Dear Ms. Berthod,
The Weld County Board of County Commissioners (BOCC) received your letter dated August
29, 2013 which outlines your frustrations of USR13-0024 being approved and the applicant's
unwillingness to move the location of the kennel.
At the request of the Board of County Commissioners staff prepared this response to your letter.
On July 31, 2013 the business associated with the USR listed herein was approved by the
BOCC and it was suggested at the conclusion of the hearing that the applicant meet with the
neighbors to discuss the placement of the kennel. It sounds like the applicant met with
neighbors to discuss options and concerns but still elected not to relocate the kennel.
The relocation of the kennel was not a requirement under the provisions of the USR. At this
time, we recommend you continue to work with your neighbor to achieve mutually acceptable
terms. The Board of County Commissioners will not interfere with the current operations under
the approved USR, unless there has been a clear violation of the development standards listed
in the Resolution.

Narrative:
The BOCC conditionally approved USR13-0024 on July 31, 2013 for a 75
dog boarding kennel and a 25 doggie daycare facility. At the hearing the
BOCC suggested the applicant meet with the neighbors to discuss the
placement of the kennel. After the hearing the applicant met with the
neighbors to discuss options and concerns. As a result of the meeting the
applicant has elected to not relocate the kennel. The applicant is still in the
process of addressing the conditions of approval per the BOCC resolution.

Dear Commissioners:
The granting of the above referenced permit was very disappointing to me
and the entire neighborhood. However, I wanted to thank you for at least
recommending that Mr. Childs make a reasonable attempt to address the
concerns of the adjacent property owners with the placement of his
buildings.
Attached is the letter I and my neighbor, Dan Borys, received from Mr.
Childs. While Mr. Childs' letter indicated he wanted to "review and address
our concerns as recommended by\the Weld County Commissioners," the
reality came to light at our meeting. Mr. Childs had absolutely no intentions
of making any changes to the placement of his buildings due to the
increased costs that would be incurred by moving them to our suggested
locations. Also attached is the letter I sent to Mr. Childs reflecting these
facts.
It is my opinion, due to the overwhelming response of the neighborhood
against the approval of a commercial operation of this magnitude, the Board
abused its discretionary powers in granting the permit without requiring
reasonable restrictions, as requested by the surrounding landowners.
Hopefully, in the future, if you think a recommendation is warranted that
you would consider making it a condition of approval. I would also
recommend that your Land Use Planning Department make some attempt to

verify the facts presented with future applications to avoid deceitful concepts
as was present with this application.
It is my belief that Weld County and its' governing powers generally support
landowners by giving them the freedom to do as they choose with their land.
As I stated at the hearing, I also support this concept. The members of my
neighborhood have already made investment in their property and some
spent their lives being good shepherds of their land. Most of us are retired
and on a limited income. Unlike Mr. Childs who has YET to even purchase
the property, moving is not an option. Therefore, it seemed it would be
more appropriate for Mr. Childs to find a more commercially oriented
location for his commercial operation that would be more consistent with the
current surrounding use of the area. Whether you choose to believe it or
not, the granting of this permit has had a devastating_impact-o r_ne my
property value, and the general outlook o--my e tire neighborhood.
With all due respect, I would like to request a reply from the Board. My

Dear Mr. Childs:
I wanted to express my disappointment in the outcome of our meeting last evening.
When I received your letter stating you wanted to "review and address our concerns, as
recommended by the Weld County Commissioners," I was hopeful you would be
receptive to our suggestions. The reality is that you had no intentions of changing
anything due to the added costs of the suggested placement of your buildings.
As the neighbors all stressed at the hearing and as the Commissioners strongly
suggested, the proposed placement of the buildings is inappropriate and inconsistent
with the current surrounding use of the area insofar as you want to put the kennel and
related structures and runs closest to existing home sites. The Commissioners directed
you to undertake reasonable accommodations to respect the current concerns of the
existing landowners. The only thing at this point that will demonstrate your compliance
with this condition is to locate the kennel and related structures as far away from the
current residences as possible and place your own residence on the west side of the
property. The fact that you refuse to execute the suggested location of the buildings is
considered a failure to respect my and others' concerns and will lead to continued
objection to your commercial operations.
It would have been a more efficient use of all of our time if you had just been honest in
your letter instead of presenting all the "fluff". I wish you luck with your endeavor and
hope whatever underlying motivations are pressing you forward are worth it.
