Anadarko/Kerr-McGee operates over 5,000 oil and gas wells in the Denver-Julesburg (DJ) Basin with the vast majority being located in Weld County, Colorado. KMG is continually looking ways to eliminate emissions and the footprint size associated with their oil and gas operations. The COSF will eliminate the need for atmospheric oil tanks at a tank battery thus eliminating the amount of VOC's released. The scope of COSF process is to separate the very light hydrocarbon gases from the heavier hydrocarbon components. Since most hydrocarbons are more valuable as a liquid, the goal of stabi"ization is to maximize the absolute volume of liquid that can be stored and transported under the sales specification. The oil is pre-heated by the Feed/Bottom Heat Exchanger and injected into the Stabilizer Tower. As heat is added to the bottom of the stabilizer tower, vapors are generated on the bottom tray. The hot vapors rise to the tray above, where they bubble through the liquid. The liquid is heated by the hot vapors, which vaporize some of the hydrocarbon liquid. The vapors, in turn, are cooled by the liquid, and a portion of the vapor is condensed. This process of vaporization and condensation is repeated on each tray in the stabilizer tower. As the liquids fall down the stabilizer tower, some of the liquids are cycled to a Reboiler where they receive heat. The hot, stable oi.l from Reboiler is routed via the Side Reboiler and the Feed/Bottom Exchanger to the Oil Storage Tanks. The purpose of the Side Reboiler and Feed/Bottom Exchanger is to transfer the heat efficiently from hot oil to cold oil. The column with Reflux recovers more intermediate components from the vapor. Overhead vapor from the Stabilizer Tower is sent to the Partial Reflux Condenser to be cooled and separated as two phases in the Reflux Accumulator. The overhead vapor from the Reflux Accumulator is very rich and can easily be condensed if the pressure is increased. It is compressed by Flash Gas Compressor and condensed Natural Gas Liquids are drawn into the NGL tank. This application addresses the development of the COSF for the demands that are associated with the increase in oil and gas production in the Wattenberg field. The proposed site is approximately 80 acres in area. The proposed site is located on a portion of the S/2 of Section 24, Township 3 North, Range 65 West. The site is currently zoned Agricultural and is surrounded by Agricultural zoned properties. The development of this site contributes to the expansion of the county's industrial economic base by providing increased capacity to an essential function in the production of natural gas in the County. The proposed facilities on site will operate 24 hours a day, 7 days a week, 360 -365 days a year. Consistency with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan Section 22-2-10 (D) emphasizes the extraction of natural resources as an important part of the economy of the County. The development of this site contributes to the expansion of the county's industrial economic base by providing increased capacity to an essential function in the production of natural gas in the County. The Weld County Comprehensive plan addresses goals and policies for agriculturally zoned properties and oil and gas deposits. The Comprehensive Plan also addresses the presence of oil and gas deposits in the County and encourages the extraction of oil and gas resources that conserve the land and minimize the impact on surrounding land and the existing surrounding land uses. The proposed facility will deal with the improved tank battery designs to be implemented in 2014. 3. Consistency with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. Oil and gas facilities are allowed as a use by right in the A (Agricultural) Zone District. However, oil and gas support service operations such as this proposed COSF require the approval of a Use by Special Review Permit (Section 23-3-40(A)) 4. Surrounding uses and compatibility with surrounding uses. The COSF is surrounded primarily by agricultural lands. Consideration has been taken to ensure that the COSF will operate in a manner that is compatible with existing and planned uses in the area. The process of increasing the amount of intet mediate and heavy hydrocarbon components in the oil for oil stabilization in Weld County is a necessary component of the production of this valuable resource. Providing the required treatment will not only foster the development of an important economic base but will also contribute to the convenience and general welfare of the residents of the County. The site contributes of the County's tax base with little or no adverse impact in terms of additional roads or other governmental expenditures. 