement and that an agreement with New Coal Ridge Ditch Company and the Northern Colorado Water Conservancy District will need to be obtained before any structures or modifications are made to the easement or canal.
