Box 758 • Greeley, Colorado 80632 Dear Mr. Garcia: Re: Public Assistance eligibility determination—Weld County Request for Private Property Debris Removal & Demolition of Private Structures The Department of Homeland Security's Federal Emergency Management Agency (FEMA) has determined that your request for Private Property Debris Removal and Demolition of Private Structures is ineligible for Public Assistance funding. Please see the enclosed letter to the Colorado State of Emergency Management for detailed information on this determination. Under the Robert T. Stafford Disaster Relief and Emergency Assistance Act and applicable regulations, the Applicant is entitled to appeal this eligibility determination. The Applicant may appeal this determination to the FEMA Region VIII Regional Administrator pursuant to 44 CFR § 206.206. If the Applicant elects to file an appeal, the appeal must: (1) contain documented justification supporting the Applicant's position, (2) specify the monetary figure in dispute, and (3) cite the provisions in federal law, regulation, or policy with which the Applicant believes the initial action was inconsistent. An appeal must be submitted to the Colorado State Emergency Management Agency (Grantee) by the Applicant within 60 days of the Applicant's receipt of this letter. The Grantee's transmittal of that appeal, with a written recommendation, is required to be submitted to Region VIII within 60 days of receiving the Applicant's letter. In accordance with the FEMA Recovery Directorate Manual -Public Assistance Program Appeal Procedures (Version 2, 9/30/13), the date of receipt of this letter will serve as the date from which the Applicant's 60-day time period to file a first appeal runs.
