Henderson, Senior Assistant City Attorney Subject: Bliss Annexation Date: October 21, 2014 This office has reviewed the Petition for Annexation of Bliss Annexation into the City of Greeley and finds that the Petition for Annexation is in substantial compliance with the requirements of C.R.S. §31-12-107. Additionally, this office has reviewed the Petition for compliance with annexation requirements contained in C.R.S. §§31-12-104 and 31-12-105 and finds that the Petition meets the legal requirements of those sections. A draft resolution setting forth Council's proposed Findings of Fact and Conclusions is attached. Please schedule this matter for hearing in accordance with C.R.S. §31-12-108. Attachment SERVING OUR COMMUNITY • IT'S A TRADITION We promise to preserve and improve the quality of life for Greeley through timely,courteous and cost effective service. • PETITION FOR ANNEXATION BLISS ANNEXATION TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF GREELEY, COLORADO: The undersigned, in accordance with Title 31, Article 12, Chapters 101 et. seq., Colorado Revised Statutes, 1973, as amended, hereby petition the City Council of the City of Greeley for annexation to the City of Greeley of the territory described herein and described and shown on the map designated, " BLISS Annexation." The applicable number of said map (at least four) are submitted herewith and by this reference are incorporated herein. The description of the territory hereby petitioned for annexation to the City of Greeley is set forth in Exhibit A attached hereto and incorporated herein by reference. In support of this petition, the Petitioner(s) allege(s) that: 1. It is desirable and necessary that the above-described territory be annexed to the City of Greeley. 2. The requirements of Section 31-12-104 and 31-12-105 of the Colorado Revised Statutes exist or have been met in that: A. Not less than one-sixth (1/6) of the perimeter of the area proposed to be annexed is contiguous with the City of Greeley. B. A community of interest exists between the territory proposed to be annexed and the City of Greeley. C. The territory sought to be annexed is urban or will be urbanized in the near future. D. The territory sought to be annexed is integrated or is capable of being integrated with the City of Greeley. 3. In establishing the boundaries of the territory proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, has/have been divided into separate parts or parcels of real estate without the written consent of the land owner or land owners thereof, except and unless where such tracts or parcels are already separated by a dedicated street, road, or other public way. 4. In establishing the boundaries of the territory proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate comprising twenty (20) acres or.more which, together with the buildings and improvements situated thereon have an assessed valuation in excess of$200,000 for ad valorem tax purposes for the year next preceding the filing of the written petition for annexation, has/have been included within the territory proposed to be annexed without the written consent of the land owner or land owners. 5. The territory proposed to be annexed does not include any area which is the same or substantially the same area in which an election for an annexation to the City of Greeley was held within the twelve months preceding the filing of this petition. 6. The territory proposed to be annexed does not include any area included in another annexation proceeding involving a city other than the City of Greeley. • 7. The territory proposed to be annexed is not presently a part of any incorporated city, city and county, or town. 8. The property owned by each petitioner is described on each separate signature sheet and, when needed, described more fully in the exhibits attached hereto and incorporated herein by reference. 9. The signer(s) of this petition comprise(s) more than fifty percent (50%) of the land owners and owning more than fifty percent (50%) of the property, excluding public streets and alleys, and any land owned by the annexing municipality, and are, in fact, owners of one hundred percent (100%) of the property set forth in Exhibit A attached hereto and incorporated herein by reference. Accompanying this petition are the original and four copies of an annexation plat map containing the following information: A. A written legal description of the boundaries of the area proposed to be annexed. B. A map showing the boundary of the area proposed to be annexed. C. Within the annexation boundary map, an identification of the location of each ownership tract in unplatted land and, if part or all of the area is platted, the boundaries and the plat numbers of plots or of lots and blocks. Also within the boundary map, identification of any special districts the area proposed to be annexed may be part of D. Next to the boundary of the area proposed to be annexed, a drawing of the contiguous boundary of the annexing municipality and the contiguous boundary of any other municipality abutting the area proposed to be annexed. E. A surveyor's certificate prepared by a registered land surveyor that attests to the preparation of the map and certifies at least one-sixth (1/6) contiguity to the City of Greeley. F. Acceptance block describing the acceptance action of the City of Greeley in form and substance as provided in Appendix A of the Subdivision Regulations of the City of Greeley and providing for the effective date and City Clerk and Mayor attest signatures. 10. Except as otherwise provided, no part of the territory sought to be annexed is more than three miles from a point on the municipal boundary; as such was established more than one year before this annexation will become effective. 