Narrative: The applicant is proposing to install an additional injection well at the High Plains
Platteville site. No additional changes to the layout and improvements at the High
Plains Platteville site are proposed. Truck traffic will increase from 75 round trips
per day to up to 150 round trips per day under this proposed minor amendment.
THE DEPARTMENT OF PLANNING SERVICES' DIRECTOR RECOMMENDS APPROVAL OF THIS
APPLICATION FOR THE FOLLOWING REASONS:
1. The proposed change(s) will be compatible with existing and allowed uses in the surrounding
area and be in harmony with the neighborhood. The proposed minor amendment will not
change/increase on-site improvements.Traffic trips will increase from 75 round trips per day to up
to 150 round trips per day. The facility has 24-hour a day hauling hours approved under
MUSR13-0003. Per the application materials approximately 20% of the total vehicles would
access the site during the hours from 10:00 PM to 7:00 PM (approximately 3.33 vehicle trips per
hour).
2. The proposed change(s) is consistent with the County Comprehensive Plan pursuant to Chapter
22 of the Weld County Code.

Section 22-2-10 2. A.Policy 7.2. of the Weld County Code states:"Conversion of agricultural land
to nonurban residential, commercial and industrial uses should be accommodated when the
subject site is in an area that can support such development, and should attempt to be
compatible with the region."
The proposed minor amendment will not change/increase on-site improvements.Traffic trips will
increase from 75 round trips per day to up to 150 round trips per day. The facility has 24-hour a
day hauling hours approved under MUSR13-0003. Per the application materials approximately
20%of the total vehicles would access the site during the hours from 10:00 PM to 7:00 PM
(approximately 3.33 vehicle trips per hour).
3. The proposed change(s) will not result in a substantial adverse impact on the other property in
the vicinity of the subject property. No phone calls, letters or correspondence have been received
from property owners in regards to this case.
4. The recommendations of the referral agencies have been considered. Recommendations from
referral agencies have been attached as conditions of approval and/or development standards.
All referral agencies have either indicated no conflict/concerns or have recommended approval
with conditions.
5. The proposed change is not deemed to be a major change. The Department of Planning
Services determined that the proposed use was not deemed to be a major change and
could be processed as a minor amendment at a February 7, 2014 staff meeting.
6. The proposed changes must be consistent with the original development standards. The proposal
is consistent with the previously approved permit. Development Standard#1 has been updated to
reflect this minor amendment request and two additional Development Standards (Development
Standards #21 and #22) have been added delineating Colorado Oil and Gas Commission
financial assurance, reclamation and closure plan requirements for the injection well.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
1. Prior to Recording the plat:
A. The applicant shall submit evidence of an Air Pollution Emission Notice (APEN) and
Emissions Permit from the Air Pollution Control Division, Colorado Department of Health
and Environment. Alternately, the applicant can provide evidence from the APCD that
they are not subject to these requirements. (Weld County Environmental Health)
B. The applicant shall submit an updated Groundwater Monitoring Plan, and the
Groundwater Monitoring Plan shall be approved by Weld County Department of Health
and Environment. Evidence of such shall be submitted, it writing, to the Department of

C. The applicant shall submit a dust abatement plan, detailing on site dust control
measures, for review and approval, to the Environmental Health Services, Weld County
Department of Public Health&Environment. (Weld County Environmental Health)
D. A PE certified and signed copy of the Spill Prevention, Control and Countermeasure
Plan, prepared in accordance with the applicable provisions of 40 CFR, Part 112, as
applicable, shall be provided to Environmental Health Services Division of the Weld

E. The applicant shall submit an approved waste handling plan, to the Environmental Health
Services Division of the Weld County Department of Public Health& Environment. The
plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site(this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed(including the
facility name, address, and phone number).
4) Solids and sediment will accumulate in the storage tanks. The waste handling
plan shall include a detailed plan that describes the method of how those solids
will be removed, including all on-site handling procedures.
5) The waste handling plan shall provide a commitment to notify the Weld County
Department of Public Health and Environment in writing, in the event the plan is
amended. The plan shall be reviewed and approved by the Weld County
Department of Public Health and Environment. (Weld County Environmental

