WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 27th of November, 1978 , the Preliminary Plan of Bird Subdivision was submitted to the Board of County Commis- sioners of Weld County, Colorado for approval in accordance with the Subdivision Regulations of Weld County, Colorado, and WHEREAS, the Board of County Commissioners heard all of the testimony and the statements of those present, and WHEREAS, the Board of County Commissioners had evidence presented in support of the approval of said Preliminary Plan, and no evidence was presented in opposition to the approval of the Preliminary Plan for the following described estate, to-wit: Part of the Southwest Quarter of Section 16, Town- ship 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: Beginning at the West Quarter Corner of said Section 16, and considering the North line of said Southwest Quarter as baring North 89°45'10" Fast, with all other bearings contained herein relative thereto; Thence North 89°45'10" East, along said North line of said Southwest Quarter of Section 16, 1124.03 feet; Thence South 00°14'50" East, 413.00 feet; Thence South 59°30'10" West, 109.92 feet; Thence South 89°54'30" West, 1030.35 feet to a point on the West line of said Southwest Quarter of Section 16; Thence North 00°05'30" West, along said West line of said Southwest Quarter of Section 16, 465.58 feet to the Point of Beginning. Said described parcel of land contains 11.999 acres, more or less, and is subject to any rights-of-way or other easements as recorded by instruments of record or as now existing on said described parcel of land. WHEREAS, the petitioner was present, and WHEREAS, the Board of County Commissioners has studied the request as submitted, and having been fully informed, is satisfied that the submitted Preliminary Plan conforms in all respects with the requirements of Section 5 of the Weld County Subdivision Regulations , and that approval of said Preliminary Plan would be e L 780906 ... in the best interest of Weld County. Bird S-151 : 78 : 8 PLANNING COMMISSION RECOMMENDATION November 21 , 1978 The Planning Commission recommendation for approval is conditional upon the following items being included in the application for the final plat : 1. Submission of a subsurface drainage plan , surface drainage plan and vegetative and erosion control plan as requested by the West Greeley Soil Conservation District in a letter dated October 10, 1978. 2 . The following statements being placed on the final plat : A. Due to the high ground water table, basements shall be permitted to be constructed only when the individual lot soils investigation substantiates that a basement can be built given the soils and ground water table conditions . B. A soils investigation and an individual foundation design shall be completed and submitted to the Building Inspection Division for approval prior to the issuance of a building permit for any residence. C. Due to the high ground water table , approval of an engineered evapotranspiration sewage disposal system by the Weld County Health Department shall be installed on each lot unless specifically exempted by the Weld County Health Department . Exemption from the engineered evapotranspiration type of sewage disposal system shall be based on accurate data indicating seasonal depths of ground water . These statements will address the concerns of the Colorado Geological Survey as contained in their letter dated September 22 , 1978 . Comments : 1 . The Milliken Fire District did not respond to the referral sent to them. 2 . Our office has received one letter of opposition from Leonard Gadeken , the adjacent property owner to the south of the Bird property . His objection is to the proposed street design . A copy of his letter is in Chu attached materials . 3 . The Greeley Public Works Department has requested that the proposed street geometries within the 131rd Subdivision conform to the following minimum City standards : Centerline radius = 200 feet and tangent length = 250 feet- between curbs . In addition it has been recommended that streets be improved with curb , gutter , and sidewalk and that the drainage conform with the principles of the Greeley Comprehensive Drainage Plan . The . Commission also reviewed the alternative for the 24th Street • collector to be aligned from its current point of construction westward around the north of the reservoir . The Public Works Department requests that the proposed street geometries within I the Bird Subdivision conform to the following minimum City standards : I center line radius = 200 feet and tangent length = 250 feet between curbs . Vote was taken and the motion carried unanimously . • IV. FINAL PLAT: SOLAR RIDGE SUBDIVISION LOCATION : 19th Avenue and 24th Street John Given presented the final plat of Solar Ridge Subdivision . Commissioner Cummins asked to sec a copy of the approved preliminary plat . Mr . Given showed this to the Commission and noted that the major change to the plat is that a portion of 19th Avenue was built hut never dedicated so this is now being done . It 'was therefore necessary to widen lot 2 . Commissioner Cummins noted that there • had been some problems with lot 2 discussed at the time of review of the preliminary plat . Jay Freese explained that Waldorf School will probably be keeping lot 2 . Chairman Dietz expressed concern for the private drive in the area which has been named, as well as the access to the property . He asked if the lots still meet R- 1E requirements . Mr . Given replied that