HomeMy WebLinkAbout20142954.tiff HEARING CERTIFICATION DOCKET NO. 2014-71 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR14-0035, FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY (NATURAL GAS AND CONDENSATE SEPARATOR FACILITY AND COMPRESSOR FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT—AKA ENERGY GROUP, LLC A public hearing was conducted on October 1, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem - EXCUSED Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated August 29, 2014, and duly published September 3, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Aka Energy Group, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0035, for an Oil and Gas Support and Service Facility (natural gas and condensate separator facility and compressor facility) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. la Chair Rademacher advised Gregg Wurtz, AKA Energy Group, that, since Commissioner Kirkmeyer was not able to be present, he had the option of continuing this matter to a date with the full Board present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Kirkmeyer will listen to the record and make the determining vote. Mr. Wurtz indicated he would like to proceed. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. This facility will occupy eight (8) acres of an 80-acre parcel purchased by the applicant, the USR boundaries will apply to the entire parcel, and this is an unmanned facility with 24/7 operations. A Noise Abatement Plan was submitted; the buildings will be sound attenuated and mufflers installed if necessary. The applicant will comply with all Colorado Oil and Gas Conservation Commission (COGCC) requirements. Mr. Gathman reported three surrounding property owners attended the Planning Commission hearing to express concerns regarding noise, light pollution, traffic, safety (spill concerns), and the specific location of the facility on the site (one person requested the facility be moved to the north). Staff also received an email regarding excessive oil and gas traffic in the area and requesting paving on CRs 35 and 38. Mr. Gathman said Development Standards were added to address compatibility with the area and reviewed referrals, which expressed no concerns. Mr. Gathman showed pictures of the site. He stated the site is not close to any municipality, and there are other oil and gas facilities nearby. El Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements. Access is off CR 38, a local gravel road, and their access is adjacent to the section line. He reviewed the Average Daily Traffic count (ADT) from 2009, and noted that, as DCP and Anadarko have sites nearby, that has most likely increased. Mr. Carroll reviewed road maintenance on CR 38, and said CR 39 is a collector road. The applicant anticipates two to three pickup-truck trips per day and tractor-trailers coming to the site three times a week. He also noted cattle guards are not necessary at this location. In response to Chair Rademacher, Mr. Carroll confirmed Anadarko's access is off of CR 35, and an ADT has been scheduled for that road. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. Portable toilets are fine. She noted they may need an Air Emissions Permit, and will do a Spill Prevention Control and Counter Measure Plan within six months of commencing operations, Development Standard #10 addresses noise standards, and Ms. light said being electric driven will also reduce noise levels. In response to Commissioner Conway's comment concerning the lack of topography at the site to buffer sound, Ms. Light addressed the noise levels further. IR Mr. Wurtz said the project has an eight-acre footprint. There are two compressors housed inside individual buildings which will receive gas from an existing pipeline, gas and liquid will be separated, gas will leave via another pipeline, and liquids will be stored onsite then picked up by transport trucks. Mr. Wurtz added that electric facilities are significantly quieter than those run by diesel fuel, but could not offer specifics. el Commissioner Conway noted that one surrounding property owner requested the facility be moved to the north. Mr. Wurtz replied the parcel to the north was purchased by the Water Conservation District for a water infiltration project. In response to Commissioner Conway's lighting concerns, he confirmed they will use downward lighting for security purposes only. Mr. Wurtz also confirmed AKA Energy has a 24-hour contact phone number posted at the entrance to their facility. e No public testimony was offered concerning this matter. In response to Chair Rademacher, Mr. Wurtz stated he was in agreement with the Conditions of Approval and Development Standards. e Mr. Yatabe clarified and corrected the new legal description, being as follows: W1/2 SW1/4 of Section 31, Township 4 North, Range 65 West of the 6th P.M., Weld County, Colorado. Commissioner Garcia moved to approve the request of Aka Energy Group, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0035, for an Oil and Gas Support and Service Facility (natural gas and condensate separator facility and compressor facility) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously. There being no further discussion, the hearing was completed at 10:30 a.m. This Certification was approved on the 6th day of October, 2014.