F. A Weld County Road Access Permit Application Form will be required for all new and
existing roads, driveways or other means of providing ingress or egress to lands
adjoining County rights-of-way. The application form shall be completed by the property
owner to be accessed from a County road or his/her duly authorized agent as evidenced
by written documentation.
1. Access pictures will be required from the left, right and into the access.
2. A signature and date will be required to deem the application acceptable and

2. The plat shall be amended to delineate the following:
A. All sheets of the plat shall be labeled MUSR14-0004. (Department of Planning Services)
B. The attached Development Standards. (Department of Planning Services)
C. The plat shall be prepared in accordance with Section 23-2-260.D of the Weld County
Code. (Department of Planning Services)
D. County Road 32 is designated on the Weld County Road Classification Plan as a
Collector road, which requires 80 feet of right-of-way at full build out. There is presently
60 feet of right-of-way. An additional 10 feet shall from the centerline of County Road 32
be delineated on the plat as future County Road 32 right-of-way. All setbacks shall be
measured from the edge of future right-of-way. The applicant shall verify the existing
right-of-way and the documents creating the right-of-way and this information shall be
noted on the plat. If the right-of-way cannot be verified, it shall be dedicated. This road is
maintained by Weld County.
E. Show the approved access on the plat and label it with the approved access permit
number(will be provided).

2. Prior to Operation of the additional Injection Well.
A. The applicant shall develop an Emergency Action and Safety Plan with the Office of
Emergency Management and the Fire District. The plan shall be reviewed on an annual
basis by the Facility operator, the Fire District and the Weld County Office of Emergency
Management. Submit evidence of acceptance to the Department of Planning Services.
3 Upon completion of Condition of Approval #1 above, the applicant shall submit two (2) paper
copies or one (1) electronic copy (.pdf) of the plat for preliminary approval to the Weld County
Department of Planning Services. Upon approval of the plat the applicant shall submit a Mylar
plat along with all other documentation required as Conditions of Approval. The Mylar plat shall
be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning
Services. The plat shall be prepared in accordance with the requirements of Section 23-2-260.D
of the Weld County Code. The Mylar plat and additional requirements shall be submitted within
one hundred twenty (120) days from the date of the Board of County Commissioners Resolution.
The applicant shall be responsible for paying the recording fee.

4. In accordance with Weld County Code Ordinance 2012-3 approved April 30, 2012, should the
plat not be recorded within the required one-hundred (120) days from the date the Administrative
Review was signed a $50.00 recording continuance charge may be added for each additional 3

2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld
County Code. (Department of Planning Services)
3. The facility shall be constructed and operated to ensure that contamination of soil and
groundwater does not occur. (Department of Public Health and Environment)
4. A manager, knowledgeable in operating an injection well, shall be on site when the facility is
receiving waste. (Department of Public Health and Environment)
5. Any individual sewage disposal system (I.S.D.S.) on the property shall be permitted, installed,
maintained and operated in compliance with all provisions of the Weld County Code, pertaining to
I.S.D.S. (Department of Public Health and Environment)
6. Adequate drinking water, hand washing, and toilet facilities shall be provided. (Department of
Public Health and Environment)
7. No disposal of waste other than Class II, as defined by the Environmental Protection Agency, is
permitted. Any changes from the approved Class II use would require an amendment to this
Special Review permit. (Department of Public Health and Environment)
8. Any wastes generated on the facility shall be disposed in accordance with the Colorado Solid
Waste Act, Section 30-20-100.5, C.R.S., or other appropriate rule, regulation, or law. (Department

9. The maximum permissible noise level shall not exceed the industrial limit of 70 dB (A), as
measured according to Section 25-12-103, CRS. (Department of Public Health and Environment)
10, Fugitive dust and fugitive particulate emissions shall be controlled on this site. (Department of

