This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. (State Highway 392) REQUIREMENTS: Site Plan: Public Works is using the Drexel, Barrel plat. The other two are detail sheets. Access Permit Application Form: Provide a copy of your CDOT Access Permit. Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code. Traffic Impact Study: The study was prepared by Drexel, Barrel, and Associates: a single access point on the north side of State Highway392, located about 1300 feet west of CR 43. Colorado Crude Carriers will generate about 465 trips per day on an average weekday by 2015. Based on the projected volumes and aR-B category, it is recommended that an eastbound left-turn deceleration lane be added at the site access point on State Highway 392. Grading Permit: If more than one acre is to be disturbed, a Weld County Grading Permit will be required prior to the start of construction. A vehicle tracking control pad will be installed and maintained through the life of the site to prevent tracking of debris onto the state highway. Flood Hazard Development Standards: A portion of the RE-3779 property lies in a Special Flood Hazard Area (SFHA) defined by the Federal Emergency Management Agency (FEMA). This SFHA is delineated on the current effective Flood Insurance Rating Map (FIRM), panel number #080266-0627C, dated Sept. 28, 1982. Portions of lots located in the current effective FEMA 100-yr floodplain may not be buildable. WARNING: LOT MAY NOT BE BUILDABLE DUE TO FLOODPLAIN OR FLOODWAY DESIGNATION. Please be advised that owners of Lot B may not be able to obtain building permits to construct structures. All construction or improvements occurring in the floodplain as delineated on Federal Emergency Management Agency FIRM Community Panel Map #080266-0627C dated September 28, 1982, shall comply with all applicable FEMA and CWCB floodplain regulations and requirements. 2. Flood hazard development permits will be required for development activities located within the FEMA mapped floodplain. The FEMA definition of development is any man-made change to improved or unimproved real estate, including by not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials. 3. FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of any development activities, the owner should contact Weld County to determine if the floodplain boundaries have been modified. Traffic Narrative: Colorado Crude Carriers has 38 full-time employees, of which 25-30 are working off site. Fisher Landscaping has 2-3 employees on site and another 15-20 employees on site for short periods of time during working hours. Vehicles accessing this site will be cars, pickups and Class B Crude oil trucks and trailers. On average, 10-15 trucks/trailers will access this site during a 24-hour period. Drainage Report: Comment: The applicant is showing a water quality control feature. Development Standard: The historical flow patterns and run-off amounts will be maintained on site. There is an existing shop/office building for the landscape company on the property. The proposal includes a new shop/office building for the crude oil business. The landscape company will have 2-3 full time employees and 15-20 other employees accessing the site for short periods. The crude oil business will have 15-20 onsite employees and 20 plus drivers. The facility is currently served by North Weld County Water District. The applicant provided documentation from the District that they are able to serve the crude oil trucking company. There is an existing septic system that serves the landscape company facility, Permit SP-0500412, is permitted for 4 employees. Since there will be an increase in number of employees using the system, the existing septic system must be evaluated by professional engineer to determine if adequate. If the existing system is found to be inadequate, then a repair permit will be required to upgrade the existing septic system. The applicant is proposing to install an engineer-designed septic system for the proposed shop/office building for the crude oil business. The commercial septic permit will require Weld County Board of Health approval. Both the existing and the proposed septic systems shall be designated on the plat and protected from vehicle traffic. The waste handling plan stipulates that Waste Management or Ram Waste will provide refuse service. Any used vehicle fluids and parts cleaning solvent from maintenance and repairs will be removed by Safety Kleen. The proposed maintenance shop building for the crude oil business will have floor drains that will discharge to a watertight vault. The vault will be serviced also by Safety Kleen. The crude oil business will not wash vehicles at the site. Tire service will be provided by TCI Tire Service of Loveland or TDS of Greeley. The dust abatement plan stipulates that during construction, water will be utilized to control dust. After construction is completed, the site will be stabilized with native grasses. The graveled access drives, parking and circulation areas will be maintained, speeds will be controlled and water will be utilized to control onsite dust. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The existing septic system for the landscape company facility, Permit SP- 0500412, shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems' ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 2. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for the existing septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. 3. Plot the existing septic system and proposed septic system on the plat. The septic systems must be protected from vehicle traffic. 4. A copy of the Commercial Pesticide Applicators license, from the Colorado Department of Agriculture, shall be provided to Environmental Health Services, Weld County Department of Public Health & Environment. 5. Designate the vault for the vehicle maintenance shop floor drains on the plat. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of building permit: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 2 2. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. 3. The installation of the septic system shall comply with the Weld County I.S.D.S. flood plain regulations. No septic system shall be installed within the floodway. Please contact Weld County Public Works to verify flood plain vs. floodway. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the approved "waste handling plan", at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall operate in accordance with the approved "dust abatement plan", at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 7. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 8. Any additional hydraulic load to an existing septic system will require an Evaluation from a Colorado Registered Professional Engineer. The engineer's evaluation shall be submitted to the Weld County Environmental Health 3 Department. In the event the system is found to be inadequate, the system must be brought into compliance with current Weld County Individual Sewage Disposal Regulations. 9. The facility shall utilize the existing public water supply (North Weld County Water District). 10.AII pesticides, fertilizer, and other potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 11.The applicant shall comply with all provision of the Pesticide Applicators' Act issued by the Colorado Department of Agriculture, Division of Plant Industry. 12.Vehicle maintenance shop floor drain wastes shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 13.In the event vehicles will be washed on site, the vehicle washing area(s) shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 14.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 15.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 4 \ 1861 Department of Planning Services jl 1555 N 17`"Ave Greeley, CO 80631 c o U N T Y (970) 353-6100 Weld County Referral Date: December 28, 2013 Applicant: RODNEY & KAREN STEELY Project: A Site Specific Development Plan and Amended Use by Special Review Permit to USR-1526 (Storage of landscaping materials and equipment along with employee parking associated with a landscaping business)to include Mineral Resource Development Facilities including Oil and Gas Support and Service Facilities (truck parking, maintenance, repair and office associated with a crude oil transportation company) along with amending the boundaries of USR-1526 to encompass the entire area of Lot B of RE-3779 in the A(Agricultural)Zone District. Case Number: USR13-0060 Parcel Number: 080316400002-R3130504 After reviewing the application and documents submitted the Building Department has the following comments: Building and electrical permits will be required for any new construction, alteration, or addition to any building on the property per Section 29-3-10 of the Weld County Code It is required that a code analysis be done on the project by a design professional with experience in this area. A building permit application must be completed and two complete sets of engineered plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County : 2012 International Building Code; 2012 International Mechanical Code; 2012 International Plumbing Code: 2006 International Energy Code; 2012 International Fuel Gas Code; 2011 National Electrical Code; 2003 ANSI 117.1 Accessibility Code and Chapter 29 of the Weld County Code. A plan review shall be approved and a permit must be issued prior to the start of construction. A new access permit will be necessary. 2. The access will require the construction of an eastbound to northbound left turn lane per the traffic impact study. 3. Projected ROW need in this area is 75' feet either side of the highway centerline. I'm guessing that we obtained the appropriate ROW when we did the original Fisher permits.
