HomeMy WebLinkAbout20140278.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 29, 2014 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, January 29, 2014, at the hour of 9:00 a.m. .£ ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Susan Brown Controller, Barbara Connolly El MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of January 27, 2014, as printed. Commissioner Garcia seconded the motion, and it carried unanimously. ▪ AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed. Commissioner Garcia seconded the motion, and it carried unanimously. PRESENTATIONS: e 1) RECOGNITION OF SERVICES, DEPARTMENT OF HUMAN SERVICES - DENNIS BOGOTT: Chair Garcia read the certificate into the record recognizing Mr. Bogott for his eight years of service to Weld County. Judy Griego, Director of Department of Human Services, was present, and Lennie Bottorff, Business/Fiscal Division Head, stated Mr. Bogott has always taken on the most challenging reporting requirements in the Department, and did a great job managing his staff, and will be missed. Mr. Bogott said when he started it was quite a challenge and he has enjoyed his time with the County. Commissioner Conway said that the taxpayers/residents of Weld County were lucky to have him. The Board concurred and wished him luck in retirement. e 2) RECOGNITION OF SERVICES, SHERIFF'S OFFICE - WILLIAM SIMPSON: Chair Garcia read the certificate into the record recognizing Mr. Simpson for his almost three decades of service to Weld County in the booking department. Sally Gomez, Sheriffs Office, accepted on his behalf. Minutes, January 29, 2014 2014-0278 Page 1 BC0016 1LI Commissioner Rademacher concurred with Commissioner Conway, that Mr. Simpson is one of the unsung heroes of the County. e PUBLIC INPUT: Doug Meyers, County resident, spoke regarding The American Stewards of Liberty, and bringing State and Federal government to the negotiating table regarding eminent domain. Commissioner Rademacher said these comments are timely because there is a bill being presented this year to give the oil and gas industry more powers of imminent domain, to which the Board expressed opposition. Commissioner Kirkmeyer said that Colorado Counties, Inc. (CCI) is opposing it as well. e COMMISSIONER COORDINATOR REPORTS: Commissioner Garcia reported that on Friday Trevor Jiricek, Director of General Services, and Roy Rudisill, Director of the Office of Emergency Management, and himself attended a meeting in Evans regarding the destroyed mobile home parks, Evans was turned down for FEMA help due to the size of the economic impact, so that situation will continue to be a problem. The flood also uncovered a dump site in the park, and FEMA will assist with everything above ground, but the garbage below-grade is another situation Evans will have to deal with. Commissioner Garcia also referred to new signage due to the Economic Development Council for shopping, parks, pool, library, etc., and mentioned that Evans is debt free, but doesn't have capital reserves. Commissioner Rademacher noted the Board will be meeting with Evans again soon. 11 Commissioner Conway stated many of the Board's positions on upcoming legislation have been adopted by CCI and some new leadership was elected. Commissioner Conway will be the General Government Chair for the next two years. He also attended a meeting at AGPROfessionals, Inc., and met with homeowners in Kersey to hear concerns about PDC Energy's proposed development. Ii Commissioner Kirkmeyer attended the first Upstate Colorado Economic Development Council meeting. She said that Commissioner Conway was elected Vice-Chair and she will be on the Marketing Committee, and Weld County's small business incentive program was discussed. She said the Board is meeting with Library Board members this afternoon at 2:00 p.m. There is also a workshop with oil and gas representatives regarding code changes, in the Event Center of the Administration Building at 2:00 p.m. tomorrow. Commissioner Freeman commended Commissioners Conway and Kirkmeyer for the knowledge they continually share at CCI. Commissioner Conway thanked the Public Works crews for their work in this week's snowstorm, he noted that after he crossed the County line into Region 6, the roads were barely passable, but Weld roads were fine. Commissioner Kirkmeyer announced the public grand opening/open house of the state-of-the-art Regional Communications Center, on Wednesday, February 5, from 1-5:00 p.m., Sunday. Fi Chair Rademacher announced there will be another Broncos/jeans day this Friday, January 31, 2014. BIDS: El 1) PRESENT BID #B1400025, GEOTECHNICAL TESTING SERVICES FOR 2014 - DEPARTMENT OF PUBLIC WORKS: Trevor Jiricek, Director of General Services, said there were nine (9) vendors and this bid will be brought back before the Board with a recommendation from staff and a summary of costs on February 12, 2014. NEW BUSINESS: IE 1) CONSIDER VETERANS SERVICE OFFICER'S MONTHLY REPORT AND CERTIFICATION OF PAY FOR DECEMBER, 2013, AND AUTHORIZE CHAIR TO SIGN: Toby Taylor, Veterans Officer, presented the report to the Board and requested approval. Commissioner Conway noted the outreach volume continues to be phenomenal and he moved to approve said report and certification of pay and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. Minutes, January 29, 2014 2014-0278 Page 2 BC0016 2) CONSIDER 2013 ANNUAL MILEAGE AND CONDITION CERTIFICATION REPORT FOR THE HIGHWAY USER TAX FUND: Rich Hastings, Department of Public Works, presented the certification report, and explained how to read the CDOT Highway User Tax Fund Mileage Certification (HUTF), which determines how State funds are disbursed, and reviewed its contents. In response to Commissioner Conway, Mr. Hastings said the missile silo road is maintained by the Air Force, and there were 41 annexations this past year (8.5 miles of road and seven bridges). Commissioner Conway said it is important to make sure the annexing parties take care of these roads. Commissioner Conway moved to approve said report. Seconded by Commissioner Garcia, the motion carried unanimously. 3) CONSIDER AGREEMENT PURSUANT TO SECTION 30-11-123, C.R.S., and AND AUTHORIZE CHAIR TO SIGN - CARGILL, INC.: Bruce Barker, County Attorney, reviewed the terms of the agreement, and mentioned that they still have to come before the Board every October. Commissioner Conway said it is positive news for the County that they are located here. Commissioner Garcia moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. El 4) CONSIDER AMENDED SMALL TRACT OIL AND GAS LEASE AND AUTHORIZE CHAIR TO SIGN - CONTINENTAL RESOURCES: Esther Gesick, Clerk to the Board, said her office is reviewing old records and in this case the lease was not filled out correctly, so this item is primarily for housekeeping purposes. Commissioner Freeman moved to approve said amended lease and authorize the Chair to sign. Seconded by Commissioner Garcia, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