11. All chemicals stored on-site must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations. (Department of Public Health and Environment)
12. The facility shall comply with Colorado Air Quality Control Commission Regulations and any air
permits issued by the Colorado Department of Health and Environment Air Pollution Control
Division. (Department of Public Health and Environment)
13. All liquid wastes received at the facility shall be unloaded on the unloading pad. The concrete
unloading pad shall be cleaned at a frequency that prevents oils and other wastes from building
up on the pad. At a minimum, the pad shall be pressure washed daily to remove any waste build-
up. During winter months, the facility shall maintain the unloading pad free of ice. (Department of

14. Any analysis of waste shall be forwarded to the Weld County Health Department, Environmental
Health Services Division. The Division reserves the right to require additional, more extensive
monitoring at a later date. (Department of Public Health and Environment)
15. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-
20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination. (Department of Public Health and

16. Any petroleum-contaminated soils on the facility shall be removed, treated or disposed in
accordance with all applicable rules and regulations. (Department of Public Health and

17. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may
be reason for revocation of the Permit by the Board of County Commissioners. (Department of

18. The facility shall comply with the approved Groundwater Monitoring Plan. (Department of Public
Health and Environment)
19. All storm water, which has come into contact with waste materials on the site, shall be confined
on the site. In the event that storm water is not adequately controlled on the site, upon written
notification from the Weld County Department of Public Health and Environment or the Colorado
Department of Public Health and Environment, a comprehensive site-wide storm water plan shall
be developed and implemented. The plan must be approved, in writing prior to implementation
by the Weld County Department of Public Health and Environment and the Colorado Department

20. All contaminated soils shall be stored on an impervious surface where any stormwater that comes
into contact with the soils would be contained. (Department of Public Health and Environment)
21. The facility shall post financial assurance with the COGCC. The financial assurance shall be
adequate to cover a third-party closure of the facility, including the plugging and abandonment of
the well, in accordance with industry standards, and the removal of all structures (including
concrete) on the facility. The site shall be returned to its original grade. The facility shall submit
evidence to Weld County Department of Public Health and Environment that the appropriate

22, A Detailed Closure Plan shall be submitted to Weld County Department of Public Health and
Environment and the Colorado Oil and Gas Conservation Commission. The Closure Plan shall
include a description of the manner in which the well will be plugged and abandoned, as well as
specific details regarding reclamation of the property. No structures or equipment associated with
the facility shall remain on the property following closure. (Department of Public Health and

23. The operation shall comply with all applicable rules and regulations of the State and Federal
agencies and the Weld County Code. (Department of Public Health and Environment)
24. The property owner or operator shall provide evidence of an Emergency Action and Safety Plan
on or before March 15th of any given year signed by representatives for the Fire District and the
Weld County Office of Emergency Management to the Department of Planning Services.

25. No parking or staging of commercial vehicles shall be allowed on County roads. (Department of

28. Buildings, structures shall conform to the requirements of the various codes adopted at the time
of permit application. Currently the following has been adopted by Weld County: 2012
International Building Code; 2012 International Mechanical Code; 2012 International Plumbing
Code: 2012 International Energy Code; 2006 International Fuel Gas Code; the 2012 International
Plumbing Code; 2011 National Electrical Code; 2003 ANSI 117.1 Accessibility Code and Chapter

29, Hauling hours shall be 7 days a week, 24-hours a day. (Department of Planning Services)
30. The landscaping/screening on site shall be maintained in accordance with the approved
Landscape/screening Plan. (Department of Planning Services)
31. Sources of light, including light from high-temperature processes such as combustion or welding,
shall be shielded so that light rays will not shine directly onto adjacent properties where such
would cause a nuisance or interfere with the use on the adjacent properties;and Neither direct
nor reflected light from any light source may create a traffic hazard to operators of motor vehicles
on public or private streets and no colored lights may be used which may be confused with or