5. Describe the followinz: a. Number of people who will use this site There will be two full time employees assigned to the facility. These employees will be on site 24 hours per day, 7 days a week, 365 days a year. Additional personnel may be present through the week for pick-up and delivery of commodities and additional maintenance. b. Number of employees proposed to be employed at this site There will be two full time employees on site. During construction additional personnel will be on site until completion. a Hours of operation The site will run 24 hours a day, 7 days a week, 365 days a year. d. Type and number of structures to be built on this site As depicted in the plans, the site will include a main pump/electrical building with office space, a compressor building, an electrical motor control center building, a natural gas fired turbine generator, five stabilizer skids with stabilizer towers, six flash gas compressors, pressurizes inlet and discharge bullet tanks, two 250,000 barrel API 650 oil storage tanks, two 1,000 barrel produced water tanks and one flare. e. Type and number of animals, if any, to be on this site There are no animals on site. f. Kind of vehicles that will access the site and how often There will be approximately 10-15 typical operator F-250 style trucks accessing the site daily. There will also be occasional preventative maintenance F-450 style tucks accessing the site. In addition, produced water trucks, capable of 180 bbls of water will access the site approximately two times per day. g. Who will provide fire protection to the site The LaSalle Fire Protection District provides fire protection to this area. A referral packet will be sent to the District by the County. Once an approval letter is received it will be placed in the Appendix. h. Water source on the property KMG intends to apply for a commercial well permit in order to drill a water well which will service this site. A letter from the Central Weld County Water District stating that the district is capable of providing water is provided in the index. L Sewage disposal system KMG intends to apply for a septic permit through Weld County in order to install a leach field for sewage disposal. j. Storage or warehousing There will be no storage onsite. 6. Proposed Landscaping There is no existing screening and no additional landscaping is being proposed with this application. KMG plans to install Eft. chain link fencing around the perimeter of the facility. 7. Reclamation Procedures Should the site no longer be needed by Anadarko, all equipment will be removed and the ground re- graded to accommodate agricultural uses. 8. Storm Water Drainage There is no drainage report required with this application, however a drainage narrative has been provided in the appendix. 9. Construction Period Construction of the site is anticipated to commence soon upon approval of this requested USR. Construction is estimated at 8 to 12 months, 6 days per week. 10. Waste Handling Plan KMG has a Waste Handling Plan (Plan) that covers all operations. This plan is used to determine how to best manage waste generated as part of our operations. The objective of the Waste Handling Plan is to ensure waste generated at the Facility is managed in accordance with all Local, State and Federal regulations. Additionally, the Plan identifies operational chemicals used or stored on site regarding specific disposal pathways. Kerr-McGee/Anadarko personnel are trained annually with regards to proper Waste Management practices. The facility will be serviced by Waste Management for solid waste removal. A small dumpster will be located onsite. All liquids will be managed and disposed or re-cycled. The municipal waste dumpster will be managed and disposed of by a contract waste management company. The dumpster will be emptied either weekly or every two weeks. Non-routine waste (e.g. spills or releases) will be managed in accordance with Anadarko's Emergency Response and Oil Spill Contingency Plan. Spills, as appropriate, will be reported to the proper regulatory agency(s). Additionally, a site specific Spill Prevention Control and Countermeasure (SPCC) Plan will be developed to outline appropriate actions to be taken in the event of a spill or release. The SPCC Plan in conjunction with the Emergency Response/Oil Spill Contingency Plan will ensure that all appropriate response actions are taken and that all waste will be handled in accordance with applicable rules and regulations. Both documents are written in accordance with requirements set forth by the Environmental Protection Agency. Regarding a motor vehicle oil leak (potentially during construction), Anadarko's standard operating procedure is to excavate the impacted soil and haul it to the Buffalo Ridge Facility in Keenesburg, CO or other similar facility. Once the impacts are removed, Anadarko will back fill the excavation with clean fill. 11. Dust Abatement Plan During the construction phase of the project, Anadarko will utilize water trucks to maintain dust suppression if necessary. Also, the Storm Water Management Plan will be followed to mitigate soil erosion during the construction phase. After construction is completed the site will be stabilized using native vegetation in allowed areas, which will not be