RE: APPROVE REQUEST OF ELWOOD HERBST TO TRADE RIP-RAP FOR DIRT.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Elwood Herbst has requested that he be allowed to
remove excess dirt from the borrow area on Weld County Road 42,
east of Weld County Road 55, and in exchange for said dirt, the
County remove and be allowed to use the rip-rap stored on the
Herbst property, and
WHEREAS, the Department of Engineering Services has made an
on-site inspection and recommends that the Board of County Com-
missioners of Weld County, Colorado grant Mr. Herbst the right
to remove excess dirt from the borrow area on Weld County Road 42,
and further that Mr. Herbst sign the proper permit with no fee
to be charged for said permit, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado deems it in the best interests of Weld County to grant
said request.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the request of Elwood
Herbst, abovestated, be and hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
October, A.D. , 1978.

An on site inspection was made of this request . My recommend-
ation would be to grant Mr. Herbst the right to remove excess
dirt from the borrow area on Weld County Road 42 , east of
Weld County Road 55 after he has signed a proper permit and
given the County the right to remove and use the rip-rap
stored on his property .

IT IS UNDERSTOOD that the Permittee will cause the installation at no expense whatsoever to Weld County and that

All road crossings shall be bored. Said installation shall he encased in pipe of larger diameter when required end the
crossing shall be as nearly perpendicular to the roadway as physically possible. No water shall be used in the boring and no
tunneling shall be permitted.
Where the installation crosses any ditch, canal or water carrying structures, wherever possible it shall be pushed through
and beneath in a pipe of larger diameter thereby eliminating the necessity of trenching. In no case shall the flow of water ever
be Impaired or interrupted. The applicant shall obtain permission to cross all irrigation ditches from the owner of each ditch.
This work must be accomplished in accordance with accepted good practices and conform to the recommendations of the
National Electric Safety Code and to such statutes as are applicable.
• Construction warning signs, conforming to the Uniform Traffic Control Device Manual and to the Colorado Supplement,
shall be in place daily prior to starting any work. If proper s'gn, are not in place during any work, the County Engineer or Ins as-
signed agent shall immediately stop all work until proper signs ate in place.
Traffic shall be maintained on all roads at all times. Flagmen shall be provided at any locations where the orderly flow of
traffic Is interrupted.

and their officers and employees harmless from any and all loss and damage or any claims which may arise out of or he con-
nected with the installation, maintenance, alteration, removal or presence of the Installation herein referred to or any work or fa-
cility connected therewith, within the area covered by this permit.
If it becomes neeess.i ry to change the location of the proposed line written approval must be secured from the County
Engineer. -
Perntittee will be required to shut off lines and remove nil roe L'istible materials front the County right of way when requested
to do so by Weld County, Colorado, because of necessary highway construction or maintenance operations.
Perntittee shall mark this installation with markers arcepa the to Weld County, Colorado, a minimum of two signs per mile,
and shall be marked by two signs at each bridge and or ditch crossing, and at each road crossing.
In the event any changes are made to this roadway in the future that would necessitate removal for relocation of this
installation, Permfttee will do so promptly at its own expense open written request from Weld County, Colorado. Weld County,
Colorado, will not be responsible for any damage that nay result in the maintenance of the highway or to the installation
placed inside County right of way limits.

SPECIAL CONDITIONS •
REQUIREMENTS FOR INSTALLATION OF UTILITIES WITHIN COUNTY RIGHT OF WAY
WELD COUNTY, COLORADO
1. The Weld County Engineering Department must be informed of the start date of all construction in order to provide inspec-
tion during construction. Bores and encasements under roads must be inspected. The depth of burled pipe must he inspected.

3. The applicant shall notify the local police, ambulance, and fire department stating duration of all road closures. All road
closures must be approved by the Board of County Commissioners by official resolution.
4. All work covered by this permit must be completed within 30 days of the issue date.Extension of the completion date may be
granted upon proper request to the County Engineering Department.
5. As a general rule, utilities will not be located under the roadway surface or immediately adjacent to the roadway surface, ex-
cept for

6. The hRlklli ttoYtjfl shall provide all necessary signs and barricades in accordance with the Manual on Uniform Traffic Con-
trol Devices and the latest. Colorado Supplement.
1. As a general rule, open cutting of road surfaces will not be permitted.
8. No cleated or track equipment to work on or move over asphalt surfaces without mats.
A. All disturbed•portions of right of way are to he returned to original condition at a time designated by Weld County, Colorado.
10. Any materials from excavation ns the result of utility installation will be removed from highway surface each day.
11. Under no condition is an asphalt surface to be cut unless otherwise specified in the special conditions.
12. Murljacking will he required where bores are larger than lines or encasements.
13. The ends of bored sections are not to be covered before being inspected.
14. Nn plastic line is to be installed without encasement under pavement regardless of pressure and size unless special permission
to do so is granted by Weld County.
15. Encasement of line may he required from toe of slope to toe of slope under all highways and paved County road Intersections
and approaches if lines are over two inches in diameter or more than 100 psi pressure.
10. Manholes and other points of access to other underground utilities may be permitted within the right of way only when they
are located beyond the shoulder of the through traffic roadway.
.17: All requests for installation will he reviewed in the field by representatives of Weld County. Colorado, prior to any issuance of
any permit.
18. Where special eases warrant Weld County will permit the installation of underground utilities paralleling highways along the
slope of the shoulder. In the event such permits are issued, it will be required by the contractor that material removed must
be replaced in like kind and with same or better compaction. No segregation of material will be permitted.
19. The construction of underground installations will generally require the services of an inspector furnished by Weld County,
Colorado. The decision in regard to which project requires inspection is reserved by Weld County, Colorado. All extraordi-
nary costs relating to the Inspection of such utility installation will be borne by the Permlltee at a rate specified by Weld
County.
20. All drainage facilities or siphons will he opened immediately upon completion of work at sites of drainage or siphon installa-
tion. Damaged portion of drainage or siphon facility will he replaced. All damaged sections are to be inspected by Weld
County, Colorado. before being concealed in any manner. Drainage ditches or borrow pits are to be restored to original con-
dition immediately after backfilling is completed.
21. No meters are to be placed within the highway right of way, excepting within corporate limits where municipal regulations
allow installation.
22. Thrust blocks will be required on all vertical and horizontal bends in water pipes.
23. Weld County does not warrant County right of way. The Permittee shall determine all ownership;and property lines.
24. Weld County may require a noncancelable cash or surety bond to insure compliance with the provisions of this permit. The
bond will remain in effect for a period of one year after all work has been completed. The total amount of the bond will be
determined by Weld County.
25. All necessary new gravel shall be placed en all surfaces where any damage has occurred to the road surface from equipment,
trenching, or storage of material. Weld County shall determine the damaged areas and depth of new gravel.
20, The installation of non ferrous lines in road right of way shall require a suitable menus to facilitate future line location.
27. For all utilities, regardless of installation, permit fee shall be based upon trench width as follows: Up to 6 inches -- $0.015
per lineal foot, 1 inches through 12 Inches — $0.03 per lineal foot, 13 inches through 24 inches -— $0.06 per lineal foot, 25
inches through 811 Inches - - $0.09 per lineal foot, 37 Inches and above -- $0.12 per lineal foot. Minimum permit fee will he
$5.00.