32. Building Permits issued on the proposed lots will be required to adhere to the fee structure of the
Countywide Road Impact Program.
33. Building Permits issued on the proposed lots, will be required to adhere to the fee structure of the
County Facility Fee and Drainage Impact Fee Programs,

35, The historical flow patterns and run-off amounts will be maintained on site in such a manner that
it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or

36. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other
than grasses, needs to be maintained at a maximum height of 12 inches until the area is
completely developed.
37. The Use by Special Review activity shall not occur nor shall any building or electrical permits be
issued on the property until the Special Review plat is ready to be recorded in the office of the

USR-1677 is currently authorized under the auspices of MUSR 13-0003 as a Class II Oil Field
Waste Disposal Facility (Reception No. 3932702, Recorded May 16, 2013).
Said Facility includes one disposal well with a maximum of 6 employees on site and
approximate current traffic counts of 75 round trip truck/trailer loads per 24 hours.
Proposed changes entail the addition of one disposal well to be authorized under the State of
Colorado Regulations. Attendant truck traffic count could increase by 75 round trip loads.
No other operational changes are expected.
Traffic Narrative
Under USR-1677 Conditions of Approval, acceleration and deceleration lanes were required and
constructed on CR-32. This modified USE would result in 150 round trips per day. Said trips
are anticipated to anive/disburse equally, to/from the Site on CR-32; thence further disburse
equally on county/state roads depending on customer needs. Trips are equally distributed hour-
to-hour with 80% of the total being between 7:00 a.m. and 10:00 p.m. (15 hours) and 20%of the
total being between 10:00 p.m. and 7:00 a.m. (9 hours).
Therefore, at the Site ingress/egress on CR-32:
7:00 a.m. - 10:00 p.m.: 240± 15 hours= 16 vehicles/hr (vph)
In other words: 4 right turn in/hr

An Amendment to a Use by Special Review permit to add one disposal well to an existing injection well
facility.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 32 is a collector road, which requires an 80-foot right-of-way at full build out. There is presently a 60-
foot right-of-way and this road is maintained by Weld County. Pursuant to the definition of SETBACK in
the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The applicant states that the total truck numbers will increase by 75 round trip loads for a total of 150
round trips per 24 hour day. A westbound left turn lane into the facility was constructed under USR-1677
and will accommodate the additional truck traffic. Future improvements if warranted will be done in
accordance with the existing Improvements and Road Maintenance Agreement for USR-1677.
A Weld County Road Access Permit Application Form will be required for all new and existing roads,
driveways or other means of providing ingress or egress to lands adjoining County rights-of-way. The
application form shall be completed by the property owner to be accessed from a County road or his/her
duly authorized agent as evidenced by written documentation.
a. Access pictures will be required from the left, right and into the access.
b. A signature and date will be required to deem the application acceptable and complete.
This property is not in a Special Flood Hazard Area (SFHA) defined by the Federal Emergency
Management Agency (FEMA).
The applicant shall ensure that the proposed improvements do not alter the historic drainage patterns and
run-off amounts from the property.
REQUIREMENTS:
The development standards and notes related to Public Works shown on the previously recorded plat