they do . Commissioner Clift asked if drainage for the area has been taken care of. Mr . Freese replied that drainage will be handled as each individual lot is developed. Commissioner Clift asked if the grade of the street would cause problems . Mr . Freese replied that it would meet minimum requirements . Max Karner , City Engineer, commented that the street does meet all the requirements although it will not be a typical street . Chairman Dietz asked for further clarification on the handling of the drainage . Mr . Karner explained that each lot will have to pro- rate drainage from the street for that lot so the water will still run off the property hut no more than would histori- cally drain off . Commissioner Cummins made a motion to approve the final plat. Commissioner Roeth seconded the motion. Vote was taken and the motion carried unanimously. VI REFERRAL FROM COUNTY: Revised Preliminary Plat of Bird Subdivision LOCATION: 2420 71st Avenue John Given explained that this item has been reviewed previously and the Commission recommended denial , with the request that provision he made for access to adjoining property . The present plat accommodates this request . Chairman Dietz asked if 24th Street is anticipated to extend through this property . Mr . Given pointed out the location where 24th Street will likely extend through . He also recommended that 70th Avenue and local streets developed from 24th Street he the primary access to future interior subdivision . Mr . Freese suggested that a temporary turn-around should be shown where the street is stubbed . Mr . Given noted that the geometries should he redesigned according to the City Engineer . Commissioner Rocth made a motion to recommend no objection to the proposed preliminary plat . Commissioner Clift seconded the motion. Approximately 200 feet north of the proposed location is a crest in 71st Avenue. This crest is 4 feet higher than the grade at the access . This partially obstructs visibility and could be a safety hazard. 2. I object to the proposed traffic pattern and the individual lot retention areas. Yet, considering the subdivision' s inclusion in the Greeley comprehensive plan, these items should be referred to the City of Greeley. 3. The County should not accept the street for maintenance with a tailwater ditch along the south property line in the right-of-way. There are approximately 11.999 acres t' divided into 8 40,000 sq. ft. or more lots. Each lot will be single -family with roughly 1400 sq. ft. minimum Ranch style houses or equivelant with limited number of out buildings allowed. Each lot will be serviced by Greeley Gas, Poudre Valley Rural Electric Assoc. , Mountain Bell, City of Greeley water, and use septic systems as a means of sewage disposal. Presently, located on the south boundary is a natural drainage ditch which drains approximately 60 acres of ground to the due west of 71st Avenue and runs through a 15" squash pipe onto our property. We plan to tile. this ditch for approximately 100 feet and then take it into a "French Drain" arrangement approximately 100 feet past the eastern most point of the proposed road into the subdivision. Since the land is free and clear, we plan to use the final subdivided product as collateral. The money will be obtained through private funds as well as lending institutions. We will use a surety bond arrangement to guarantee complete improvements. Furrows, contour furrows and cross slope furrows will work on row crops. Sprinkler irrigation is also recommended. Minimum tillage and crop residue utilization will help control erosion. Fertility maintenance is important. Crops grown on these soils respond to fertilizer applications of phosphorus and nitrogen. w+• Lamm The potential native vegetation of this soil should be based on taking half and leaving half of the total annual production. Seeding is advis- able if range is in poor condition. Sand bluestem, sand reedgrass, switchgrass, sideoats grama, blue grama, pubescent whentgrass and crested wheatgrass are suitable for seeding. rile grass selected should 1 meet the seasonal requirements of livestock. For successful seeding, a clean, firm, sorghum stubble-prepared the growing season prior 1O seeding- or a firm, prepared seedbed and grass drill should be used. Early spring �IV4M seeding has proven most successful. Windbreaks and environmental plantings are generally suited to this soil. Soil blowing is the principal hazard to establishing trees and shrubs. This hazard can be overcome by cultivating only in the tree row and by C0+!1•1• leaving a strip of vegetation between the rows. The purpose of this investigation was to determine those soil conditions and characteri- stics which would affect the utility of the soils and foundation design of the proposed structures. Data gathered through field and laboratory work are summarized and tabulated in Exhibit Nos. 1 through No. 5 attached. FIELD INVESTIGATION Test borings were made May 19, 1978 at the locations shown on Exhibit No. 1 , to obtain data concerning existing soil conditions and to obtain samples for laboratory use. Six holes were drilled with a truck mounted power auger equipped with a four inch bit. Penetration data were gathered using the Standard Penetration Test, ASTM D 1586. This test is made by driving a two inch split spoon sampler with a 140 pound weight falling 30 inches. The blows required to drive the sampler twelve inches are referred to in Exhibit No. 2 as blows per foot. The test borings were located to best reflect representa- tive