RESOLUTION NO. 2014-10
SETTING A HEARING DATE FOR
DONALDSON INVESTMENTS, LLC
PETITION FOR ANNEXATION
WHEREAS, Donaldson Investments, LLC. has submitted a Petition for Annexation; and
WHEREAS, the Town Board of the Town of Eaton has reviewed the Petition for
Annexation, and, finding substantial compliance as set forth below, believes it to be in the best
interest of the Town to set a public hearing.
NOW,THEREFORE,BE IT RESOLVED BY THE TOWN BOARD OF TRUSTEES
OF THE TOWN OF EATON, COLORADO,THAT:
Section 1. The Town Board of the Town of Eaton finds that a Petition for Annexation of
certain property described on Exhibit A, which is attached hereto and incorporated herein by this
reference, filed with the Town Clerk on June 25,2014,to be known as the"Eaton Vista Acres No.
1 & No. 2," is in substantial compliance with §31-12-107(1), and that a public hearing should be
held to determine if the proposed annexation complies with §§31-12-104 and 31-12-105, C.R.S.,
or such parts thereof as may be required to establish eligibility pursuant to §31-12-101, et seq.;
Section 2. The Town Board hereby sets a public hearing for such purposes for September
18, 2014, at 7:00 p.m., at 223 15` Street, Eaton, Colorado, and directs the Town Clerk to publish
and provide notice as required by law.
Section 2. This Resolution shall be effective on July 24, 2014.
PASSED,ADOPTED,AND APPROVED at a regular meeting of the Town Board of the
Town of Eaton on this 17th day of July, 2014.

NOTICE
NOTICE IS HEREBY GIVEN that a Petition for Annexation has been presented
to the Town Board of the Town of Eaton, Colorado, and found to be in substantial
compliance with the applicable provisions of law, has adopted a Resolution to set a
public hearing to be held on September 18, 2014, at 7:00 p.m., at 223 First Street,
Eaton, Colorado, to determine if the proposed annexation complies with the
applicable requirements of law and is considered eligible for annexation.

Statement of Community Need
Eaton Vista Acres Annexations #1 & #2
It is intended that the property being annexed eventually be developed in accordance with the land uses
and densities called out in the Eaton Comprehensive Plan. Until such time that development
entitlement is sought and eventually approved for the area of these annexations,it is intended that the
property be used for agricultural uses. It is the intent to zone the property agricultural upon annexation,
and at such time that the owner wishes to seek development entitlement,the first step will be rezoning
of those areas of the site specific to the development application. It is intended that the rezoning and
development application happen incrementally, in phases,over time.

IMPACT REPORT
EATON VISTA ACRES ANNEXATION
The proposed Eaton Vista Acres Annexation contains 161 acres and is planned to have 316
living units ranging from urban estate lots to multifamily units (condos). The development will
also provide over 18 acres of open space.
The property is bounded by WCR 39 on the west and the adjoining portion of that road is
included in the annexation.
This report is provided as per state statute and contains information on the impact of the
proposed development as it relates to the current infrastructure of the Town of Eaton.
WATER
The Town owns water rights that are treated and delivered by the North Weld County Water
District through a master meter. Our contract includes a maximum flow of 1,389 gallons per
minute and 2 million gallons of water per day, or a total of 730 million gallons per year. In 2012
the Town purchased 264 million gallons and in 2013 the amount was 236 million gallons or
about 36%of capacity. Our peak daily usage is at 1,845,000 gallons which is 95%of capacity.
This requires working with North Weld on ways to increase the maximum flow beyond the
1,389 gallons per minute which will mean a cost sharing effort with them to build a larger line
along WCR 72 from the Severance area to our west tank site on WCR 33.
As with all annexations, raw water rights will have to be dedicated to the Town in sufficient
quantities to serve this new area. Parks and open space can be irrigated with well or ditch
water and developers are encouraged to install dual systems to reduce the amount of treated
water needed.
SEWER
The Town built a new sewage treatment plant which was brought on line in 2006. This new
plant has a capacity of 750,000 gallons per day and is currently operating at 40%of capacity
with a peak flow of 47%. The plant serves about 2,000 taps at the present time and could
handle the planned 316 additional taps when Eaton Vista is built out. The developer is
proposing several of the larger lots be served by septic systems rather than connecting to the
Town's system.
STORM DRAINAGE
By ordinance the developer will be required to submit a drainage plan which will include the
location and size of storm sewer lines and detention ponds. Once these improvements are
completed and approved, they become the responsibility of the Town to maintain.
STREETS
The Town currently maintains over 26 miles of streets. Eaton Vista Acres would include nearly
of a mile of WCR 39 from WCR 76 to WCR 78 which is currently maintained by the County. In
addition,those streets built within the development will be added to the inventory.
Revenue sources like the Highway User Tax, license plate fees and County road and bridge
sharing have not kept up with maintenance costs in recent years so revenues such as sales tax
and/or property taxes will need to be used to fill the gaps.
SCHOOLS
The Eaton Re-2 School District has prepared their own estimate of the impact of the proposed
development on the school system and it is attached.
The Town will continue to collect school impact fees, which the District uses for land acquisition
costs, with the issuance of building permits.

Re: Eaton Vista Acres
Dear Mr. Carsten:
The above referenced development is proposed for a wide range of housing units
on approximately 158 acres east of County Road 39 to be annexed into the Town of
Eaton. The plan allows for 301 residences of which 178 are single family detached
homes and 138 multifamily or attached housing units. Although it is recognized that
construction of these homes will occur over several years, when combined with already
approved developments, the potential adverse effects upon elementary school facilities
and financial capacities are important. This letter summarizes the implications for
school sites and facilities.
Based upon expected student generation rates applicable for Eaton School District
RE-2, this level of development, at build out, would generate approximately 179 new
students to be accommodated within District facilities (see Tables 1 for detail):

The District had a meeting with the developer's architect/planner about the
development and land acreage to build a school site, if needed, to serve additional
students.
It is understood that approval of the annexation does not yet create an ability to
construct homes, i.e., draw a building permit, and therefore does not yet add to
enrollment potential. However, certain school issues should be considered at this
important juncture, including school site planning and facility capacity.
Site Issues
If the District pursued a land dedication, further discussions with the developer,
along with a conceptual site drawing would be needed in order to determine a school
site. As a result, the District would appreciate the opportunity to fully plan future school
sites in concurrence with the Town and applicant. The District has begun internal
discussions concerning the need for additional space and would like as much lead time
as possible as to when this development will begin construction.
Facility and Fiscal Capacity Issues
Current facilities that would serve this development are Eaton Elementary (grades
K - 2), Benjamin Eaton Elementary(grades 3 — 5) Eaton Middle School, and Eaton High
School. Current capacities and enrollments of these schools are:

Although the above capacity shows there are additional seats available in the
elementary buildings, because of the emphasis on small class size (20-22 students per
class) the available seats is overstated. Eaton Elementary does not have any unused
classroom space and Benjamin Eaton Elementary has only one classroom that is
currently available. Near term enrollment at these four schools is expected to increase
modestly over the next few years. However, should substantial growth materialize,
capacities at all these schools may be further compromised.
At this juncture in the process, the District is uncertain if a land dedication should
be addressed with the developer or if cash-in-lieu is appropriate for this development.
Additional discussions with the applicant, along with jointly planning with the Town and
applicant will be needed.
