HomeMy WebLinkAbout20141845.tiff MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,June 12, 2014 at 10:12 a.m., in the Hearing Room of the Weld County Planning Department at 1555 N 17th Ave, Greeley, Colorado. Members Present: Galen Monson, Don Carroll, LeAnn Koons, Robert Fleck. Members Absent: Jerry Adams, Terry Stencel, Tom Beach and Al Trujillo. Also Present: Chris Gathman and Tom Parko, Jr., Department of Planning Services and Kris Ranslem, Secretary. CASE NUMBER: PUDF14-0001 APPLICANT: MARK&JACQUELYN EBERL PLANNER: CHRIS GATHMAN REQUEST: APPLICATION FOR AN AMENDMENT TO A PUD (PLANNED UNIT DEVELOPMENT) FINAL PLAT (S-500 - EDEN'S RESERVE PUD) TO VACATE LOT 9 (AGRICULTURAL ZONED) OUT OF THE EDEN'S RESERVE PUD. LEGAL DESCRIPTION: LOT 9 EDENS RESERVE PUD; PART OF SECTION 21,T3N, R68W OF THE 6TH P.M.,WELD COUNTY, COLORADO. LOCATION: SOUTH OF AND ADJACENT TO CR 32; 0.5 MILES EAST OF CR 5. Chris Gathman, Planning Services, stated that the applicants wish to vacate Lot 9 which is an agricultural zoned outlot from the Eden's Reserve PUD (Planned Unit Development). Lot 9 encumbers approximately 63.9 acres. The standard requirements under Section 24-7-60.A state"Easements shall follow rear and side lot lines whenever practical and shall have a minimum total width of twenty (20) feet apportioned equally on abutting properties"and Section 24-7-60.8"Where front line easement are required,a minimum of fifteen(15) feet shall be allocated as a utility easement". Mr. Gathman stated that in this case the applicants are proposing to vacate out entirely out of the PUD and therefore they are not subject to the subdivision design standards. Staff recommends that the 20 foot Emergency Access and Utility Easement remain as it deals with access and utilities to that Logan's Reservoir parcel. Additionally, staff recommended that any utility easements that already have existing utilities within them remain. Rob Fleck asked the applicant if there is another use for the property since they are requesting to vacate it from the PUD. Mark Eberl said that they want regular agricultural zoning rather than PUD zoning so that they can submit a Recorded Exemption to split their existing house off to sell and build another one. Mr. Gathman added that currently the applicants are undergoing the Change of Zone process for the property to rezone it back to agricultural. Don Carroll moved to accept the plat as presented, seconded by Galen Monson. Motion carried unanimously. PLANNER: TOM PARKO, JR. REQUEST: PROPOSE AMENDMENT TO THE UTILITIES COORDINATING ADVISORY COMMITTEE BYLAWS Tom Parko, Planning Director, presented the proposed changes to the Utility Board Bylaws. Earlier this year there was a reorganization with the Department of Public Works and through that reorganization there were two (2) engineers transferred from Public Works to the Planning Department. Therefore it makes sense to have one of these engineers serve as a representative on the Utility Board. Galen Monson inquired if it should read "Weld County" Department of Planning Services. Mr. Parko replied that we can add that to the changes. Galen Monson moved to accept the proposed changes to the Utilities Coordinating Advisory Committee Bylaws and recommend approval to the Board of County Commissioners,seconded by LeAnn Koons.
