HEARING CERTIFICATION DOCKET NO.2014-57 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR14-0019,FOR MINERAL RESOURCE DEVELOPMENT FACILITIES,INCLUDING OIL AND GAS SUPPORT AND SERVICE FACILITIES(COMPRESSOR STATION FOR NATURAL GAS AND ALL RELATED EQUIPMENT,INCLUDING BUT NOT LIMITED TO, EIGHT (8) COMPRESSORS, VAPOR RECOVERY UNITS, SEPARATORS, DEHYDRATORS, STORAGE TANKS) AND ONE (1) SEVENTY-FOOT IN HEIGHT COMMUNICATION TOWER IN THE A (AGRICULTURAL) ZONE DISTRICT - ANADARKO E&P COMPANY,LP A public hearing was conducted on August 20,2014,at 10:00 a.m.,with the following present: Commissioner Douglas Rademacher,Chair Commissioner Barbara Kirkmeyer,Pro-Tem-EXCUSED Commissioner Sean P.Conway Commissioner Mike Freeman Commissioner William F.Garcia Also present: Acting Clerk to the Board,Susan Brown Assistant County Attorney,Brad Yatabe Planning Department representative,Diana Aungst Public Works representative,Don Carroll Health Department representative,Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated July 11,2014,and duly published July 16, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Anadarko E&P Company,LP,for a Site Specific Development Plan and Use by Special Review Permit, USR14-0019, for Mineral Resource Development Facilities, including Oil and Gas Support and Service Facilities(compressor station for natural gas and all related equipment, including but not limited to, eight (8) compressors, vapor recovery units, separators, dehydrators,storage tanks)and one(1)seventy-foot in height communication tower in the A(Agricultural)Zone District.Brad Yatabe,Assistant County Attorney,made this a matter of record. Chair Rademacher advised Nathan Keiser,applicant,that he has the option of continuing this matter to a date when the full Board will be present. However,if he decides to proceed today, it will require three affirmative votes, or, in the case of a tie vote, Commissioner Kirkmeyer will listen to the record and make the determining vote. Mr. Keiser indicated he would like to proceed today. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She displayed photographs and maps of the site and surrounding area. C C:?L CF►(B%/)?w(Ac)HL q�� 2014-252O PL1738 HEARING CERTIFICATION-ANADARKO E&P COMPANY,LP(USR14-0019) PAGE 2 le Ms.Aungst stated four surrounding property owners spoke in opposition to the project at the Planning Commission hearing,and the Landscape Plan was developed in response to those concerns. In response to Commissioner Conway,Ms.Aungst stated there was a community meeting in June prior to the Planning Commission,but issues were not completely resolved therein. Don Carroll,Department of Public Works,provided a brief overview of the transportation plans and requirements.This will be an unmanned facility with one employee visiting the site on a daily basis. He also reviewed access and traffic counts. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions.The driving areas will be gravel and native vegetation will be established to stabilize the soil,and a Noise Abatement Plan was submitted. Chair Rademacher opened the floor for early public testimony. David Reitz,surrounding property owner one-half mile to the east,said they are not opposed to oil and gas operations, but they have`quality of life'issues with this project creating an industrialized view. He said their remaining concern is that Anadarko remain in dialogue with them and implement and maintain their landscaping plan. He also expressed concerns regarding speeding trucks and requested a safety analysis of the three-way stop at CRs 28 and 21. The Board asked Public Works staff to make contact with Mr. Reitz to examine that issue and there was additional discussion. PART II (Clerk's Note:Audio from this point is available in document HE-57,Part II) • Nathan Keiser, Anadarko Petroleum, stated this compressor station will be almost identical to the other seven they have recently built in the area and showed their locations. Mr. Keiser said they have taken a large number of trucks off County roads by building these and using pipelines for transport. He also reviewed technological improvements that allow them to operate well below noise limits, and stated there is a 70-foot tower which provides safety communications,a hotline for the Colorado public to contact Anadarko and get a call back within 24 hours,and a new landscaping plan. • Mr. Keiser showed images of the plan for the facility. In response to Commissioner Conway,he said the property slopes down gradually from east to west so the facility is in a slight depression. Commissioner Conway said public complaints about the other stations center around excessive noise;Mr.Keiser assured the Board the station will be in compliance with the 55-decibel limit of the Colorado Oil and Gas Conservation Commission at the fence line of the site. He said the new design of these facilities is all contained and quieter,with no emissions. Ms.Light said 60 decibels is at the level of normal human speech,but noted staff also gets complaints regarding vibrations.There was further discussion regarding the facility's lighting. Mr.Reitz pointed out this facility is further from the County road than their other facilities. Chair Rademacher asked about the availability of water to keep the trees alive,and the applicant affirmed it was available and Anadarko would keep their landscaping commitments. 