11. As an expressed condition of annexation, land owner(s) consent(s) to inclusion into the Northern Colorado Water Conservancy District and the municipal subdistrict pursuant to Section 37-45-136 (3.6) C.R.S. Land owner(s) acknowledge(s) that, upon inclusion into the district and subdistrict, land owner's (s') property will be subject to the same mill levies and special assessments as are levied or will be levied on other similarly situated property in the district and subdistrict at the time of inclusion of land owner's(s') lands. Land owner(s) agree(s)to waive any right to an election which may exist to require an election pursuant to Article X, Section 20, of the Colorado Constitution before the district and subdistrict can impose such mill levies and special assessments as it has the authority to impose. Changing some of our Agriculture buildings into Industrial buildings will bring in new growth and also job creation for Greeley. Additional signage may be requested in the future as new businesses lease from Bliss Industrial Park (Bliss Investments). There is existing signage located on the public ROW and is covered by BP#BCN050182. Building/Business signs are also present on some of the buildings; it is unclear if building permits are required for these signs. 6. Landscaping Requirements a. The total area of developed parcels is±31.09 AC or 1,354,280 SF. The undeveloped and landscaped areas total 194,722 SF and the areas of the Ogilvy Ditch are 165,702 SF. The total undeveloped area is 360,424 SF and accounts for 26.6% of the site. From the Weld County Code, 15% of the site shall be undeveloped or landscaped. These parcels meet the intent of the Weld County Code, Sec. 23-3-350. Design standards, section G-l. b. Where practical, trees have been planted to screen the site from the public ROW. c. Existing landscaping exist on site. 7. Storm Water Run-off See attached storm water narrative and WQCV calculations. 8. Off-street Parking Off-street parking has been added to the Site Analysis Map and will be addressed building by building. The surface type of all parking areas is an all-weather surface (Gravel and or Recycled Asphalt). Parking lot screening will be addressed by parcel. 9. Loading and Service Areas The loading area associated with 2440 E. 8`h St. is not presently screened from the public ROW. The loading area surfaces are of all-weather surface (gravel). The loading areas, of all parcels, do not encroach onto neighboring parcels. 10. Access All access points are existing approved accesses, see the site analysis map. JOB #2012-133 7 11. New Access No new accesses are proposed. 12. Acceleration/Deceleration Lanes. No acceleration/deceleration lanes are proposed for the existing access points. 13. Trash Collection The existing trash enclosures are constructed of steel siding with wood frames and match the existing buildings, see trash enclosure detail and pictures as provided. 14. Operation Standards a. Noise: Noise at this site has not been an issue in the past. Most of the activities that produce noise are preformed inside of the rental units. The surrounding zoning is I-3. b. Air Quality: The existing uses comply with the Colorado Air Pollution Control Commission. c. Water Quality: At the present time, no water is discharged by any activities present at the site. The existing septic systems are permitted with the Weld County Department of Health and Environment. Storm water quality will be controlled by the use of WQCV ponds for the parcel located below Ogilvy Ditch. Storm waters from areas above (north) of Ogilvy Ditch are historically drained into said ditch and do not impact State Waters (Cache La Poudre River). d. Radiation and Radioactive Materials: The presence of radioactive materials is not anticipated at this site at this time. Heat: Heat is not an issue for most of this site due to the large parcel size and the location of the buildings. Burrows Manufacturing (2024 E. 8th St.) is located adjacent to the West property boundary. The welding operations, as they now exist, do not produce temperature changes at the property line. e. Glare: The location of the buildings, relative to the property lines, reduces the amount of glare visible from the public ROW. All lighting is directed downward. Welding operations(Burrows Manufacturing) are presently conducted inside of their rental unit. Any welding operations performed outside will be shielded from the public ROW and any other business present in the area. f. Property Maintenance: Bliss Investments presently has a property maintenance plan in place. All existing trees and bushes are watered at least once per week during the growing season. This accomplished by using a tractor and 600 gallon water tank mounted on a trailer. 2,400 gallons of water are used weekly. Mowing and trimming operations are preformed every three weeks or more often as needed. Fertilizer is applied once per year during the growing season. Ground cover(grasses and weeds) is not allowed to exceed 12" in height. Noxious weeds have been controlled by spraying. JOB #2012-133 8 ANNEXATION REPORT In conjunction with the Bliss Annexation Application, the Applicant submits the following report concerning the setting of the Property, pedestrian connectivity, traffic impact, drainage, soils, and the relationship to the Comprehensive Plan. I. Setting of Property The Property consists of 66.76 acres located to the south of East 8th St./CO HWY 263 and north of the Cache La Poudre River. Four separate parcels comprise the total acreage. Anderson Salvage is located directly to the west, and several residential houses are located directly to the east. The Property is located within the Airport Overlay