Environmental Health Services has reviewed this proposal for an additional disposal
well at the High Plains Platteville Disposal Facility. We have no objections to the
proposal, however, we do recommend that the following conditions be part of any
approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice (APEN)
and Emissions Permit from the Air Pollution Control Division, Colorado
Department of Health and Environment. Alternately, the applicant can provide
evidence from the APCD that they are not subject to these requirements.
2. The applicant shall submit an updated Groundwater Monitoring Plan, and the
Groundwater Monitoring Plan shall be approved by Weld County Department of
Health and Environment. Evidence of such shall be submitted, it writing, to the
Department of Planning Services.
3. The applicant shall submit a dust abatement plan, detailing on site dust control
measures, for review and approval, to the Environmental Health Services, Weld
County Department of Public Health & Environment.
4. A PE certified and signed copy of the Spill Prevention, Control and
Countermeasure Plan, prepared in accordance with the applicable provisions of
40 CFR, Part 112, as applicable, shall be provided to Environmental Health
Services Division of the Weld County Department of Public Health &
Environment.
5. The applicant shall submit an approved waste handling plan, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
4) Solids and sediment will accumulate in the storage tanks. The waste handling plan
shall include a detailed plan that describes the method of how those solids will be
removed, including all on-site handling procedures.
5) The waste handling plan shall provide a commitment to notify the Weld County
Department of Public Health and Environment in writing, in the event the plan is
amended. The plan shall be reviewed and approved by the Weld County
Department of Public Health and Environment.
All development standards associated with USR 1677 and MUSR13-0003 are still
applicable. Additionally, we recommend that the following requirements be incorporated
into the permit as development standards:
1. The facility shall post financial assurance with the COGCC. The financial assurance
shall be adequate to cover a third-party closure of the facility, including the plugging
and abandonment of the well, in accordance with industry standards, and the
removal of all structures (including concrete) on the facility. The site shall be
returned to its original grade. The facility shall submit evidence to Weld County
Department of Public Health and Environment that the appropriate financial
assurance has been obtained.
2. A Detailed Closure Plan shall be submitted to Weld County Department of Public
Health and Environment and the Colorado Oil and Gas Conservation Commission.
The Closure Plan shall include a description of the manner in which the well will be
plugged and abandoned, as well as specific details regarding reclamation of the
property. No structures or equipment associated with the facility shall remain on the
property following closure.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory review
of the referral information and provide informal comments. The comments do not address the
adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy
any County regulations or requirements. In addition, the comments provided herein cannot be
used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or
physical availability of water.
The proposal is to add one injection well to the Oil Field Waste Disposal Facility ("Facility")
approved in MUSR 13-0003. The Facility includes one injection disposal well (API #05-123-
29168) and one commercial well, permit no. 278835. Well permit no. 278835 was issued on
September 29, 2008 pursuant to C.R.S. 37-92-602(3)(b)(I) for Lot A of the Recorded Exemption
RE-4049. The use of the ground water from this well is limited to drinking and sanitary facilities as
described in a commercial business. Water from this well shall not be used for lawn or landscape
irrigation or for any other purpose outside the business building structure. Our records show that
well no. 278835 was constructed to a depth of 480 feet and it produces water from the Laramie-
Fox Hills aquifer.
Since this minor amendment proposes to only add one injection well through the
Colorado Oil and Gas Conservation Commission, we have no objection to the proposal,
provided well permit no. 278835 will continue to be used in accordance with the terms and

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from
seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2,unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(I)for appropriation of ground water tributary to the South Platte River system.
4) The use of ground water from this well is limited to drinking and sanitary facilities as described in CRS 37-92-602(1)(c),
for a commercial business. Water from this well shall not be used for lawn or landscape irrigation or for any other purpose
outside the business building structure.
5) Production from this well is restricted to the Laramie Formation which is located above the Laramie-Fox Hills aquifer
between 40 feet and 355 feet below the ground surface. Plain casing shall be installed and grouted to prevent production
from other zones.
6) The pumping rate of this well shall not exceed 15 GPM.
7) The annual amount of ground water to be diverted by this well shall not exceed 1/3 acre-foot(108,600 gallons).
8) Approved as the only well on a tract of land of 5.15 acre(s)described as Lot A,Recorded Exemption R-4049,Weld County.
9) The return flow from the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well Is located. The maximum
consumptive use of ground water shall not exceed 10 percent,
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner(recorded at least annually)and submitted to the Division Engineer upon
request.
11) This well shall be constructed not more than 200 feet from the location specified on this permit.
NOTE:To ensure a maximum productive life of this well,perforated casing should be set through the entire producing