2014-2520 PL1738 HEARING CERTIFICATION-ANADARKO E&P COMPANY,LP(USR14-0019) PAGE 3 Lois Reitz stated she agreed with her husband's comments,but is still concerned about construction traffic,and the danger of excessive speeds combined with huge potholes. She confirmed this area is maintained by CDOT. Commissioner Conway stated he and/or staff would mention this area to Gloria Hice-Idler,with CDOT Region 4,at the next Highway 85 Coalition meeting,so this is on her radar(especially the potholes).This meeting is open to the public and rotated around the County.Commissioner Conway said Public Works staff would follow up with the Reitz on that matter,and there was further discussion regarding traffic counts. Mia Tsuchimoto,surrounding property owner,stated they appreciate Anadarko working to mitigate most of their concerns and aren't opposed to the station;however,the landscaping is a high priority because this is a rural,not industrial,area. She concurred with the traffic sign requests of Mr.Reitz,with a Stop sign at CR 21. Commissioner Conway agreed that leaving a paved road to washboard conditions going too fast is dangerous.He said this is a valid safety concern,and recommended that Janet Lundquist,Department of Public Works,contact these neighbors when she is in this area to examine the conditions. In response to a question, Mr. Keiser stated that Anadarko was in discussions with Tri-State to build a sub-station,but have since said they will most likely not sell that piece of land to Tri-State. Ms.Tsuchimoto said she hopes they will continue to hear their concerns after this is granted.Ms.Aungst confirmed that a sub-station is not a part of this USR request,but would have to come before the Board as a separate matter. Kirsten Jimenez presented a letter to the Board,to be entered into the record as Exhibit H. She said her property is at the intersection of CRs 28 and 21.5 and her home is within 100 feet of the proposed location.She said she is concerned about what is happening to the County and her home,and said Anadarko has a history of polluting. She stated she is not part of an activist group,she just wants to protect her children,and is not convinced the application adequately describes what will be located at the site.She addressed the acknowledgement in the USR that there may be spills,saying she felt that was a basis for denial of this USR and presented an alternative parcel available nearby. In response to Commissioner Conway, she showed a picture of the actual signage typically at these sites, noting the reference to dangerous emissions. In response to Chair Rademacher,Mr.Keiser confirmed the signs posted are required by law,but also company policy. He stated the pollution incident that was referred to in public comment was at their Fort Lupton facility,and noted a processing station is very different from a compressor station,and stated this facility will have no emissions;however,there is a potential for a gas leak caused by an emergency release,in that event they would immediately notify surrounding residents and the facility would be remotely and immediately shut down. In response to Commissioner Conway,Mr.Keiser said there are emergency response protocols in place and response depends on the nature of the emergency. Chair Rademacher asked that once the site is built,the Mountain View Fire Protection District be consulted,as well as the Office of Emergency Management;the plan needs to be reviewed annually and their contact with the neighborhood should remain proactive. Bruce Barker,County Attorney,noted they are required to submit a safety plan to the Office of Emergency Management. Condition of Approval#1.C refers to the annual update of the EOC plan. 2014-2520 PL1738 HEARING CERTIFICATION-ANADARKO E&P COMPANY,LP(USR14-0019) PAGE 4 Chair Rademacher requested an annual update to the Board in response to public concerns about landscaping,and Mr.Keiser assured the Board Anadarko will hire a reputable landscaping firm.He also suggested Condition of Approval#5.C,regarding a special transport permit should be removed,and this was done by assent of the Board. Ms.Aungst confirmed the resolution language includes maintenance. lel In response to Chair Rademacher,Mr.Keiser said he and the applicant have reviewed, and agree to abide by,the Conditions of Approval and Development Standards,as amended. Commissioner Garcia moved to approve the request of Anadarko E&P Company,LP for a Site Specific Development Plan and Use by Special Review Permit,USR14-0019,for Mineral Resource Development Facilities, including Oil and Gas Support and Service Facilities (compressor station for natural gas and all related equipment,including but not limited to,eight (8)compressors,vapor recovery units,separators,dehydrators, storage tanks)and one(1) seventy-foot in height communication tower in the A(Agricultural)Zone District,based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record.The motion was seconded by Commissioner Freeman. Commissioner Garcia thanked everyone for coming and expressing their issues and concerns and being part of the process,and he also thanked the applicants for their well-prepared presentation and proactively contacting the neighbors. Commissioner Conway concurred,and thanked the attendees for bringing their road maintenance issues to the Board's attention. In regard to pollution concerns,he said the Environmental Protection Agency and the Colorado Department of Public Health and Environment do periodic testing,so experts are looking out for the public's health and safety. He also assured the neighbors that Anadarko has an excellent track record of working to mitigate their impacts in Weld County.Commissioner Freeman concurred, and said that Anadarko has done an excellent job with the last three compressor stations. Commissioner Conway noted there are also environmental and safety benefits for the County with the fact that these stations lessen the requirements for truck traffic. Chair Rademacher concurred.The motion carried unanimously.