for the Greeley/Weld County Airport District and Tax District 0684. II. Pedestrian Connectivity There are no sidewalks located along East 8th St. in this vicinity. At this time, the Applicant is not proposing any new structures on the Property, and does not intend to construct any pedestrian walkways. III. Traffic Analysis Each parcel within the Property has one or more existing access points onto East 8th St. No additional access points are being requested and no modifications to those points are proposed at this time. The existing and proposed uses on the site generate varying numbers of average trips per day. Based on the Traffic Impact Report prepared by the Applicant, trips to and from the Property represented approximately 5.7 percent of the background daily traffic along East 8th St. during the period studied. In addition, the existing driveways onto the property and the respective geometries appear to function well and do not present any hazards. IV. Soils Report The soils on the Property consist of Bankard sandy loam, Nunn loam, Otero sandy loam, Aquolls and Aquents, and gravelly substratum. Those types of soils generally have a low risk of corrosion and moderate run-off potentials. V. Drainage The Applicant analyzed the drainage on each parcel separately: A. Lot A RE 238 —Parcel #096103000038 (4.098 acres) This parcel is situated on the eastern portion of the Property and is undeveloped. The storm water flows flow from north to south across grass pasture toward the Cache La Poudre River. The calculated WQCV for this parcel is 2,037 CF. B. Areas North of the Ogilvy Ditch—Parcel #096 103 00003 1 (2.57 acres) This parcel consists of the Bliss Investments' main office and a maintenance building used in conjunction with the Bliss Industrial Park. The general storm water flow direction for this parcel is from north to south and into the Ogilvy Ditch. The calculated WQCV for this parcel is 2,021 CF. C. Areas South of the Ogilvy Ditch—Parcel#096103000047 (24.4 acres) This parcel contains the majority of the site improvements including seven structure, five modular housing units, and oil and gas wells and facilities. The drainage flows on this parcel are from the north to the south. Two French drains have been installed just south of the five modular housing units to address drainage issues in that area. The calculated WQCV for this parcel is 15,941 CF. D. Lot B of AM RE-336—Parcel #096103000040 (35.668 acres) This parcel is largely undeveloped, other than for a farm house, large shop and three additional out buildings. Most of the parcel is situated within the Cache La Poudre River flood plain area for shallow flooding. The general drainage flow for the parcel is from the north to the south. The WQCV for this parcel is CF. VI. Relationship to the Comprehensive Plan The proposed Annexation is consistent with the City of Greeley Comprehensive Plan and specifically the Land Use and Growth Chapters Goals, Policies, Objectives and Actions. The proposed Annexation will satisfy goal LU1 by providing an appropriate and desired development plan consistent with the goal of sustainable and strategic growth in the City due to the Property's contiguity to the current City of Greeley boundaries and the current industrial uses of the Property. The proposed Annexation zoning will also satisfy goal LU4 based on the industrial characteristics of development along the 8th Street Corridor and its compatibility with adjacent land uses. The existing buildings on the Property are similar in design and appearance to other building along the East 8a' St. corridor. The subject site is located south of East 8`s Street, north of the Cache la Poudre River, and west of Fern Avenue (see Exhibit A). The subject annexation includes portions of the Cache la Poudre River to the south and the Ogilvy Ditch that runs parallel to the property to the north. The annexation also contains four parcels that include one single- family dwelling, five mobile homes, eleven industrial buildings, and three oil and gas wellheads with associated equipment (see Exhibit C). A portion of the subject annexation is within the Cache la Poudre River floodway and floodplain; however, none of the existing structures are located within the floodway (see Exhibit C). The proposed annexation is located inside the Long-Range Expected Growth Area (LREGA). The applicant is not proposing development at this time. When development is proposed, subsequent plans will be required to comply with the City's Development • Code that is in place at the time of requested development. In conjunction with the annexation, the applicant has applied to establish C-D (Conservation District) and I-M (Industrial Medium Intensity) zoning. The property must be zoned within 90 days of annexation. The zoning request will be evaluated during that process. COMPREHENSIVE PLAN The property is entirely within the City of Greeley's Long-Range Expected Growth Area (LREGA) and complies with City of Greeley Comprehensive Plan policies. ANALYSIS The proposed annexation has 42% contiguity with existing municipal limits which meets the State of Colorado one-sixth (16.67%) contiguity standard regarding annexations. The annexation will not further extend the municipal boundary of the City of Greeley in any direction. The annexation of this site into the City would be consistent with present growth patterns and Comprehensive Plan policies. There is evidence that this site shares a common interest with the City's future. The requirements of State statutes and City of Greeley guidelines for annexation appear to have been met by this requested annexation. Since the site is currently used as an industrial use, there should be no impact on School District No. 6.
