The following change is hereby made to the Contract Documents:
Contract Time Extension: The original Agreement for L.G Everist is extended from March 13, 2014 to March 12,
2015 as permitted by the contract. This extension will be the second year of a possible
three year contract.
Change to Original Rate Schedule: The 2013 Bid Schedule of the original contract shall be replaced by the attached
2014 Bid Schedule.
CHANGE TO CONTRACT PRICE:

Brief description of the problem/issue:
The L. G. Everist Agreement may be extended from March 13, 2014, to March 12, 2015, as permitted by the contract.
This extension would be in the second(2nd)year of a possible three-year term limit. The contract also allows for yearly
rate adjustments based upon the Denver-Boulder-Greeley CPI index, which is a 2.77% increase. L.G Everist did request
an increase for the supply of 3/8" chips. The increase was from $13.65 a ton in 2013 to $14.00 a ton in 2014 (2.56%
increase). The total contract amount would be$112,840.00,which is under the budget amount for 2014.
This contract extension does not include the 1/2",chip supply for 2014. Due to the September flooding, L.G Everist will
not be able to supply Weld County with the %"chips. The gravel pit that produced the''/," is under water and will not be
operating before the construction season starts. The Public Works Department will prepare a bid for the 'A"chip at the
end of March.
L.G Everist was awarded this contract in 2013 as the low bid vendor and the department has been satisfied with their
product.
What options exist for the Board? (Include consequences,impacts,costs,etc.of options)
The Board may either approve or deny the contract renewal/extension..

Project Description:
The project in general consists of crushing, stockpiling and loading (6,000 Tons of 3/8" chips and 7,200 Tons of%:"
chips) totaling 13,200 tons of aggregate material into Weld County trucks for the 2013 chip seal projects in Weld
County.
The Owner has considered the Bid submitted by you for the above described Work in response to its Invitation for Bids
and Instructions to Bidders.
You are hereby notified that your Bid has been accepted in the amount of S 180,180.00 or as shown in the Bid Schedule.
You are required by the Instructions to Bidders to execute the Agreement and furnish the required Performance Bond,
Payment Bond and Certificates of Insurance within ten(l0)calendar days from the date of this Notice to you.
If you fail to execute said Agreement and to furnish said Bonds within ten (10) days from the date of this Notice, said
Owner will be entitled to consider all your rights arising out of the Owner's acceptance of your bid as abandoned. The

8. Contract Appropriations: The Owner hereby states and affirms that the amount of money
appropriated for this Contract is equal to or in excess of the Contract amount.No change order to this
Contract requiring additional compensable work to be performed,which work causes the aggregate
amount payable under the Contract to exceed the amount appropriated for the original Contract shall
be issued by the Owner unless the Owner assures the Contractor,in writing,that lawful appropriations
to cover the costs of the additional work has been made or unless such work is covered under a

On February 19,three bids were opened for the 2013 Chip Seal Aggregate Supply contract. Three bids were received and
the amounts ranged from $180,180.00 to $528,000.00 with the lowest bid submitted by L.G Everist, Inc. The Estimated
cost for this material was$290,400.00.
This material will be used for 2013 chip seal projects and for the 2013 HRP Construction projects.
It is our recommendation to award both the North and South Supply to L.G Everist, Inc for a total amount of
$180,180.00.
