RE : LOT SIZE VARIANCE #44 - DONNA DEE SMALLFOOT.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined,
at a public hearing held on the 11th day of July, 1977 , in the
Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain parcel of land is owned by Donna Dee
Smallfoot, 6251 Weld Co. Rd. #20 , Longmont, CO 80501, which
land is more particularly described as follows, to-wit :
A part of the SA of Section 18, T2N, R67W of the 6th P.M. ,
Weld County, Colorado, more particularly described as follows:
Commencing at the WQ corner of said Section 18, thence in an
Easterly direction along the North Boundary of the SW4 of
said Section 18 a distance of 1034.36 feet to the point of
beginning; thence containing along the last described course a
distance of 412.95 feet; thence on an angle to the right of 38°48'30"
a distance of 2594.87 feet to a point on the Northerly right-of-way
line of County Road No. 20; thence on an angle to the right of
91°29'22" along said right-of-way line a distance of 413.00 feet;
thence on an angle to the right of 88°30'38" a distance of
2592.72 feet to the point of beginning, containing 24.584 acres.
WHEREAS, Donna Dee Smallfoot desires to split the hereinabove
described tract of land into two parcels, and
WHEREAS , Section 9-4A (6) of the Weld County Subdivision
Regulations requires that a lot size variance be obtained before
a Recorded Exemption is granted to the applicant, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, feels that the applicant has shown good cause for
granting a lot size variance under Section 9-4A (6) of the Weld
County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED that a variance from lot
size requirements be granted to Donna Dee Smallfoot for the
above described parcel of land.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 11th

RE : Lot Size Variance #44
Dear Commissioners :
The attached letter and related materials are in reference to a
request by Donna Smallfoot for a lot size variance. The subject
property is described as Pt. of the SW4 of Section 18, T2N, R67W
of the 6th p.m. , Weld County, Colorado. Said property is located
one mile north of Firestone. The property in question contains
approximately 24. 5 acres of Class IV and VI non-irrigated soils.
The request is to obtain a variance from the minimum lot size
requirement , Section 9. 4(A)(6) , so that Ms. Smallfoot may make
application to apply for a recorded exemtpion. Section 9.4(A) (6)
states, "That the original tract or parcel of land to be divided
under this section meets the minimum lot size requirements estab-
lished by the Weld County Zoning Resolution; variance from this
requirement being allowed only upon good cause being shown to the
Board of County Commissioners or where said tract or parcel of land
lies within the Comprehensive Plan of an existing incorporated
town of Weld County. (Revised 4/17/74)"
If this lot size variance is granted, Ms. Smallfoot will proceed
with her application for a recorded exemption to divide the property
into two lots. The property in question is proposed to be divided
in half with each resulting parcel containing approximately 12 acres
and each resulting parcel would contain an existing set of improve-
ments.
Based upon the information submitted and the adopted policies in the
county, the Planning Commission staff recommends that the request
be approved for the following reasons :

1. The Tri-Area Planning Commission has indicated they have no
objections to the granting of this request.
2. The request complies with the intent clause of the recorded
exemption procedure (Section 9.2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural District
(Section 3 . 3(A) of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that non-productive
agricultural land (Class IV and Class VI non-irrigated soils)
is proposed to be split and utilized for residential purposes
which would be compatible with land uses in the surrounding
area and since each of the two resulting parcels has an
existing set of improvements.
3 . The request complies with the provisions of Section 9.4(A) of
the Weld County Subdivision Regulations.
4. The Town Board of Firestone has indicated they have no
objections to the approval of this request since each of the
resulting parcels has an existing set of improvements.