allowed to grow over 12" high. Additionally, Anadarko will gravel the access drive and circulation pattern. In addition, a water truck will be utilized to control dust after construction, if necessary. Operational Standards NOISE CONTROL: The operation of the Central Oil Stabilization Facility shall comply with the noise standards enumerated in Section 802 of the COGCC Amended Rules 2008. Noise will be emitted from the site. It is anticipated that the proposed equipment will actually have minimal noise emissions. Additionally, the rural nature of these sites is preferred to mitigate the effects of noise emissions on the surrounding property owners. AIR AND WATER QUALITY: All activities will be in compliance with the permit and control provisions of the Colorado Air Quality Control Program, Title 25, Article 7, C.R.S. as applicable. In addition, KMG has applied for an air quality construction permit from the CDPHE (permit #13 WE223 6). LIGHTING: Lighting on the site will be downcast. Shielded lighting will be provided on the proposed building. Lighting is for nighttime and emergency work only. The lights will be on a timer, photo eyes and motion detection. Any source of lighting on the site shall be shielded so that light will not shine directly onto adjacent properties where such would cause a nuisance or interfere with the use on the adjacent properties. In addition, neither direct nor reflected light from any source on site will create a traffic hazard to operators of motor vehicles on the adjacent access road. Lighting detail can be found on the attached exhibit. WEED CONTROL: The Central Oil Stabilization Facility will be kept free of weeds, rubbish and other material. The area shall be treated if necessary and as practicable to prevent invasion of undesirable species and noxious weeds. Required Permits Weld County: A Use by Special Review Permit is required to be approved by the Board of County Commissioners prior to construction of this facility. Ken McGee/Anadarko will submit any additional permits necessary for county approval prior to the commencement of construction on site. La Salle Fire Protection District: The Site Plan and Special Review Use Application will be referred to and reviewed by the La Salle Fire Protection District. Approval of the plan is expected. A letter from the fire district regarding this proposal will be added to the Appendix once it is received. Oversize Load Permits: If necessary, oversize load permits will be obtained prior to moving any new equipment onto the site. Access Permits: Access Permits and traffic plans will be submitted as part of this application. The submitted access application is in the Appendix. Traffic Access to the facility will be from WCR 30, north on the existing lease road. Operators driving F-250 trucks will access the site approximately 8 trips daily. Produced water trucks capable of holding 130 to 180 bbls will access the site approximately twice per day. Fire & Emergency Response There is adequate provision for the protection of the health, safety and welfare of the inhabitants of the immediate area and the county. Fire Suppression will be added to the qty (2) 250,000 bbl tanks in using a foam dam near the seals. Foam and water will flood the seal areas in case of a fire. All roads leading to and those in the site area will be designed and maintained to support fire apparatus. A turnaround will be constructed as necessary to accommodate fire apparatus. In addition to the above- referenced rules and regulations, Anadarko is also subject to COGCC Rule 6064 pertaining to Fire Prevention and Protection. Anadarko has support personnel in the field or on call at all times to provide technical assistance in fire prevention and elimination. Additionally, fire sensors will be installed at strategic locations within the facility. If such an event happens, fail safe features will activate; such as ESD (Emergency Shut Down) valves will automatically close, and alarms sent to the Anadarko Integrated Operations Center (IOC) located in Evans, CO. Gurtler Trust and Russell L Gurtler Jr. Family Trust ("Surface Owner"), whose address is 7538 CR 49, Hudson, CO 80642. RECITALS A. Surface Owner is the current owner of part of the SESW of Section 24, Township 3 North, Range 65 West, 6'h P.M., Weld County, Colorado (the "Property"). B. KMG is the lessee of the North Half of the Southeast Quarter (N1/2SE1/4) of Section 24, Township 3 North, Range 65 West, 5ti' P.M. , Weld County, Colorado (the "Stabilizer Facility") pursuant to a certain Lease Agreement between the parties dated January 9, 2014 (the "Lease"). C. KMG desires an easement across the Property for access to the Stabilizer Facility. NOW, THEREFORE, in consideration of the sum of Ten Dollars ($10.00) and other good and valuable consideration, the receipt of which is hereby acknowledged , KMG and Surface Owner agree as follows: 1 . Easement. for Road Purposes. Surface Owner hereby grants and conveys to KMG its successors and assigns, a nonexclusive easement and right-of-way forty feet (40') during construction to be reduced to twenty four feet (24') post construction in width over and across the Property at the location depicted on Exhibit A (the "Road") for the purpose of ingress and egress to and from the Stabilizer Facility, Access may be changed by mutual agreement of Surface Owner and KMG; provided however, all costs and expenses of such relocations shall be borne by the party that requests them. Neither party shall unreasonably interfere with the use of the Road by the other. 