WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that a certain tract of land being
the property of Raymond S. Yeager and Dorothy M. Yeager, husband and
wife, Keenesburg, Colorado, and more particularly described as follows:
That part of the Southeast one-quarter Section 22, Township
1 North, Range 63 West of the Sixth Principal Meridian, Weld
County, Colorado, described as;
Beginning at the Southwest corner said Southeast one-quarter
(S'- Cor)
Thence North 90°00'00" East on an assumed bearing along the
South line said Southeast one-quarter a distance of 2645. 14
feet to the Southeast corner said Section 22;
Thence North 00°25'46" East along the East line said South-
east one-quarter a distance of 2616. 97 feet to a point 16. 50
feet (1 rod) South of the Northeast corner said Southeast one-
quarter (El Cor);
Thence North 89°39'18" West parallel with the North line said
Southeast one-quarter a distance of 2622. 71 feet to a point on
the West line said Southeast one-quarter;
Thence South 00°54'58" West along said West line a distance of
2633. 02 feet to the point of beginning; containing 158. 717 acres,
more or less,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in 1973 C. R. S, 30-28-101 (10), as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has studied the request of the petitioner and
studied the recommendations of the Weld County Planning Commission,
and having been fully informed, now desires to exempt this particular
division of land pursuant to its authority under 1973 C. R. S. 30-28-101
(10) (d), as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by Raymond S. Yeager and Dorothy M, Yeager,
husband and wife, Keenesburg, Colorado, be exempted from the definition
of the terms "subdivision" and "subdivided lands" as provided for in the
new Weld County Subdivision Regulations at Section 2-1,A. , (3) adopted
August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 18thday of February,A. D, ,
1976.

Dear Commissioners:
The attached application, plat, and related items are in reference to a re-
quest, by Raymond C. and Dorothy Yeager, for a Recorded Exemption. The
Parcel in question is described as part of the SEa of Section 22, T1N,
'R63W Of the 6th P.M. , Weld County, Colorado. Said property contains
156.396 irrigated acres. The request is to split oft" a 14.572 acre parcel
with improvements from the property.
Based upon the information submitted, the Planning staff recommends denial
for the following reasons:
1 . The proposed split does not comply with the Weld County Compre-
hensive Plan because it would promote non-agricultural use of
agricultural land, and it would encourage urban encroachment
on rural land uses.
2. The recorded exemption request is not in compliance with the intent
clause of the recorded exemption procedure (Section 9-2 of the Weld
County Subdivision Regulations). Said clause states:
"The intent in establishing the Recorded Exemption procedure
is to provide, in accordance with the Weld County Compre-
hensive Plan, a means whereby non-productive agricultural
land may be developed for higher or more productive uses,
in-so-far as such uses are compatible with surrounding
agricultural uses in areas where such land divisions are
proposed. (Rev. 4/17/74)"
The granting of the recorded exemption would allow for the conversion
of productive agricultural lands since a new set of improvements would
be allowed on the 142_,3 acre parcel .

3. The recorded exemption request is not in conformance with the intent
clause of the Agricultural Zone District (Section 3.3 A of the Weld
County Zoning Resolution). Said section states:
"Intent - The intent in establishing the A-I .Agricultural
Zone District is to allow all agricultural and related
uses in those areas in which agriculture is and should
continue to be the predominant land use. This district
is intended to discourage encroachment of incompatible
uses upon the agricultural land in the district, to en-
courage agricultural uses as the highest and best use
of the land in the district as compared with other uses
in conflict therewith, and to provide for the orderly
expansion of urban growth in conformance with the Weld
County Comprehensive Plan."
The request would not be encouraging agricultural uses as the highest
and best uses, it would not be providing for the orderly expansion of
urban growth, and it would be breaking up a large block of agricultural
land.
4. The granting of the recorded exemption would potentially be doubling the
residential density since a set of improvements if applied for would
be permitted on the 142.3 acre parcel .
The particular circumstances of this request warrant clarification at this
point. The applicant had an exclusive listing with a real estate agent
for the sale of the 14.572 acre parcel prior to the adoption of Senate Bill
35 by Weld County. However, the sale of said parcel to Maior W. and Sarah
A. Tappan occurred subsequent to the adoption of Senate Bill 35 by Weld
County, and therefore approval of the Recorded Exemption i s necessary
prior to the granting of a building permit for a residence on the 142.324
acre parcel .

Gentlemen:
In answer to your inquiry as to the need for the sale by
the Yeagers to the Tappans, we state the following:
1. The reason for splitting off the property is
simply that the Yeagers had three years in a row
in which they had minimum income. They had
to raise money in order to place their financial
affairs in proper condition and therefore they
offered for sale the piece of ground with the house
on it. Another crop failure, whether from hail
or some other cause, would have meant financial
disaster and loss of the entire holdings for the
Yeagers. The financial problem was created by the
1969 freeze-in of the beets, and the approximately
70 to 80 percent loss of crops.
2. The division is that the 14. 572 acre tract has a
concrete line ditch along the west side of tract
B. The depth was really determined by leaving a
short distance between the improvements and the
concrete ditch. The 10 acres of farm land simply
made a simple tract by using the concrete ditch.
3. The use for Parcel A is strictly farming. The use
of the south 10 acres of Parcel B is for farming.
The use of the balance of Parcel B is that it is
covered by improvements and buildings of various
kinds, and garden and lawn.