general conditions at the site, and to obtain specific data at each location sampled. Test borings were taken to the approximate depths below the surface shown U on Exhibit No. 2. Disturbed samples of each soil type encountered were obtained for laboratory analysis. As each boring progressed, a log was kept on which was recorded such information as field classification of soils, sample locations, depth to groundwater table, if any, and other pertinent data. These logs are reproduced on Exhibit No. 2. -1- a LABORATORY INVESTIGATION The laboratory phase of the investigation included the verification of field soil classification, determination of soil gradations by mechanical analysis, Atterberg Limits, natural moisture content, and consolidation- swell charcteristics of foundation material . These test results are summa- rized on Exhibit No. 5. SITE CONDITIONS The site is located west of Greeley, Colorado, approximately 3 miles. It is bounded on the west by 71st Avenue and is approximately one half mile north of U.S. Highway 34 By-Pass. The topography is gently rolling with surface drainage in an easterly direction to a drainage swale located adjacent to the east property line. There is approximately 30 feet of relief over the area investigated. Adequate drainage is available provided that proper grading and landscaping are observed. GROUNDWATER Evidence of groundwater was encountered at the depths shown on the accompany- ing Test Boring Log Exhibit. It is anticipated that groundwater will fluctu- ate as much as 4 feet during wet and dry cycles of the year. Basement construction may have to he limited to that portion near list Avenue. In any event, peripheral drains should be located around footings with discharge into a "French Drain" system constructed in sanitary sewer trenches. If a sanitary sewer system is not planned, groundwater can he carried off through sub-drains underneath water distribution lines. I -2- 4 111 SUBSOILS Our analysis reveals the soils consist of eolian deposits of silty sands over silty clays with occassional gravel deposits. The silty sand layer is relatively thin and in most cases will be penetrated during site grading and building construction. Our consolidation curves of the silty clays indicate no expansive soils are present. The site is underlain by the Laramie Formation of sandstone-claystone, but the depths to bedrock indi- cate no contact should be anticipated. BUILDING FOUNDATIONS Our analysis of field conditions and test results indicates the use of conventional footings located below maximum frost penetration. Separate areas could be del - neated with different bearing capacities assigned; however, this approach sometimes gets confusing and the lrads are switched in such a manner that excess settlement occurs. Consequen�ly, one bearing capacity will be assigned, thus eliminating any costly design errors. Footings should be designed for a maximum allowable bearing capacity of 2,000 pounds per square foot including live load. Settlement in the order of three-quarters of one inch may be anticipated. FLOOR SLABS AND OTHER SLABS ON GRADE The foundation soils show no tendency to shrink or swell ; however, since little uplift pressure or differential settlement is required to cause unsightly cracks in floor slabs, the following precautionary measures are � . deemed necessary: 1. Compact material underneath floor slabs at or slightly above optimum • moisture content. -3- 1; . 4 4 2. Preclude the entrance of an outside water source underneath slabs. 3. Eliminate underslab plumbing where possible, and where unavoidable thoroughly pressure test and take other precautions necessary to minimize leaks. 4. Separate floor slabs completely from bearing walls, columns and footings. 5. Appropriate provisions should be made in large floor slabs for shrinkage cracks. TREATMENT OF FOUNDATION SOILS Precautions should be taken to assure that the moisture content of the foundation soils is maintained at a relatively constant level . Excava- tions shall not be allowed to remain open long enough to allow appreciable drying below natural moisture content, and the exposed foundation material should be protected from wetting from any outside source. Wetting of foundation soils should be prevented after construction. Methods of accomplishing this include thorough compaction of all backfill around structures, provisions for discharge of roof downspouts and other water collection systems well beyond the limits of all backfill , and any other procedures deemed necessary to maintain a stable moisture content. Exca- vations should be made only large enough to provide necessary working space in order to hold the area requiring backfilling to a minimum. SULFATE RESISTANT CEMENT Analysis indicates a sulfate concentration in excess of 0.10 percent water soluble sulfate (SO4) in the soil samples. Therefore, Type II cement should be used in concrete exposed to this soil . -4- I LIMITATIONS The exploratory data presented in this report were collected to help develop designs and cost estimates for this project and thus, may not represent adequate information for indicating underground conditions for contractor bidding or construction. We recommend considering exploratory work to reveal underground conditions well enough to enable contractors to more accurately evaluate conditions for bidding and execution of work after designs have been prepared. Professional judgements on design alternatives and criteria are presented in this report. The judgements