2. Payment, KMG will pay Surface Owner Five Hundred dollars ($500.00) per annum for use of the road, payable on or before the Effective Date of this Agreement, and on or before each anniversary of the Effective Date of this Agreement. In addition, KMG shall compensate Surface Owner for re-seeding the 16' construction portion of the roadway post construction. Payment will be made based on the current price of the crop on the Chicago Mercantile Exchange. Re-seeding will be done at the sole direction of Surface Owner. 3.. Improvement of Easement. KMG, at its sole cost and expense, may make such improvements to the Road as it considers appropriate and shall be solely responsible for maintaining the Road to its satisfaction at its sole cost and expense. 4. Use of Road. In the interests of safety and dust control, KMG and its contractors, agents and employees shall not travel on the Road at a rate in excess of twenty miles per hour (20 MPH), and shall yield to any livestock on or crossing the Road. 5. Indemnification. Any use of the Road by KMG, its contractors, agents and employees, is at the sole risk of KMG. KMG shall indemnify, defend and hold Surface Owner harmless from and against any and all damages, claims, actions, losses, liabilities, costs and expenses (including, without limitation, reasonable attorney fees and expenses and costs of investigation or trial) resulting from the use of the Road by KMG and its contractors, agents and employees. 6, Limited Warranty. THIS AGREEMENT IS MADE WITHOUT WARRANTY OF TITLE EXCEPT A WARRANTY BY, THROUGH AND UNDER SURFACE OWNER, BUT NOT OTHERWISE. THIS AGREEMENT IS MADE WITHOUT ANY OTHER REPRESENTATION OR WARRANTY OF ANY TYPE WHATSOEVER, EITHER EXPRESS, STATUTORY OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTY OF FITNESS FOR ANY PURPOSE, CONDITIONS OR MERCHANTABILITY. 7. Termination. The easement and right-of-way granted hereby shall terminate in the event of and upon the termination of the Lease. 8. Entire Agreement. This Agreement sets forth the entire understanding among the parties hereto regarding the matters addressed herein, and supercedes any previous communications, representations or agreement , whether oral or written. This Agreement shall not be amended, except by written document signed by both parties hereto. 9. Recording, A Memorandum of this Agreement may be recorded by KMG in the records of Weld County, Colorado. 10. Execution. This Agreement may be executed in any number of counterparts each of which shall be deemed an original instrument but all of which together shall constitute one and the same instrument, and shall be binding upon and inure to the benefit of the parties, and each of their respective heirs, executors, administrators, successors and assigns and is executed by the parties as of the Effective Date set forth above. The basis of the change is to reduce our footprint, eliminate Vapor Recovery Units (VRUs), which reduces noise, and replace all oil storage tanks with 1-2 pressure vessels. The oil tank elimination reduces footprint and emissions significantly. As a result of these next generation tank batteries, the oil will contain additional entrained gasses and Natural Gas Liquids (NGLs). These gasses and NGL must be removed from the oil prior to entering existing pipelines and rail offloading infrastructure, hence, the necessity of the Central Oil Stabilisation Facility (COSF). The Use by Special Review permit for this application is currently in process and is expected to be submitted to the County within the month. The COSF will take approximately 1 year to build, from green field to full operations. A main feature of the COSF will be the qty (2) 250,000 barrel tanks (-50'-0" tall x x190'-0" diameter). These API 650 tanks are "weld in place" and will require 11 months to construct, once the tank builder (Advanced Tank) mobilizes. The tank locations and containment features are part of a standard designs and comply with Weld County regulations, as well as other industrial and national standards/requirements. The CDPHE air permit has been approved and allows Anadarko Petroleum Corporation to construct the site. The Land Lease with property owner Gurtler has been completed. A "Notice of Access" to Weld County will be in place prior to tank builder mobilization around the first week of March 2014. Anadarko Petroleum Corporation requests permission for Weld County to build these tanks prior to the USR approval, as "build at risk".
