This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011) CR 1.5 is a local paved road (Elmore Rd.) and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. No (ADT) traffic count number at this location. REQUIREMENTS: Show the approved access on the plat and label it with the approved access permit number (AP#). The USR plat needs to show 60' of right-of-way on Elmore Road, a north arrow, and the scale. Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code Drainage: The historical flow patterns and run-off amounts will be maintained on site. Traffic: No additional traffic is anticipated. Vehicular traffic circulation will continue to be provided by Elmore Road which connects to State Highway 66.The CO RHS has no employees. One volunteer visits the site two days during the week and two to four volunteers visit the site each Saturday. Others may visit by appointment only. Water is provided by Long Peak Water District. There is an existing septic permit on file for this property. Septic permit G19732314 was sized for 3 bedrooms/6 people. The application states there are no employees, a maximum of 4 volunteers and a limited amount of public who would come to the site. Any additional hydraulic load to the existing septic system which exceeds sizing requirements shall require a review by a Colorado registered professional engineer and in the event the system is found to be inadequately sized or constructed, the system shall be brought into compliance with current regulations. A waste handling plan was not submitted. A waste handling plan is required which shall address items associated with the kennel such as animal feed and waste. Washing of pens, food items, bedding shall also be contained in the waste handling plan. An on site dust abatement plan was not submitted. The site map shows two paved access drives but does not indicate what containment areas are constructed of and how they are maintained. Noise will be restricted to the level allowed in the residential zone district. A Pet Animal Care Facilities Act license (PACFA) is required according to the Department of Agriculture. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: The following requirements are recommended to be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 3. The applicant shall provide a copy of the current license from the Pet Animal Care Facilities Act (PACFA) to the Weld County Department of Public Health and Environment. We recommend that the following requirements be incorporated into the permit as development standards: 1. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed weekly from the facility and disposed of by a commercial hauler. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved waste handling plan, at all times. 2 5. The applicant shall comply with the Colorado Department of Agriculture (CDA), Division of Animal Industry. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan, at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in Section 14-9-30 of the Weld County Code. 8. Adequate drinking, handwashing and toilet facilities shall be provided for public, employees and volunteers of the facility, at all times. 9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes, at all times. (Longs Peak Water District) 10.Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.In the event the existing septic system is utilized for business use, the septic system shall be reviewed by a Colorado registered professional engineer if the usage surpasses septic permit G19732314 sizing limitations. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. A building permit application must be completed and two complete sets of engineered plans. Weld County Building Department records do not indicate a building permit was pulled for the existing shop, the Assessors records show the structure was built in 2004. A change of use building permit will be required for the existing shop; an Agreement Concerning Existing As-Built Construction can be used to show compliance with structural. electrical and mechanical requirements. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2012 International Building Code; 2012 International Mechanical Code; 2012 International Plumbing Code:; 2012 International Fuel Gas Code; 2006 International Energy Code; 2011 National Electrical Code; 2009 ANSI 117.1 Accessibility Code and Chapter 29 of the Weld County Code. This violation was initiated due to the operation of a kennel (or more than 4 household pets of one species) without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual court date being scheduled, NO investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. If this application if approved by the Board of County Commissioners and once a plat is recorded will correct this outstanding violation. If this application is denied, the number of household pets shall be reduced to 4(four)or a combination of 2 or more species totaling no more than 7 within 30(thirty)days of denial or the violation will proceed in court accordingly.
