SUBJECT: USR13-0054, Tri-State Generation and Transmission
Association Inc. (115 kV Transmission Extending 24.7
Miles) Keota Substation to the Redtail Substation
The Weld County Public Works Department reviewed the submitted application for critical items,
including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils
Report, and Flood Hazard Development Permit. Comments made during this stage of the review
process will not be all inclusive; as revised materials are submitted other concerns or issues may arise.
All issues of concern and critical issues during further review must be resolved with the Public Works
Department.
COMMENTS:
Tri-State Generation is planning to construct, own, and operate a 24.7 mile, new 115 kV overhead
transmission line from Keota to the Redtail Substation and (1) 250-foot communication tower located at
the Keota Substation.
REQUIREMENTS:
Permits:
Contact the Permitting/Inspection agent for Weld County Public Works, at (970) 304-6496, ext. 3764 for
a Right-of-Way permit for any work that may be required in the right-of-way. A special transport permit
will be required for any oversized or overweight vehicles that may access the site and may also be
obtained through the same office.
Access, County Roadway Crossing:
County Roads 89, 97, 103, 107, 119, 110, and 118 are all local gravel roads and require a 60-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. The roads are maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required
setback is measured from the future right-of-way line.
CR 390 is a collector road, which requires an 80-foot right-of-way at full build out. There is presently a
60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK
in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way
line.
Access roads would be created off CR 89 and CR 118 for the Keota and Redtail substations
respectively. Tri-State has submitted Access Road Permit Applications (AP13-00358 & AP13-00372)
and will comply with all County design standards. Both applications are pending.

Since more than one acre is to be disturbed (Keota/Redtail), a Weld County Grading Permit will be
required prior to the start of construction.
A vehicle tracking pad will be required at all crossings to keep from tracking mud or debris on to Weld
County roads, at both substation locations.
There shall be no parking or staging on Weld County Roads. Utilize your private easements or rights-
of-way.
The contractor will utilize the Keota/Redtail sites for its base of operations with no new proposed
staging or lay-down yards. A 100' private right-of-way will be used for the transmission line.
Noxious Weeds:
Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant
to Section 15-1-180 of the Weld County Code.
Traffic:
During construction of the project, vehicles will access the private right-of-way from Keota/Redtail
facilities, or via County Roads that are adjacent to the right-of-way. Once the transmission line is
operational, additional traffic will be limited to occasional vehicle use for regular inspection and
maintenance. The applicant anticipates that approximately 30 construction personnel will be required to
construct the project. Periodically, a standard size pickup truck will drive the transmission line route.
Stormwater Drainage:
At both substation locations, the historical flow patterns and run-off amounts will be maintained on site.
Flood Hazard Development Standards:
The 115 kV transmission line extending approximately 24.7 miles with 2 substations is not in a Special
Flood Hazard Area (SFHA) as determined by the FEMA Agency. The preferred alternative
transmission line route would cross three named drainages: Wild Horse Creek, Igo Creek, and North
Pawnee Creek. The drainage would most likely be spanned.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Special Review Permit for a major facility of a public utility (two
115 KV transmission lines extending approximately 24.7 miles) and two (2) substations
- Keota at the west terminal and Redtail at the east terminal) and one (1) 250 foot
communication tower located at the Keota substation in the A (Agricultural) zone district.
Permanent water and sewer is not required as this is a temporary construction use.
Portable toilets, hand washing units and bottled water can be utilized during
construction of the pipeline.
Dust and air pollutants would be minimized through implementation of dust suppression
and proper vehicle maintenance. Possible construction-related dust disturbance shall be
controlled by the periodic application of water to all disturbed areas along the right-of-
way and access roads. An Air Pollution Emission Notice (APEN) may be required if the
amount of disturbed area exceeds 25 acres.
All construction materials, waste, and debris will be removed from the project area in a
timely manner. Waste will be kept in dumpsters and taken to a permitted waste
disposal facility.
We have no objections to the proposal; however, we recommend that the following
conditions be part of any approval:
We recommend that the following requirement be incorporated into the permit as a
condition that must be met one month prior to construction activities:
The applicant shall submit evidence of an Air Pollution Emission Notice (APEN)
application from the Air Pollution Control Division, Colorado Department of
Health and Environment. Alternately, the applicant can provide evidence from
the APCD that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and
other potential nuisance conditions. The facility shall operate in accordance
with the approved "waste handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled along the
construction route. The facility shall operate in accordance with the approved
"dust abatement plan", at all times.
5. Adequate toilet facilities (portable toilets) and handwashing units shall be
provided during construction of the project.
6. Environmental Protection Measures for Construction Projects, as identified in
Appendix B of the application, shall be adhered to.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code.
8. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.