are based upon our evaluation of actual conditions encountered at the location indicated herein, and upon our extrapolations thereof together with our interpretations of conditions generally characteristic of this area. We do not warrant the accuracy of such extrapolations and interpretations beyond the limits of the tests performed or where actual physical conditions oere not observed. Test borings drilled for this investigation were spaced to obtain a reason- ably accurate representation of subsurface conditions for design purposes. Variations from the conditions disclosed which were not indicated by the test explorations frequently occur and quite often these variations are Ksufficient to necessitate modifications in design. Therefore, if different materials are encountered the owner or builder should be certain that the foundation conditions are adequate and within the scope of this report prior to proceeding with any construction. 111 I -5- .4 I a J Under the above conditions, it is important that we inspect the subsurface materials exposed in excavations to take advantage of all opportunities to recognize differing conditions and minimize the risk of having unde- tected conditions which would affect the performance of the facility. BIRD PROPERTY GEOLOGIC HAZARD INVESTIGATION SCOPE This report is the result of our geologic hazard investigation of the titled property in Weld County, Colorado. The purpose of this investigation was to find which, if any, of the geologic hazards named in H.B. 1041 are present at this site and to determine their effects on the proposed development. LOCATION The site under investigation is approximately three miles west of Greeley ii the West Half of the Southwest Quarter (W1/2, SW1/4) of Section 16, Township 5 North, Range 66 West of the Sixth Principal Meridian, Weld County, Colorado. This area is bounded on the west by 71st Avenue and 2,200 feet north of Highway 34 Bypass. S FIELD INVESTIGATION Test borings have been made at this site and soils reports, drill logs and laboratory analysis have been developed for the site separately. TOPOGRAPHY The site is gently rolling prairie at an elevation of approximately 4,880 feet. The general slope is easterly. S S GEOLOGY The surface geology of the area consists of a mantle of light brown eolian silts with fine sand. The soil layer runs to over 15 feet in thickness. The bedrock is sandstone which is believed to be part of the Laramie Formation. The results of the soils testing form a part of this submittal . tGEOLOGIC HAZARDS A geologic hazard is defined in H.B. 1041 as "a geologic phenomenon which is so adverse to past, current and foreseeable construction or land use as to 1 constitute a significant hazard to public health and safety or to property. " t Several of the hazards listed in H.B. 1041 are not applicable to this location because of its gentle topography. A. Seismic Activity - All of Colorado is in Seismic Risk Zone 1 (Minor Damage). There is no evidence or history of seismic activity in this area. B. Ground Subsidence (Hydrocompaction) - Ground surface collapse can occur in wind deposited silts as a result of excessive wetting of dry soils with ia high void ratio. The thin eolian deposits on the surface of this site are not expected to pose any hazard of this nature. Some slight settle- ment will occur as the dead load is applied during construction. C. Expansive Soil - The volumetric expansion of "swelling clays" is usually the result of increasing water content of the clays. If the water content remains uniform, no expansion or shrinkage will occur. The results of the laboratory testing show no tendency for volume change. D. Water Table - This site has a high water table condition. The source of this water is believed to be seepage originating from the Greeley- Loveland Canal and the Boomerang Ditch. The depth of water is identi- fied in the soils report. Groundwater does fluctuate considerably r throughout the year and will create problems during and after construc- tion if provisions for lowering and stabilizing groundwater are not initiated. MINERAL RESOURCES There are no known economic resources located on this site. CONCLUSIONS A. The geology of the site is a relatively thin mantle of wind deposited fine grained alluvial material overlaying weathered sandstone. INB. The only significant geologic hazard is a high water table. As discussed at the luncheon meeting with the two planning commissions , there appears to be at least two alternatives to the proposed Bird Subdivision . They are : 1 . Extend cul de sac to north property line , thereby providing for north-south circulation to adjoining unplatted properties . There would be no significant change in the density or lot configuration of the Bird Subdivision. Under this alternative the 24th Street collector would be routed north , around the wet area , as suggested in the Comprehensive Plan . 2 . Extend the 24th Street Collector directly through the Bird Subdivision or along the north property line . At this time an analysis of cost and design constraints to constructing 24th Street has not been made by the Public Works Department . Since either of the above alternatives would involve modifica- tion of the preliminary plat , I recommend denial of the preliminary plat as submitted. RECORD O1 PROCEFDI,gGS Planning Commission Minutes September 28, 1978 The Planning Commission of the City of Greeley , Colorado was called to order by Chairman John Dietz . Those present were Commissioners Clift, Cummins, Keirnes , Modlin, and Roeth. • I . APPROVAL OF MINUTES Commissioner Cummins made a motion to approve the minutes of the September 12 , 1978 meeting as mailed. Commissioner Keirnes seconded the motion. Vote was taken and the motion carried unanimously. 