The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by
Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments
made during this phase of the Use by Special Review process may not be all inclusive; as other issues may
arise during the remaining application process.
COMMENTS:
CR 22 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant
shall delineate or dedicate an additional 40-foot of right-of-way parallel to the CR 22 right-of-way for full build-
out.
Our most recent traffic count (ADT) reflects on road CR 22 between CR 41 to CR 49 1327 , taken in 2013.
Section Line: CR 45 (30' right-of-way in section 14 only).
REQUIREMENTS:
Access:
Show the approved access on the plat and label it with the approved access permit number (AP14-00029)
The applicant shall place on the plat drawing: 30-foot access easement across Lot C, RE-2345, for the benefit
of Parcel 130714000002 on case USR14-0001.
Noxious Weeds:
Should noxious weeds exist on the property or become established as a result of the proposed development,
the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of
the Weld County Code.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).

SUBJECT: USR14-0001 Weichel

Environmental Health Services has reviewed this proposal for one (1) single-family
dwelling unit per lot other than those permitted under Section 23-3-20.A. (second single-
family dwelling unit) in the A (Agricultural) Zone District.
There is currently a modular home, main residence and shop/residence located on the
parcel. The home built in the 1930's will be removed.
A well permit was provided with the application (292798) which is permitted to serve up
to three single family dwellings.
There are three permitted septic systems located on the parcel. The main residence is
served by permit G19830202, the mobile home is served by permit SP-9900544 and the
shop/residence is served by permit SP-1300113. The shop/residence septic system
has not received final approval.
We have no objections to the proposal; however, we recommend that the following
requirement be met prior to issuance of a certificate of occupancy for the
shop/residence:
1. Septic permit SP-1300113 shall receive final approval from the Environmental
Health Services Division of the Weld County Department of Public Health and
Environment.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Sewage disposal shall be by septic system. Any septic system located on the
property must comply with all provisions of the Weld County Code, pertaining to
Individual Sewage Disposal Systems.
5. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
6. The facility shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

After reviewing the application and documents submitted the Building Department has the following comments:
A building permit may be required for any new structures, additions or alterations of any structures, per Section 29-
3-10 of the Weld County Code.
Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2012 International Residential Code; 2006
International Energy Conservation Code; 2011 National Electrical Code; and Chapter 29 of the Weld County Code.
Ag-Exempt structures shall be separated from a residence with a minimum one (1)hour rated separation wall.
A plan review shall be approved and a permit must be issued prior to the start of construction.
