RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT, USR-1224

WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated May 26, 1999, the Board approved the request of Roy
and Jacqueline Nelson, for a Site Specific Development Plan and Use by Special Review
Permit#1224 for a Commercial Recreational Facility (roping arena) in the A (Agricultural) Zone
District, on the following described real estate, to-wit:
Lot B of Recorded Exemption #1670, being part of
the in the N1/2 NE1/4 of Section 8, Township 4
North, Range 64 of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from Roy and Jacqueline Nelson, P.O.
Box 526, Kersey, Colorado 80644 to vacate a portion of said Use by Special Review Permit
#1224.
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said partial vacation,
conditional upon the following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant
shall submit a revised plat, titled "Partial Vacation of Use by Special
Review Permit, USR-1224, conforming to Section 23-2-260.D of the Weld
County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Use by Special Review Permit #1224, be, and hereby is, partially
vacated, with the above mentioned condition, with said plat to be titled and recorded as Partial
Vacation of Use by Special Review Permit, USR-1224.

Subject: Partial vacation of USR-1224—Public Recreational
Facility (Roping Arena)

The property is legally described as Lot B of Recorded Exemption RE-4029 being located in the
North Half of the Northeast Quarter of Section 8, T4N, R64W of the 6th P.M., Weld County, CO
and is located south and adjacent to County Road 48 and west and adjacent to County Road
53.
The applicants are requesting a partial vacation of USR-1224 to reflect the downsizing of the
Special Use Permit for a roping arena in conjunction with a Recorded Exemption application.
The partial vacation will ensure that the boundary of USR-1224 is consistent with the boundary
of Lot B of RECX13-0078.
The Department of Planning Services is recommending approval of this partial vacation.
Background Information
USR-1224 was approved March 1, 2000 for a Site Specific Development Plan and Use By
Special Review Permit for a Public Recreational Facility (Roping Arena) in the A (Agricultural)
Zone District, as indicated in the application material on file in the Department of Planning
Services and subject to the Development Standards stated hereon.
The property owners submitted a Recorded Exemption to split Lot B of RE-4029 into two
parcels. Lot A is proposed for a new residence for the property owners. Lot B will retain the
current Special Use Permit designation for a roping arena.
Lot A will be approximately 26 acres in area and will be served by Central Weld County Water
District and a new septic system. Lot B will be a minimum of 35 acres net and is served by a
Central Weld County Water District Tap No. 2038 and a septic system permit number SP-
9600459.

1 a.Water will be provided by Central Weld County Water District. A letter from the
water district is attached.
2 A copy of the existing Septic Permit(#SP-9600459), are included with the
application.
3 The parcel has one Pole Barn used as a one family home, four loafing sheds,one hay
shed. The west half is not currently being used. There is an oil and gas well head on
the north east corner, center of the parcel,and in the center of the west part of the
parcel. There is also an oil and gas well heads and tanks on the northwest corner.
4 The new lot will be approximately twenty eight acres in size, and will be located on
the south of and adjacent to County Road 48.It will be used for a single family
dwelling site.
5 There are no unique physical characteristics on site.
6 There are no building envelopes on this parcel.
7 There is a Use By Special Review Permit on the property, but will be vacated from
the twenty eight acres.