0I1 REFERRAL FROM WELD COUNTY: PRELIMINARY PLAT OF THE BIRD SUBDIVISION LOCATION: 2420 71st Avenue John Given, Current Planner, explained that this is an area that the Commission has looked at in the past and noted its general location in relation to the Westridge and Peterson Subdivisions . The Commission had previously reviewed a rezoning request on this property and recommended denial to the County. The property was rezoned, however, and the present proposal for development of the subdivision provides for eight lots with a cul de sac having access dii ctly onto 71st Avenue. This cul de sac exceeds subdivision standards which would allow a maximum length of 500 feet. This problem was discussed at the time of rezoning , as well as the fact that other properties in the area are developing along 71st Avenue before City services can be made available. This development does not provide access to property further off of 71st Avenue which is not yet developed. The undeveloped interior parcels are becoming increasingly more restricted as far as circula- tion. John Given suggested that by lengthening the street proposed for the subdivision and adding a north/south street stubbed to adjoining properties the problem of the cul de sac can be eliminated and this will also provide for future additions to the street. Another problem which he pointed out was with the extending of 24th Street (a collector) out to 71st Avenue. Twenty-Fourth Street could be run through the middle of the Bird property. This could be done without reducing the number of lots platted on the property. Another alternative would be to wait until the next property is platted and consider the 24th Street location at that time. Martin Bird told the Commission that the way the subdivision is set up the cul de sac could be opened up for access and explained how this could be done. He also noted that it would be more expensive to run the street over wet land than to take it over higher ground. Commissioner Keirnes - asked who the owners of the property surround- �I ing this parcel were. Mr. Bird pointed out the properties and who owned them. Jay Freese commented that possibly the City and County need to sit down with the property owners in the area and discuss where the streets will be. There is a problem with using the 1j marshy area to the east for this street. Commissioner Roeth questioned whether the Commission should be looking at the alterna- tives as well as the proposal before them. John Given replied that he was pointing out the alternatives as they relate to this particular proposal . Commissioner Keirnes questioned whether the City has a master street plan. Mr. Given replied that there is such -a plan, but it does not define exactly where the street should be. Mr. Bird explained other possible alternatives for streets in the area. Commissioner Cummins suggested deferring action on this preliminary plat until a determination can be made between the City and County on where 24th Street should be located. It is a rectangular parcel running along 37th Street and is proposed for rezoning to allow for residential development. This item was reviewed in A.R.T. and other than comments regarding street I dedications and regulations for subdivisions , staff had no objections. Commissioner Clift questioned whether there is an irrigation ditch on this piece of property. Max Karner, City Engineer, explained that the irrigation ditch that Commissioner ! Clift was referring to is one mile east of this site. Commissioner I Roeth made a motion to recommend no objections to the proposed rezoning. Commissioner Keirnes seconded the motion. REFERRAL FROM WELD COUNTY: REZONING AGRICULTURAL TO COMMERCIAL LOCATION: U.S. 85 and Weld County Road 64 (Mumper Hill Road) Mr. Given told the Commission that this property is located along the west right-of-way of U.S. 85 north of County Road 64. He also noted that 11th Avenue is an arterial and U.S. 85 is an expressway. ) I . The lot is 89 X 1490 feet with primary exposure to U.S. 85. The existing use is non-conforming since it has been used for sale of agricultural equipment. The distance between 11th Avenue and U.-S. 85 is equivalent to a city block. The frontage onto County Road 64 is 89 feet, and there is an existing driveway on the t property. The proposed zoning would allow development which will lead to increased congestion at the driveway which is at the !! intersection of County Road 64 and U.S. 85. Commissioner Keirnes questioned whether he should abstain from conversation on this item since-he had previously discussed with 4 Mr. Dean the value of this property. Assistant City Attorney Ron Lambden said that a conflict occurs if there arc financial or contractual interests. Mr. Keirnes said he had none. Mr. Melvin Dinner, attorney representing the property owners , 4 told the Commission that this property was bought by Mr. Hammonds many years ago and during his ownership was used for sale of agricultural equipment. Since his death, the family has discon- tinued this use, but the non-conforming status has been with the land for over 24 years. There is a building presently on the site which is used for storage, display, and sales of these agricultural type goods . After Mr. Hammonds use was discontinued, Law Equipment leased the property for similar uses until just recently. Soils Suitability: The subdivision area is made up of two soil types. These are Otero sandy loam, 1 to 3 percent slopes, and Otero sandy loam, 3 to 5 percent slopes. Both soils are considered prime agricultural land when under irrigation. Recommendations made by C-E Maguire, Inc. , in the sub-soil investigation report should be followed. 