APPROVED Subdivision Exemption is approved in accordance with information submitted in the application and the policies of the County. The Department of Planning Services has determined through its review that the standards of Section 11.15 of the Weld County Subdivision Ordinance have been met. Prior to recording the plat, the applicant shall submit evidence that an Individual Sewage Disposal System Evaluation has been completed by the Weld County Health Department on all existing septic systems . The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.13.9 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. Brian Grub from the Weld County Planning staff assisted Gene and- Sandra Ulm in a recorded exemption and a Subdivision Exemption for financing. At this time one parcel was granted the recorded exemption #825 and the remaining two parcels were approved as a Subdivision Exemption 'h27 for financing purposes only. A year ago 1 was forced to take over the farming operations and later the two parcels which included two homes on the ten acres. After consulting with Monica Daniels- Mika of the Weld Co. Plan- ning staff and with her advice I would like to discuss with you the possibilities of a waiver on the five year time period to apply for another recorded exemption and if you will allow a Subdivision Exemption and a Uecorded exemption to happen at the same time. I do have a contract on one of the houses and five acres and the waiver would allow me to split this property into two separate parcels. This is the only way I can sell these two houses and be able to pay back back the two Banks who hold security positions on this parcel. February 2, 1994 Greg Thompson - Current Planner Department of Planning Services klEB___4 1994Weld County Administrative Office , 1400 N. 17th Ave . vno �R•nr+ntsPluming Greeley CO 80631 Dear Greg, I have reviewed the Hertzke Subdivision and Recorded Exemption proposals, and offer the following comments : ROW Projected traffic on SH 392 indicates the need for a 150- foot total right-of-way, 75 ' feet each side of the highway centerline . The Recorded Exemption map indicates a distance of 34 . 01 feet from the section line and centerline to the south property boundary. Additional width to meet the projected need should be protected by reservation or, preferably, dedication, as permitted by County regulations . ACCESS The narrative states that all three lots already have an existing home on them. Neither the existing accesses nor the location of the structures are indicated on the submittals ; however, an access easement is shown between Lots A and B, from the state highway. As there would be no change of use resulting from the approval of these proposals, the Department is not warranted to re-evaluate access for the property. However, it should be noted at this time that no additional accesses to the site should allowed, and any future plans for uses of the property should target a single access point along the highway. Lot B borders WCR 25, and we would only continue to allow one direct access for remaining lots due to the long frontage to the highway. Any changes of use on the property in the future would warrant re-evaluation of the existing access (es) . It is possible the reconstruction or relocation of access could be required in the future, as property use changes . An access permit would be required for any changes of access, and design and location of access based upon the State Highway Access Code . DRAINAGE As the proposal indicates no change of use, it is reasonable to assume that there will also be no change of drainage along the highway. However, the applicant should be aware that the highway drainage system is for the protection of the state highway ROW, and is not intended to accommodate drainage from abutting properties beyond that which has historically been accepted.
