WHEREAS, the Board of County Commissioners of Weld County, G Colorado, pursuant. to 'Coloradostatute and the Weld County Home r uN Rule Charter, id vested with the authority of administering the affairs of Weld County, Colorado, and r- WHEREAS, the Board, of County Commissioners considered a • . petition by certain . landowners to vacate County Road No. 25 �^ south of County Road No. 46 in Weld County, Colorado, and O WHEREAS, the Board of County Commissioners further has considered the recommendation of the County Engineering Depart- g ment to vacate said county road south of County Road No. 46 , which is approximately one-half ('0) mile in length, and WHEREAS, the Board of County Commissioners finds that it is in the best interest of Weld County to vacate said road due to the fact that said road is not now needed for public use, subject, however, to Weld County reserving its right-of-way easement on said property, and also maintaining all set-back requirements from Weld County's right-of-way easement on said property, and further, subject to a perpetual right of ingress and egress by Weld County vehicles to the Bernhardt pit which is located in Section 18, Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that County Road No. 25 located south of County Road No. 46 in Weld County, Colorado, as described above, be, and hereby is, vacated, subject to the con- ditions set forth in this Resolution. Rd. 25 South of Co. Rd. 46 SUBJECT: It is the recommendation of this office to' grant .said request for vacation of Weld County Road 25 as requested in the Road Petition filed with the Clerk to the Board July 12, 1977 at 3 :45 P.M. Since the abandonment of the II.P.R.R.station at Dent this "stub" road is not needed for public use any longer. In its present state it causes many problems for adjacent land owners , and makes an ingress and egress to Wildcat Mound for 4 wheel drive vehicles and motor bikes.