2. Adequacy of Planned Drainage Systems: A. Subsurface : Due to the presence of ground water, it is doubtful the proposed septic systems will he adequate due to the possibility of inundation and contami- nation of the ground water. A complete subsurface drainage plan should be consi- dered and evaluated for feasibility of lowering the ground water table. Each individual dwelling peripheral drain, as recommended by C-E Maguire, Inc. , could then be connected. Both Mr. Bird and C-E Maguire elude to the use of "French Drains" to eliminate ground water. It has been our experience with subsurface drainage that a definite unobstructed conduit is needed to carry and discharge ground water. The "French Drain" will not provide the necessary conduit and does not function adequately with increased water flows as may be found during wet years. B. Surface Drainage: Mr. Bird states in the "Summary of Bird Subdivision" that a natural drainage ditch comes into the southwest corner of the property. If we are not mistaken, this is the surface drainage from the west adjacent land. Mr. Bird proposes to take this underground and dischage it into the ground water. With the already present subsurface water, it would be better to establish a sur- face drainage channel properly graded and vegetated to carry the storm surface flows. This will get the surface water over the area faster, safer, and will not aggravate the present ground water problem. The surface channel could be incorpo- rated into the overall surface drainage design for the subdivision. It is our recommendation that a surface drainage plan be prepared for the subdivision to determine the point of discharge from the property. Since the surface drainage does enter a natural stream channel to the east of the property, it may be neces- sary to construct a sediment detention structure during the subdivision construc- tion phase. With the current laws, PL-92-500, Sec. 404, regarding point source discharge, it may be necessary to file for a discharge permit. Until a surface drainage plan is prepared, this determination can not be made. J a Page 2 - Bird Subdivision Review 3. Flooding Potential: The subdivision is not located in a flood prone area and will not create a flood hazard, provided that an adequate surface drainage plan is instituted along with proper grading and landscaping. 4. Vegetative Protection and Erosion Control Plan: It is our recommendation that a vegetative and erosion control plan be submitted with the final plan to show what measures will be used to lessen the potential for wind and water erosion during the construction phase. It should also state what conditions will be expected once construction is completed to maintain soil loss at minimum levels. The turn between Lots 4 and 8 may not be treated as an intersection. As per Section 8-2 C(1) of the Weld County Regulations, the street must be designed with a 100 foot minimum center-line radius. This requirement is based on a number of safe engineering practices: a.) Sight hazards posed by landscaping or structures. b.) Hazardous negotiations of sharp curves caused by rain, snow, or ice. c.) Stopping sight distance hazards due to improper headlight illumination of the roadway at night. Studies have shown that most drivers do not adequately adjust their speed for such hazards. It is therefore, the County's responsibility and the developer's duty to protect these drivers from their own unsafe practices whenever possible. 2. Drainage retention facilities should be incoiyorated at the northeast corner of the subdivision. The retention area should be designed to retain the volume difference between the 100-year event in the developed condition and the 5-year storm in the undeveloped condition. The release rate should not exutd the runoff rate of the 5-year storm. 3. The "French Drain" arrangement along the south property line should not be allowed to remain in the County right-of-way. This proposal would only build in maintenance problems, which the County should not be held responsible for. Please refer to the attached rough sketch of the proposed development area and the surrounding land. It makes sense to run the road straight through from West Ridge to 71st Avenue. This would give access to land on the north as well as the Bird land. The road would also be easier to build, especially through the low land in the pasture area. The access onto 71st Avenue would be much safer. Continuing the road on west from this point would be better for future development of the land on the west side of 71st Avenue. The road as proposed will come within ten feet of our home. This creates a lot of problems for us, like noise and safety. I believe this to be an invasion of our privacy and will disturb our peace. The access onto 71st Avenue will be dangerous because of the hill to the north. Our lane is about two hundred feet farther south and we find the approaching traffic from the north very hazardous. I would appreciate you considering these ideas, for I believe the positioning of a road from West Ridge to 71st Avenue is very important in the future development of this whole area.
